DECREE OF June 14, 2005

Creates the Extraction Reservation Ipaú-Anilzinho, in the Municipality of Baião, State of Pará, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, having and seen the provisions of the art. 18 of Law No. 9,985 of July 18, 2000, in Decree No 4,340 of August 22, 2002 and the constant of Case No 02018.004531 /2001-26,

DECRETA:

Art. 1º It is created the Ipaú-Anily-Old Extractial Reserve, in the Municipality of Baiao, State of Pará, with the approximate area of fifty and five thousand, eight hundred and sixteen hectares and a centiare, having on the basis of the Cartas SA-22-Z-Z-A-VI and AS-22-Z-C-III, na scale 1:100.000, published by IBGE, with the following descriptive memorial: departing from Point 1, of approxic geographical coordinates 49 ° 40'0.53 "WGr and 03 ° 15' 27, 76" S, situated on the left bank of the Tocantins River, follows by a reta of azimute 232 ° 16'16 "and approximate distance of 4,355.09 meters to Point 2, of approximate geographical coordinates 49 ° 41'52.01" WGr and 03 ° 16' 54.68 "S; of this one, follows by a straight pore of azimute 266 ° 26' 18" and approximate distance of 2,269.76 meters to Point 3, from geographical coordinates approximate 49 ° 43'05.39 "WGr and 03 ° 16' 59.37" S; of this one, follows by a straight pore of azimute 235 ° 05'05 "and approximate distance of 2,002.21 meters to Point 4, of approximate geographical coordinates 49 ° 43' 59" WGr and 03 ° 17' 36.98 " S, situated in an igarapé without denomination ; of this one, follows by the left bank of the Tocantins River, in the upstream sense, by an approximate distance of 36,879.09 meters to Point 1, the beginning of this descriptive memorial, totaling an approximate one perimeter of one hundred and seventeen thousand, three hundred and fifty eight meters and seishundred and seventeen millimeters.

Art. 2º The Ionic Extractivist Reservation-Anilzinho aims to protect the livelihoods and culture of these populations and to ensure the sustainable use of renewable natural resources traditionally used by the resident extractivist population in the area of its comprehension.

Art. 3º The Office of the Brazilian Institute for Environment and Renewable Natural Resources-IBAMA to administer the Ipaú-Anyman Extractial Reserve, adopting the necessary measures for its deployment and control, in the form of art. 18 of Law No. 9,985 of July 18, 2000 providing for free use assignment contracts with the traditional extraction population, for the purpose of their celebration by the Office of the Union Heritage of the Ministry of Planning, Budget and Management, and monitor compliance with the conditions in them stipulated in the form of the law.

Art. 4º Stay declared of social interest, for the purposes of misappropriation, in the form of Law No. 4,132 of September 10, 1962, rural real estate of legitimate private domain and their benefits to be identified in the Extraction Reservation Ipaú-Anilzinho, for the purposes provided for in art. 18 of the Act No. 9,985, 2000.

§ 1º The IBAMA is allowed to promote and execute the dispossession that it treats this article, and may, for the purpose of immission of possession, aller the urgency to which the art is referred. 15 of Decree-Law No 3,365 of June 21, 1941.

§ 2º The Advocacy-General of the Union, through its legal unit of implementation together to IBAMA, is authorized to promote the relevant administrative and judicial measures, targeting the declaration of nullity of eventual property securities and their real estate records deemed irregular, incidents in the unit of conservation of which treats this Decree.

Art. 5º This Decree shall enter into force on the date of its publication.
