LEI No. 13,091, DE January 12, 2015

Disposes on the federal Supreme Court Minister's allowance, referred to in the inciso XV of the art. 48 of the Federal Constitution ; repeal device of Law No.12,771, of December 28, 2012 ; and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC I do know that the National Congress decrees and I sanction the following Law:

Art. 1º monthly allowance of Minister of the Supreme Federal Court, referred to in the inciso XV of the art. 48 of the Federal Constitution, observed the provisions of art. 4º of this Act, it will be R$ 33,763.00 (thirty-three thousand, seven hundred and sixty-three royal) to count from 1st January 2015.

Art. 2º From the financial year 2016, the monthly grant of Minister of the Federal Supreme Court will be fixed by law of initiative of the Federal Supreme Court, being observed, compulsorily, in accordance with the respective budget forecast, the following criteria:

I-the recovery of their acquisitive power ;

II-the position of the monthly High Court Minister's allowance as a remunerative ceiling for the public administration ;

III-the comparison with the subsidies and total remunerations of the members of the other State Carreiras and federal functionalism.

Art. 3º The expenses resulting from the implementation of this Act will run into the account of the budgetary appropriations earmarked for the organs of the Union Judiciary Branch.

Art. 4º The readjustment provided for in art. 1º of this Act is conditional on its express authorisation in annex of the annual budget law with the respective prior endowment, pursuant to § 1º of the art. 169 of the Federal Constitution.

Art. 5º This Act shall enter into force on the date of its publication.

Art. 6º It is revoked the inciso III of the art. 1º of Law No. 12,771 of December 28, 2012.
