DECREE OF February 25, 2003.

Declares in social interest, for agrarian reform purposes, rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplementary Act on 76, July 6, 1993, 18 and 20 of the Act No 4,504 of November 30, 1964, and 2º of the Act No 8,629 of February 25, 1993,

DECRETA:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of the Law No 4,504 of November 30, 1964, and 2º of the Law No 8,629 of February 25, 1993, the following rural real estate:

I-"Ribeira I, II and Santo Antônio", with area of two hundred and twelve hectares, thirty-three airs and ninety-eight centiars, situated in the Municipality of Traipu, object of the Registrars in the R-10-303, fls. 275, Book 2-B ; R-1-304, fls. 276, Book 2-B and R-2-269, fls. 241, Book 2-B, of the Estate Registration Office of the Traipu Comarca, Alagoas State (Case INCRA/SR-22/nº 54360.000241/2002-69) ;

II-"Fazenda Saint Gothardo", with area of two hundred and eighty-seven hectares and eighty ares, situated in the Municipality of New Veneto, object of the Registration in the R-2-6.882, Ficha 01, Book 2, of the Estate Registration Office of the Comarca of New Venetia, State of the Holy Spirit (Process INCRA/SR-20/nº 54340.000876 /2001-13) ;

III-"Cachoeirão Farm"-part, with area of three hundred and eighty hectares, one are and thirty-three centiars, situated in the Municipalities of Guaçui and São José do Footwear, object of the Registry in the R-6-2.431, fls. 52, Book 2-N, of the Estate Registration Office of the Guaçui Comarch, State of the Holy Spirit (Case INCRA/SR-20/nº 54340.000184 /2002-56) ;

IV-"Fazenda Simasa I", with area of seven thousand hectares, situated in the Municipality of Good Jesus of the Selves, object of the Registry in the R-2-2.059, fls. 185, Book 2-G, of the Charter of the 1º Offer of the Comarch of Santa Luzia, State of the Maranhão (Process INCRA/SR-12/nº 54235.000571 /99-97) ;

V-"Reserve Farm", with area of eleven thousand, one hundred and seventy three hectares, ninety and two airs and fifty two centiars, situated in the Municipality of the West Limeira, object of the Registry in the R-2-12.889, Ficha 01, Book 2, of the Registration Office of Real estate of the Iturama Comarch, State of Minas Gerais (Process INCRA/SR-06/nº 54170.000235 /2002-49) ;

VI-"Farm Two Siblings", with area of two thousand and six hectares, situated in the Municipality of Buíque, object of the Registrars in the R-7-1.278, fls. 22, Book 2-Q2 and R-10-1.278, fls. 94v, Book 2-Q2, of the Estate Registration Office of the Buyque Comarch, State of Pernambuco (Process INCRA/SR-03/nº 54140.001410 /99-51) ;

Art. 2º Excludes from the effects of this Decree the semovents, machines and agricultural implements as well as the existing benefits in the real estate referred to in art. 1º and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Law no 76, July 6 of 1993, and to maintain the areas of Legal Reserve and permanent preservation provided for in the Act No. 4,771 of September 15, 1965, preferably in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree goes into effect on the date of its publication.
