I do know that the National Congress has approved, and I, Renan Calheiros, President of the Federal Senate, in the terms of art. 48, inciso XXVIII, of the Rules of Procedure, promulgated the following


Authorizes referendum on the commercialization of fireweapon and ammunition on national territory, to be held on the first Sunday of the month of October 2005.

The National Congress decrees:

Art. 1º Art. 1º It is authorized, in the terms of art. 49, inciso XV, of the Federal Constitution, national referendum, to be organised by the Superior Electoral Court under Law No. 9,709 of November 18, 1998 to consult the electorate on the marketing of firearms and munitions in the national territory.

Art. 2º The referendum that it treats this Legislative Decree will take place on the first Sunday of the month of October 2005, and will consist of the following question: "the trade in firearms and ammunition should be prohibited in Brazil?".

Single Paragraph. If the simple majority of the national electorate is asserted affirmatively to the proposed question, the constant fence of the Disarmament Statute will enter into force on the date of publication of the result of the referendum by the Electoral Higher Court.

Art. 3º This Legislative Decree goes into effect on the date of its publication.
