DECREE OF April 22, 2014

Declaration of public utility, for the purposes of misappropriation, in favor of the Autopista Planalto S.A. dealership, the real estate it mentions, located in the Municipality of Curitiba, State of Paraná.

THE REPUBLIC OF THE REPUBLIC, in the use of the attribution that confers you the art. 84, caput, inciso IV, of the Constitution, in view of the provisions of the art. 3º, art. 5º, caput, points "h" and "i", and art. 6º of Decree-Law No. 3,365 of June 21, 1941 on art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987 of February 13, 1995, and in accordance with the one in the ANTT Case No 50500.192262 /2013-51,

DECRETA:

Art. 1º Stay declared of public utility, for the purposes of dispossession, total or partial, in favor of the Autopista South S.A. dealership, the real estate bounded by the topographical coordinates described below, excluded domain goods public, situated on the banks of the Rodovia BR-116/PR, located in the Municipality of Curitiba, State of Paraná, necessary for the completion of the execution of the intersection works of intersection at dislevel with collector pathways in the km 116 + 500m:

I-area 1-starts the perimeter in the milestone named A, Georgian in the Geodetic System Brazilian, of coordinates Retangular Relative Plan, U.T.M.-Datum SIRGAS 2000 E=670228.384m and N=7172848.346m; of this one, follows with the azimute of 12 ° 59' 24 " and the distance of 5.97m, confronting with the 116/PR Rodovia, up to the milestone B (E=670239.7362m and N=7172843.308m) ; of this, follows with the azimute of 266 ° 30'00 "and the distance of 29 ,55m, confronting with remaining area, up to the milestone C (E=670197.553m and N=7172840.727m) ; of this one, follows with the azimute of 356 ° 47' 44" and the distance of 1.24m, confronting with remaining area, up to the milestone D (E=670197.483m and N=7172841.970m) ; of this one, follows with the azimute of 78 ° 20' 26 " and the distance of 31 ,55m, confronting with remaining area, up to the milestone A (E=670228.384m and N=7172848.346m) ; thus closing the perimeter of the polygon above described with area of 103 ,95m2 ; and II-area 2-starts the perimeter in the milestone named A, georreferenced in the Brazilian Geodetic System, from coordinates Relative Retangular Plan, U.T.M. System-Datum SIRGAS 2000: E=670227.043m and N=7172842.531m; of this, follows with the azimute of 12 ° 59'24 "and the distance of 31 ,18m, confronting with the 116/PR Rodovia, up to the milestone B (E=670219.936m and N=7172812.173m) ; of this one, follows with the azimute of 290 ° 50' 58" and the distance of 22 ,83m, confronting with remaining area, up to the milestone C (E=670198.698m and N=7172820.261m) ; of this one, follows with the azimute of 356 ° 47' 44 " and the distance of 20 ,50m, confronting with remaining area, up to the milestone D (E=670197.552m and N=7172840.727m) ; of this, follows with the azimute of 86 ° 30' 00 " and the distance of 29 ,55m, confronting with remaining area, up to the milestone A (E=670227.043m and N=7172842.531m) ; thus closing the perimeter of the polygon above described with area of 655 ,33m2.

Art. 2º It is the Seller South S.A. Autopista dealership authorized to promote, with own resources, the dispossession of the areas of land and benefits of which it treats art. 1º.

Single Paragraph. The exproprier is allowed to invoke the urgency character in the process of misappropriation, for the purposes of immission in possession, in the terms of art. 15 of Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exonerate the dealership of the prior obtaining of the licensees and the fulfilment of the obligations to the environmental entities and other bodies of the public administration, necessary to the effector of activities referred to in art. 1º.

Art. 4º This Decree shall enter into force on the date of its publication.
