DECREE OF June 5, 2006.

Disposes about the creation of the Reservation Extrativision of Canavieiras, located in the Municipalities of Canavieiras, Belmonte and Una, State of Bahia, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the provisions of art. 18 of Law No 9,985 of July 18, 2000, regulated by Decree No 4,340 of August 22, 2002, and what is stated in the Process at 02006.002618 /2001-79,

DECRETA:

Art. 1st It is created the Canavian Extraction Reservation, located in the Municipalities of Canavieiras, Belmonte and Una, Bahia state, with an approximate area of 100,645.85 ha (one hundred thousand, six hundred and forty-five hectares and eighty-five centiars), with the following descriptive memorial: Partner from point 1, from geographical coordinates approximate 38 ° 58'24 ,02' 'Wgr and 15º22'58, 46' 'S, located on the maximum preammate line of the beach of Comandatuba Island, in Puxim da Praia, follows for an approximate distance of 2,358m and azimute 352º21'40? Art. 2nd The Canavian Extraction Reserve is aimed at protecting the means of life and the culture of the extractivist population resident in the area of its comprehension and ensure the sustainable use of the natural resources of the unit.

Art. 3rd Caberá to the Brazilian Institute for the Environment and Renewable Natural Resources- IBAMA administer the Canavian Extraction Reserve, adopting the necessary measures for its deployment and control, in the terms of art. 18 of Law No 9,985 of July 18, 2000, providing the contract for free use with the traditional extraction population, for the purpose of its celebration by the Office of the Union Heritage of the Ministry of Planning, Budget and Management, and monitor compliance with the conditions in it, in the form of the law.

Art. 4th Ficam declared of social interest, for the purposes of dispropriation, in the form of the Act in the 4,132, of September 10, 1962, rural real estate of legitimate private domain and their benefits that come to be identified within the limits of the Canavian Extractivision Reserve.

§ 1st The IBAMA gets authorized to promote and execute the misappropriations that it treats the caput of this article, and may, for the purpose of immission in possession, aller the urgency to which the art is referred. 15 of Decree-Law No 3,365 of June 21, 1941.

§ 2nd The Federal Prosecutor-General's Office, the body of the Union Advocate-General, through its unit implementation legal aid to the IBAMA, is authorized to promote the relevant administrative and judicial measures, targeting the declaration of nullity of any property securities and respective real estate records deemed irregular, incidents in the Canavian Extraction Reserve.

Art. 5th This Decree goes into effect on the date of its publication.
