DECREE OF February 25, 2003.

Declares in social interest, for agrarian reform purposes, rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplementary Act on 76, July 6, 1993, 18 and 20 of the Act No 4,504 of November 30, 1964, and 2º of the Act No 8,629 of February 25, 1993,

DECRETA:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of the Law No 4,504 of November 30, 1964, and 2º of the Law No 8,629 of February 25, 1993, the following rural real estate:

I-"New Horizon Horizon and Jacarandá", with registered area of one thousand, one hundred and twenty-three hectares, and measured area of one thousand, one hundred and twenty-eight hectares, eight airs and seventy-nine centiars, situated in the Municipality of Itambé, object of the Registration in R-1-2.153, fls. 81, Book 2-G, of the Registration Card of Real Estate, Itambé Comarch, State of Bahia (Process INCRA/SR-05/nº 54160.002942 /2002-99) ;

II-"Fazenda Catarina", with registered area of four hundred and twenty-eight hectares and eight airs, and area measure of three hundred and ninety and four hectares, twenty-seven airs and ten centiars, situated in the Municipality of Camamu, object of the Registry in the R-1-2.061, fls. 43, Book 2-G, of the Registration Card of Real Estate, Camamu Comarca, Bahia State (Process INCRA/SR-05/nº 54160.003792 /2002-31) ;

III-"Our Lady of the Rosary", with registered area of two thousand, six hundred and ten hectares, and measured area of a thousand, two hundred seventy and five hectares, two airs and forty-four centiars, situated in the Municipality of Monte Santo, object of the Registration in R-1-2.995, fls. 03, Book 2-A-8, of the Registration Card of Real Estate, Comarch of Monte Santo, State of Bahia (Process INCRA/SR-05/nº 54160.003898 /2002-34) ; and

IV-"Farm Birth and Conquest", with registered area of a thousand, two hundred and sixty-one hectares, and measured area of a thousand, eighty-five hectares, thirty-one airs and fifty-three centiars, situated in the Municipalities of Morro of the Hat and Tapiramutá, object of the Registrars in the R-5-4.829, fls. 88-F, Book 2-AV ; R-6-4.829, fls. 88-F, Book 2-AV ; R-7-4.829, fls. 88-F, Book 2-AV ; R-8-1.935, fls. 44, Book 2-S ; R-9-1.935, fls. 44, Book 2-S and R-10-1.935, fls. 44-A, Book 2-S, of the Estate Registration Office, Morro Comarca of the Hat, State of Bahia (Process INCRA/SR-05/nº 54160.003697 /2002-37).

Art. 2º Excludes from the effects of this Decree the semovents, machines and agricultural implements as well as the existing benefits in the real estate referred to in art. 1º and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Law no 76, July 6 of 1993, and to maintain the areas of Legal Reserve and permanent preservation provided for in Law No 4,771 of September 15, 1965, preferably in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree goes into effect on the date of its publication.
