DECREE OF December 10, 2004

Declares of social interest, for agrarian reform purposes, rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of Supplementary Law No. 76 of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964 and 2º of Law No. 8,629 of February 25, 1993,

DECRETA:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"Fazenda Santa Cruz of the Gold", with registered area of a thousand, eight hundred and thirty-eight hectares, ninety and one airs and thirty-one centiars, and measured area of a thousand, eight hundred and forty-three hectares, seventy airs and eighties and seven centiars, situated in the Municipality of Itamaraju, object of the Registrars in the R-1-1.961, fls. 199, Book 2-6 and R-1-1.962, fls. 200, Book 2-6, of the Estate Registration Card of the Itamaraju Comarch, State of Bahia (Process INCRA/SR-05/nº 54160.001657 /2004-12) ;

II-"Fazenda Cumbe", with registered area of seishundred hectares, and area measure of three hundred and nineteen hectares and thirty-five airs, situated in the Municipality of Maracás, object of the Registration in R-1-1.235, fls. 168, Book 2-E, of the Estate Registration Card of the Maracás Comarca, State of Bahia (Process INCRA/SR-05/nº 54160.001491 /2004-34) ;

III-"Malamba", with area of three hundred and sixty-one hectares and two airs, situated in the Municipality of Itapipoca, object of the Registration in R-2-1.481, fls. 32, Book 2-F, of the Estate Registration Office of the Itapipoca Comarch, State of Ceará (Process INCRA/SR-02/no 54130.002173 /2003-67) ;

IV-"Fazenda Castanhal Lajedo", with area of three thousand, three hundred and eighty-eight hectares, situated in the Municipality of Marabá, object of the Registration in the R-5-14.651, Fichas 01/02, Book 2, of the Estate Registration Office of the Comarca of Marabá, State of Pará (Process INCRA/SR-27/nº 54600.003732 /2003-72) ;

V-"Mata of the Chocalho", with area of four hundred and twenty hectares, situated in the Municipality of Jacaraú, object of the Registration in R-5-154, fls. 77v, Book 2-A, of the Registral Service of the Jacaraú Comarch, State of Paraíba (Process INCRA/SR-18/nº 54320.000582 /2004-72) ;

VI-"Fazenda Aymorés", with area of eight hundred and twenty-seven hectares, fifty and six airs and eight centiars, situated in the Municipality of Piraí, the object of the Transcript in the 2,570, fls. 285, Book 3-B and Registration No 701, fls. 120, Book 2-C, of the Real Estate Registration Office of the 1st Oftice of the Piraí Comarch, State of Rio de Janeiro (Process INCRA/SR-07/nº 54180.002304 /2003-11) ; and

VII-"Make Who You Know", with area of four hundred and eighty-six hectares, sixty-four airs and nine centiars, situated in the Municipality of Southern Centennial, object of the Registration in the R-33-650, fls. 08v, Book 2, of the Estate Registration Office of the Southern Centennial Comarch, State of Paraná (Process INCRA/SR-09/nº 54200.002767 /2003-05).

Art. 2º Delete from the effects of this Decree the semovents, machinery and agricultural implements as well as the existing benefits in the real estate referred to in art. 1º and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute for Colonization and Agrarian Reform-INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Act No. 76 of July 6, 1993, and to maintain the areas of Legal reservation and permanent preservation provided for in Law No. 4,771 of September 15, 1965, referentially in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree goes into effect on the date of its publication
