DECREE NO 3,547, DE July 21, 2000.

Promulga the Cooperation Convenium Educational between the Federative Republic of Brazil and the Argentine Republic, celebrated in Brasilia on November 10, 1997.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers you the art. 84, inciso VIII, of the Constitution,

CONSIDERING that the Government of the Federative Republic of Brazil and the Government of the Republic of Argentina celebrated, in Brasilia, on November 10, 1997, a Convengen of Educational Cooperation ;

CONSIDERING that the National Congress has approved this Convenium by means of Legislative Decree No. 171, of December 6, 1999 ;

CONSIDERING that the Convenium entered into force on June 15, 2000, pursuant to its art. XVI ;

DECRETA:

Art. 1º The Convention of Educational Cooperation between the Federative Republic of Brazil and the Argentine Republic, concluded in Brasilia on November 10, 1997, apse by copy to this Decree, shall be executed and fulfilled as entirely as in it if contains.

Art. 2º They are subject to the approval of the National Congress any acts that may result in revision of the said Arranger, as well as any further adjustments that, in the terms of the art. 49, inciso I, of the Federal Constitution, carries charges or engraved commitments to national heritage.

Art. 3º This Decree shall enter into force on the date of its publication.

ARRANGEMENT OF EDUCATIONAL COOPERATION BETWEEN THE FEDERAL REPUBLIC OF BRAZIL AND THE ARGENTINA REPUBLIC

The Federative Republic of Brazil

And

The Argentine Republic

(henceforth termed as?Parts?),

Conscious that the educational systems must respond to the challenges of consolidating democracy in the context of increasing integration between the countries of the region, the productive transformations and scientific-technological advances ;

Determined to dynamic and update the bilateral relationship in educational matter through the reformulation of conventional instruments ;

Inspired in the mutual will to deepen the actions of cooperation between the educational systems of both states,

Wake up the following:

Article I

The Parties shall promote educational cooperation at all levels and modalities, among their organs competent, in the context of the integration process.

Article II

The Parties shall make efforts to make information on the characteristics available of the respective educational systems: their structures ; administration at the national and state levels ; human and infrastructural resources ; teaching career plans ; empowerment, initial training ; institutional organization ; evaluation methodology and too much information that results relevant for the purposes of the present Convenium.

Article III

1-The Parties will seek to facilitate direct linking between congenial institutions for them to elaborate, subscribe to and execute specific exchange and cooperation programmes in the field of human resource education and training.

2-In addition, the Parties will seek to stimulate exchange and cooperation in educational experiences innovative and foster the organization and execution of joint activities.

Article IV

Each of the Parties will stimulate:

a) the inclusion, in the content of the fundamental education courses, of the teaching of the official language of the other Part ;

b) the creation of specialization, postgraduate courses or specific courses on literature, history and national culture of the other state ;

c) the creation of specialization, postgraduate courses or specific courses that target the enhance the knowledge of the other Party's economic, political, social and technological reality ;

d) the creation of courses in Portuguese and Brazilian culture at the Argentinian universities and Spanish and Argentinian culture in Brazilian universities ;

e) the inclusion of content concerning regional integration in its distinct aspects in the different educational levels.

Article V

The Parties will seek to stimulate the planning and joint development of related activities with the areas of university extension and training and faculty empowerment.

Article VI

1-Parties will regularly grant scholarships and subsidies to stimulate and boost research joint and the transfer of technology.

2-AToo, bestower annually, in a reciprocal manner, graduate scholarships to students, researchers or experts sent by the other Party to perfect their studies.

3-The quantities and modalities of these grants or grants will be communicated by way of diplomatic.

Article VII

1-The ticket of students of a Party in undergraduate and graduate courses of the other Party will be governed by the same selective processes applied by the higher education institutions to the national students.

2-Students who benefit from specific agreements between the Parties shall be submitted to the selection processes established by these instruments.

Article VIII

The Parties will seek to stimulate the creation of exchange programs of faculty and students of university degree.

Article IX

The Parties will seek to promote cooperation between experts, technicians and specialists in education, well as the exchange of experiences that foster the linking of educational systems with the productive sector.

Article X

The Parties will seek to encourage the use of information technology for the dissemination of calendars of educational activities, contests, awards and scholarships, and relation of human resources and available infrastructure, as well as the other information that the Parties consider priority with respect to the fulfillment of the present Convenium.

Article XI

The professional exercise of citizens of one Party in the territory of the other shall be subject to the legislation national correspondent.

Article XII

The recognition of certificates of studies, titles and diplomas at all levels of education will be subject to the corresponding national legislation and the specific Protocols and Agreements on the matter which the Parties have concluded, or those who come to subscribe as long as the present Convenger is in force.

Article XIII

Each of the Parties will seek to keep the other informed of the changes that produce in their system of teaching.

Article XIV

1-For the application of this Convengen, the Parties shall create the Joint Educational Joint Committee, to be chaired by the authorities appointed by the respective Ministries of Education in coordination with the relevant areas of both Chancelleries.

2-Will be functions of the Commission:

a) devise and evaluate specific executive programs ;

b) propose Additional Protocols, to be negotiated by diplomatic pathway.

3-A The Educational Joint Commission shall meet at any time at the request of one of the Parties by the track diplomatic.

Article XV

The present Convium leaves no effect on the Cultural Exchange Convenium between the Government of the Republic Federative of Brazil and the Government of the Argentine Republic of January 25, 1968.

Article XVI

The present Convenium will be subject to ratification and will enter into force on the date on which the Parties exchange the respective Instruments of Ratification.

Article XVII

The Parties will be able to establish amendments to the present Convention, upon exchange of Notes, pursuant to the Article XVI.

Article XVIII

The present Convenium will have undetermined duration and can be denounced at any time by either Party by written notification. The complaint shall take effect 6 (six) months after the date of notification.

Done in Brasilia, on November 10, 1997, in two original copies, in the Portuguese and Spanish languages, both of which are equally authentic texts.
