DECREE NO 7,079, DE January 26, 2010.

Approves the Regimental Framework and the Framework Demonstrative of the Cargos in Commission and the Gratified Functions of the Ministry of Social Development and Combat to the Fome, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments conferring you the art. 84, incisos IV and VI, point?a?, of the Constitution, and in view of the provisions of the Act No 10,683 of May 28, 2003,

DECRETA:

Art. 1st Stay approved the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and the Gratified Functions of the Ministry of Social Development and Combat to Fome, in the form of the Annexes I and II to this Decree.

Art. 2nd In consequence of the provisions of the art. 1st, stay remanded, in the form of Annex III to this Decree, of the Management Secretariat, the Ministry of Planning, Budget and Management, to the Ministry of Social Development and Combat to the Famer, the following posts in committee of the Group-Direction and Senior Advising-DAS: twelve DAS 101.5 ; fifty DAS 101.4 ; sixty-one DAS 101.3 ; a DAS 101.2 ; two DAS 102.5 ; thirteen DAS 102.4 ; twenty-three DAS 102.3 ; and two DAS 102.2.

Art. 3rd The apostillations arising from the approval of the regimental structure of which it treats the art. 1st shall occur within thirty days, counted from the date of publication of this Decree.

Single Paragraph. After the apostillations provided for in the caput, the Minister of State for Social Development and Combat to the Famer will be publishing in the Official Journal of the Union, within sixty days, counted from the date of publication of this Decree, nominal relationship of the holders of the posts in committee of the Grupo-Direction and Superior-DAS referred to in Annex II, indicating, inclusive, the number of vacant posts, their denomination and their level.

Art. 4th The Minister of State for Social Development and Combat to the Fome will be able to edit internal regiment to detail the administrative units of the Regimental Structure of the Ministry, its competencies and the assignments of its leaders, as per the art. 9th of Decree No 6,944 of August 21, 2009.

Art. 5th This Decree goes into effect on the date of its publication.

Art. 6th is revoked the Decree no 5,550 of September 22, 2005.

ANNEX I

REGIMENTAL STRUCTURE OF THE MINISTRY OF DEVELOPMENT

SOCIAL AND COMBAT TO HUNGER

CHAPTER I

OF NATURE AND COMPETENCIES

Art. 1st The Ministry of Social Development and Combat to Fome, the body of direct administration, has as area of competence:

I-national development policy social ;

II-national food security policy and nutritional ;

III-national assistance policy social ;

IV-national income policy of citizenship ;

V-articulation with the federal governments, state, Federal and Municipal District and civil society in the establishment of guidelines for national policies of social development, food and nutritional security, citizenship income and social assistance ;

VI-articulation between policies and the programs from the federal, state, federal and municipal governments and civil society actions linked to social development, food production, food and nutrition, income for citizenship and social assistance ;

VII-orientation, monitoring, evaluation and supervision of plans, programs and projects concerning the areas of social development, food security and nutritional, income of citizenship and social assistance ;

VIII-normatization, guidance, supervision and evaluation of the implementation of social development policies, food security and nutritional, income of citizenship and social assistance ;

IX-management of the National Assistance Fund Social-FNAS ;

X-management of the Combat and Eradication Fund of the Poverty ;

XI-coordination, supervision, control and evaluation of the operationalization of income transfer programs ; and

XII-approval of the general budgets of the Social Service of Industry-SESI, the Social Service for Trade-SESC and the Social Service of Transport-SEST.

CHAPTER II

DA ORGANIZATIONAL STRUCTURE

Art. 2nd The Ministry of Social Development and Combat to Fome has the following organizational structure:

I-bodies of direct and immediate assistance to the Minister of State:

CHAPTER III

DAS COMPETENCIES OF ORGANS

I Section

of the Direct and Immediate Care Bodies to the Minister of State

Art. 3rd To the Cabinet competes:

I-advising the Minister of State in his political and social representation and to deal with public relations and the preparation and dispatch of their personal expedient ;

II-keep track of the progress of the projects interest of the Ministry, in the course of the National Congress, observed the competencies of the essential bodies of the Presidency of the Republic ;

III-arrange for consultation and consultation the applications formulated by the National Congress ;

IV-arrange for official publication and disclosure of the subjects related to the Ministry's acting area ;

V-plan, coordinate and supervise the development of the Ministry's social media activities ;

VI-advising the Minister of State on approval of the general budgets of SESI, SESC and SEST ;

VII-coordinate, guide and monitor the themes related to the international area of interest of the Ministry ; and

VIII-organization information of programs and strategic actions Fome Zero.

Art. 4th To the Executive Officer competes:

I-assist the Minister of State in the definition of guidelines and programs and in the implementation of actions of the Ministry's area of competence ;

II-advising the Minister of State on supervision and coordination of activities of the Ministry's member secretaries ;

III-supervising and coordinating, within the framework of the Ministry, activities related to federal planning and budget, accounting, financial administration, administration of information and informatics resources, civil personnel, general services, and organization and institutional innovation ;

IV-advising the leaders of the organs of the Ministry in formulating collaborative strategies with international financial bodies ;

V-supervise disciplinary activities and of correction developed within the Ministry ; and

VI-receiver, analyze, forward and respond to the complaints, complaints and suggestions of the society regarding the actions of the Ministry.

Single Paragraph. The Executive Officer also exercises the role of the sector body of the Federal Administration's Civil Personnel Systems-SIPEC, the General Services Administration-SISG, Planning and Federal Budget Office, Federal Accounting, Federal Financial Administration, Information Resource Administration and Informatics-SISP and Institutional Organization and Innovation-SIORG, via the Information Technology Directorate, of the Subsecretive of Administrative Affairs and the Planning and Budget Subsecretion.

Art. 5th The Directorate of International Projects competes for the technical and administrative coordination of projects funded in whole or in part by external resources or object of technical cooperation agreement with international body, with the competence of coordinate, plan and supervise the execution of the activities concerning those projects, in accordance with the guidelines of the Executive Officer.

Art. 6th To the Directorate of Information Technology competes:

I-plan, coordinate and supervise, on scope of the Ministry, the execution of activities related to the Information Resource Administration System and Informatics ;

II-propose guidelines and implement the policy of information technology within the Ministry ;

III-coordinate, supervise, orial, monitor and evaluate the elaboration and implementation of the Ministry's information technology plans, programs, projects and hires ;

IV-institutionally represent the Ministry in information technology affairs, together with government and civil society bodies ;

V-formulating management evaluation criteria of information technology within the Ministry, in conjunction with the Gestor Committee on Information Technology ;

VI-plan, coordinate, follow up and stimulate the execution of activities in the area of information technology as for studies and research, aiming at the development and absorption of new technologies ;

VII-identify technological partnerships and propose cooperation agreements with other government entities for the development of useful technologies in the context of modernization of the Ministry ;

VIII-deploy the policies and guidelines of information security, in conjunction with the Gestor Information Technology Committee ;

IX-elaborate and propose standards, procedures and standards for the acquisition and use of the Ministry's information technology resources ;

X-co-ordinate development and deployment of information systems, analyses and modelling of data and information, within the Ministry ;

XI-establish guidelines and standards of management of information technology projects ;

XII-give support to the technology projects of the information and project management procedures, including the use of tools and the integration of the management practices of information technology projects at the Ministry ;

XIII-subsidizing high administration and the Gestor Committee on Information Technology in decision making regarding information technology projects ;

XIV-elaborating strategic planning of information technology and the deployment of governance in the Ministry ;

XV-hold accountable for the prospection of needs, mapping, receiving, forwarding and monitoring of IT demands coming from the various managing areas of the Ministry, from external entities to the Ministry ; and

XVI-disclose the shares of IT within the Ministry, in close acting with the Social Communication Advisor ;

Art. 7th To Undersecretive of Administrative Affairs competes:

I-plan, coordinate and supervise, on scope of the Ministry, the implementation of document and file management activities, as well as those related to Federal Personnel Systems of the Federal Administration and General Services ;

II-promote the articulation with the organs central to the federal systems, referred to in the inciso I, as well as informing and guiding the organs of the Ministry as to compliance with the established administrative standards ; and

III-promote the elaboration and consolidate the plans and programs of the activities of their area of competence and submit them to the higher decision.

Art. 8th To Undersecretive Planning and Budget competes:

I-plan, coordinate and promote, in scope of the Ministry, the execution of activities related to the federal planning and budget, accounting, financial administration and organizational systems and institutional innovation ;

II-maintain articulation with the organs responsible for the central coordination of the systems mentioned in the inciso I, for the purpose of guiding the units of the Ministry as to compliance with the established standards ;

III-promote the elaboration and consolidation of the plans and programs of the activities of their area of competence and subject them to the higher decision, as well as to monitor the targets and results of the execution of these plans and programmes in articulation with the other Ministry Secretaries ;

IV-co-ordinating the elaboration and consolidation of the plans and programs of the Ministry's finalistic activities, their budgets and changes, and to submit them to the top decision ;

V-follow up and promote physical evaluation, budget and financial of projects and activities ;

VI-realizing special account outlets of the expense and other payers responsible for public goods and values and of any one that gives cause for loss, extraction or other irregularity that results in damage to the erary ; and

VII-follow up on the execution fiscal and financial resources of the resources that make up the Poverty and eradication fund.

Art. 9th À Legal Consultancy, the sector's sector of the Advocacy-General of the Union, competes:

I-advising the Minister of State on matters of legal nature ;

II-exercise the supervision of activities legal of the Ministry ;

III-set the interpretation of the Constitution, of the laws, of the treaties and other normative acts to be uniformly followed in their areas of acting and coordination, when there is no normative orientation of the Advocate General of the Union ;

IV-elaborating studies and preparing information on request of the Minister of State ;

V-advising the Minister of State in control internal administrative legality of the acts to be carried out by him or already effective, and of those coming from organs under his legal coordination ; and

VI-examine prior and conclusively, on scope of the Ministry:

a) the author's texts of bidding with the respective contracts or congenial instruments, to be published and concluded ; and

b) the acts by which if go to recognize the unchargeability or decide the bidding dispensation.

Section II

Of The Natural Specific Organs

Art. 10. The National Citizenship Income Secretary competes:

I-attend the Minister of State in the formulation and implementation of the national citizenship income policy ;

II-plan, normalize and coordinate the implementation of the strategic actions of the national citizenship income policy ;

III-plan, implement, coordinate, supervise, monitor and control at the national level the Family Exchange Program, in an articulated manner with the federated ones, in the form of the current legislation ;

IV-articulate the Program Exchange Family with the policies and programs of the state governments, the Federal District and municipal districts ;

V-orial, follow, evaluate and supervise the plans, programs and projects concerning the national citizenship income policy ;

VI-make available information that subsidizes the development of strategic studies and analyses on citizenship income, in accordance with applicable legislation ;

VII-articulating the Program Exchange Family with the other social programs of the Ministry and the Government, with the aim of integrating convergent interests in the area of citizenship income ;

VIII-subsidizing the Secretary of Evaluation and Information Management in the elaboration of performance indicators, to develop studies and strategic analyses on income of citizenship ; and

IX-keep close articulation with the other social programs of the Registry, the Ministry and the Government, with the aim of integrating convergent interests in the area of income of citizenship.

Art. 11. To the Department of Operation competes:

I-to perform budget, accounting and financial from the Family Exchange Program, transferring financial resources for the payment of benefits to households, the remuneration of the operator agent and the support for the decentralized management of the Program ;

II-scrutinize and monitor actions carried out in the management of the Family Exchange Program, the Single Cadaster and the Remaining Programs, at the municipal, state and Federal District levels, under the current legislation ;

III-follow up and support management decentralized the Family Exchange Program, through the articulation with states, Municipalities and Federal District, in the form of the current legislation ;

IV-implement the support mechanisms financial to the decentralised management of the Family Exchange Program ; and

V-follow and care for compliance with the quality of the services provided by the operator of the Family Exchange Program, as well as carry out the surveillance of the execution of the contract.

Art. 12. To the Department of Benefits competes:

I-implement the grant of benefits of the Program Family Exchange, noting the financial budget availability and applicable standards ;

II-administer the benefits granted to the families benefited by the Program, coordinating the activities required for the periodic generation of the benefits payroll ;

III-follow up on the operation of logistics of benefits payment carried out by the operator agent of the Program Exchange Family in the touching:

a) the provision and suitability of the channels of payment ; and

b) to delivery, activation and other management actions of payment cards of the Family Exchange Program ;

IV-promote and monitor actions related to use of banking and financial services of the recipients of the Family Exchange Program and the participation in financial education actions ;

V-plan for the review strategy of eligibility of the recipient families of the Family Exchange Program ;

VI-coordinate the processes of integration of the Program Stock Exchange to other income transfer programs with state-wide, municipal or Federal District conditionalities ;

VII-perfecting the management tools and of information systems used in the benefits management of the Family Exchange Program ;

VIII-monitor and evaluate the processes and activities of benefit management ; and

IX-fomenting studies and research related to benefits management with a view to the improvement of quality, effectiveness and efficiency.

Art. 13. To the Department of the Single Cadastro competes:

I-manage, at the national level, the systems and data bases of the Single Cadastro for Social Programs of the Federal Government, ensuring the preservation of the ethical and privacy aspects of the families in it, as well as by the fidedignity, quality and actuality of their records ;

II-set technological standards for the Single cadaster, as well as specify and follow up on the development of information input and information systems and applications of that Cadastro ;

III-propose, develop, systematize and disseminate enrollment strategies and methodologies, including with regard to traditional and specific peoples and populations and the cases of the most vulnerable populations ;

IV-orial and follow up on the processes of enrollment and maintenance of the enrollment information carried out by Municipalities ;

V-monitor the use of the information contained in the Single cadaster, so as to:

a) stimulate your use by other organs and institutions of the federal, state, municipal, and Federal District spheres, mainly in the planning, management and implementation processes of social programs aimed at the low-income population ;

b) to encourage federated loved ones to promote the continued update of the enrollment records and to carry out the management of the Single Cadastro in their respective sphere ; and

c) develop and implement methodologies of single Cadastro audit ;

VI-update and maintain, in partnership with the Brazilian Institute of Geography and Statistics-IBGE, the poor population estimates for the Single Cadaster and the Family Exchange Program ; and

VII-make available the information from the Single Cadastro to the organs of the Federal Government and to the States, Federal District and Municipalities.

Art. 14. To the Department of Conditionalities competes:

I-define and implement, in articulation with the sectorial bodies involved, the process of monitoring compliance with the conditionalities of the Family Exchange Programme, setting procedures and instruments for the management of the information ;

II-implement, manage and supervise the monitoring of conditionalities, in articulation with the sectorial bodies involved ;

III-analyse and systematize the information concerning the monitoring of conditionalities of the Family Exchange Program ;

IV-articulate with setorial organs involved and with other spheres of government, in order to:

a) plan and implement actions of monitoring of the recipient families of the Family Exchange Program in a situation of increased risk and social vulnerability ; and

b) to integrate and promote public policies in the scope of the Federal Government, aiming at the development of capacities of the beneficiary families ;

V-plan and implement actions supporting the strengthening the social control of the Family Exchange Program and articulating the social control actions of public policies that have interface with the Family Exchange Program ;

VI-identify, systematize and disseminate good management experiences of the Family Exchange Program, managing and sharing with the federated employees information about these practices ;

VII-planning and promotion, in articulation with other areas of the Registry and the Ministry, empowerment processes of the actors involved in the management of the Family Exchange Program, as well as supporting the capacity-building processes carried out by the federated ones ;

VIII-develop content, in articulation with other areas of the Registry, for the operational capacitor of managers ;

IX-develop supporting actions and strengthening the social control instances of the Family Exchange Program, as well as articulation between these and other social control boards of public policies that have interface with the Program ;

X-coordinate the orientation to instances of social control as to the themes under their responsibility ;

XI-manage and maintain updated the base of information about social control instances of the Family Exchange Program ; and

XII-propel and promote practices and follow-up activities of the Family Exchange Program, to be performed by the social control bodies.

Art. 15. The National Secretary of Social Assistance competes:

I-define guidelines of the National Policy of Social Assistance, considering the articulation of your social protection functions, social defense, and social surveillance ;

II-co-ordinate the formulation and implementation of the National Social Assistance Policy and the Single System of Social Assistance, noting the proposals of the national conferences and the deliberations of the CNAS ;

III-implement and ensure the operation of the National Single System of Social Protection, based on citizenship and social inclusion, upon the unification and decentralization of services, programs, projects and benefits of social assistance ;

IV-define the conditions and the mode of access to rights relating to social assistance, aiming at their universalization among all those requiring social protection, observed the guidelines emanating from the CNAS ;

V-guarantee and regulate the implementation of basic and special social protection services and programs, in order to prevent and reverse situations of vulnerability, social risks, and personal disadvantages ;

VI-co-ordinating the management of the Benefit of Continued provision of Social-BPC Assistance, articulating it to the services and programs of social assistance and other public policies with a view to the inclusion of the elderly and with disabilities ;

VII-regular the possible benefits, with seen to the coverage of human needs in the occurrence of social contingencies ;

VIII-regular and implement surveillance social within the Single System of Social Assistance ;

IX-formulating guidelines for follow-up, control, financing and budget of National National Assistance Policy ;

X-monitor and evaluate the management of the Fund National Social Assistance ;

XI-acting within the framework of policies sectorial socioeconomic with views to the integration of social policies for the fulfillment of demands for social protection and facing poverty ;

XII-coordinate, administer and maintain the National Cadestar of Entities and Organizations of the Single Welfare System-CadSUAS, in articulation with the state, municipal, Federal District and Social Care Boards bodies ;

XIII-supporting technical and financially the States, the Federal District and the Municipalities in the implementation of the basic and special protection services and programs, of the poverty-facing projects and of the assistive actions of emergency character ;

XIV-support technical and financially the States, the Federal District and the Municipalities in the implementation of organization and enhancement projects of SUAS management ;

XV-regular relations between the ones federal public, entities and non-governmental organizations in the proviso of socio-assister services ;

XVI-incential the creation of instances public advocacy for the rights of users of the programs, services and social assistance projects ;

XVII-articular and coordinate actions of strengthening of the instances of participation and deliberation of the Single System of Social Assistance ;

XVIII-formulating policy for training systematic and continued human resources in the field of social assistance ;

XIX-develop studies and research, in set with the competent organ of the Ministry and with educational and research institutions, to subsidize policy formulation ;

XX-provide grants to the Minister's Office as to the general budgets of SESI, SESC and SEST, in relation to social assistance ;

XXI-subsidizing the Secretary of Evaluation and Information Management in the elaboration of performance indicators, to develop strategic studies and analyses on social assistance ; and

XXII-keep close articulation with the other social programs of the Registry, the Ministry and the Government, with the aim of integrating convergent interests in the area of social assistance.

Art. 16. To the Director-Executive Director of the National Social Assistance Fund competes:

I-manage, co-ordinate, process and control the financial, financial and accounting planning and accounting activities of the FNAS ;

II-establish standards and criteria for the management of the sources of fundraising and the implementation of the budgetary and financial resources concerning the FNAS ;

III-plan, coordinate, process, orial and supervise the regular and automatic repass activities of the resources of the services of social and conventional assistance, contracts and other similar instruments ;

IV-contribution to the implementation of control mechanisms, monitoring and evaluation of the financial management of SUAS ;

V-plan, coordinate and supervise the accounts and special account takeover activities of the resources of the Single Social Assistance System allocated to FNAS ;

VI-orient the federated ones as to the provison of accounts relating to resources transferred by FNAS ;

VII-promote the activities of cooperation technical in the budget, financial and accounting areas to subsidize the formulation and implementation of social assistance policies ;

VIII-coordinating, elaborating and subsidizing the conduct of studies and research necessary for the funding process of the National Social Assistance Policy ;

IX-contribute to the enhancement of the operational and managerial systems of data processing, expense and accountability regarding FNAS repasses for state, municipal and Federal District funds as to services, programs, projects and activities ;

X-forwarding to CNAS managerial reports quarterly and annual fiscal and financial achievement of FNAS ;

XI-collaborate on the definition of the criteria of sharing of the resources of the Single Social Assistance System ; and

XII-providing technical support the States, Municipalities and the Federal District in the organization and implementation of actions concerning the management of the Funds.

Art. 17. To the Department of Management of the Single Social Assistance System competes:

I-implement, monitor and evaluate management of the Single Social Assistance System ;

II-regular the management actions of SUAS and the relations between the federal public and the social welfare entities and organizations ;

III-propose instruments for regulation of the National Social Assistance Policy, as to aspects of its management ;

IV-support and foster the instruments of participatory management ;

V-participate in the formulation of criteria of sharing of federal cofinancing resources for states, Municipalities and Federal District ;

VI-participate in the formulation of guidelines for participation by the Federal Government, the States and Municipalities in the financing of the services, programs, projects and benefits, in line with the SUAS management model ;

VII-organize, implement and maintain the system national SUAS information and the SUAS Network, with views to the production of data across the national territory ;

VIII-co-ordinating and subsidizing the realization of studies and research of the planning, implementation and normalization process of the National Social Assistance Policy ;

IX-support and monitor the states and Municipalities in the deployment and implementation of the principles and guidelines of the basic Human Resources Operational Standard of SUAS ;

X-propose standards and guidelines, plan, coordinate, monitor and execute the actions and social surveillance services ;

XI-establish the typification patterns of vulnerabilities, risks, events, aggravation, violations of rights and social demands ;

XII-participate in the definition of standards and standards on the quality of socio-assisuntential services provided to users ; and

XIII-prestain support technician to States, Municipalities and the Federal District in the organization and implementation of actions regarding the management of SUAS.

Art. 18. To the Department of Assistential Benefits competes:

I-co-ordinate and implement the Benefit of Provision Continued and guide the operationalisation of the possible benefits of social assistance by articulating them to social protection programs and services and other social policies ;

II-manage the Benefit of Continued Prestation of Social-BPC Assistance, together with the bodies responsible for operationalisation, comprising of their concession, maintenance and reassessment ;

III-follow up on the maintenance of the Monthly rift Vitalicia-RMV ;

IV-provide grants and participate in the formation of the actors involved in operationalization, reassessment and control of benefits ;

V-propose, develop and monitor studies, research and systematization of data and information on the eventual benefits and continued benefit of social assistance ;

VI-make available data from the BPC Cadastro from ways to subsidize the offer and inclusion of the beneficiaries in the services ;

VII-implement and maintain system of information and databases on the benefits of social assistance, with views on the planning, development and evaluation of actions, as well as regulation and control of benefits ;

VIII-propose, implement and follow up actions of control, as well as coordinating the process of periodic revaluation of benefits, determined by the Organic Law on Social Welfare-LOAS ;

IX-acting together with the Ministry of Welfare Social and the National Institute of Social Insurance-INSS and the three levels of government, with a view to improving the management of the benefit of continued benefit of social assistance ; and

X-provide technical support to States, Municipalities and the Federal District in the organization and execution of actions regarding the assistive benefits.

Art. 19. To the Department of Basic Social Protection competes:

I-plan, regular, coordinate and guide the implementation of the services, programs and projects aimed at the population living in social vulnerability arising from poverty, deprivation or fragilization of affective links, age discrimination, ethnic, gender or disability, among others ;

II-define guidelines for the organization of the set of services and basic social protection programs, having as reference to family partner matriciality and the territory ;

III-set guidelines and accompany the inclusion of traditional communities in services, programs and projects of basic social protection ;

IV-establish control mechanisms, monitoring and evaluation of the services, programs and basic social protection projects ;

V-propose criteria for sharing resources of federal cofinancing for states, Municipalities and Federal District, in the area of their competence ;

VI-formulating guidelines for participation of the Federal Government, the States and Municipalities in the financing of the services, programs and projects of basic social protection ;

VII-provide technical support to states, Municipalities and the Federal District in the organization and execution of basic social protection actions ;

VIII-monitoring the physical-financial execution of services and projects of basic social protection ;

IX-coordinate, arrange the information and produce data with views for monitoring, technical support, and enhancement of basic social protection ;

X-contribute to the implementation of system of information and data on the services, programs and basic social protection projects ;

XI-propose and participate in studies and research to subsidize the actions relating to basic social protection ; and

XII-promote, subsidize and participate in capacity-building activities for further improvement of the management, regulation and development of services, programs and basic social protection projects of SUAS.

Art. 20. To the Department of Special Social Protection competes:

I-plan, coordinate, regular and guide the implementation of the services, programs and projects aimed at families and individuals who are in a situation of personal and social risk, for the occurrence of abandonment, violence, abuse and sexual exploitation, use of psychoactive substances, compliance with socio-educational measures, street situation, child labor, human trafficking, among other situations of violation of rights ;

II-establish control mechanisms, monitoring and evaluation of the services and programs and special social protection projects ;

III-propose criteria for sharing resources of federal co-financing for states, Municipalities and Federal District, in the area of their competence ;

IV-establish criteria and define procedures for participation of the Federal Government, in the financing of the services, programs and projects of the special social protection in the States, Federal District and Municipalities ;

V-maintain joint and interlocution with other public policies and human rights advocacy bodies with a view to the effectivation of intersectoriality in the actions of special social protection ;

VI-set guidelines for the organization of the set of services and special social protection programs, having as reference to unity, decentralization and regionalization of actions ;

VII-provide technical advising to the States, Municipalities and Federal District in the organization and implementation of special social protection actions ;

VIII-monitoring the physical-financial execution of services and projects of special social protection ;

IX-coordinate, arrange the information and produce data with views for monitoring, technical support and enhancement of special social protection ;

X-contribute to the implementation of the system of information and data on the services and programs, with a view to the planning, development and evaluation of the actions of the special social protection ;

XI-subsidize and participate in activities of capacity-building for the improvement of the special social protection services and programs ;

XII-propose and promote studies and research to subsidize the actions relating to special social protection ; and

XIII-support strategies of social mobilization, by the guarantee of rights of population groups in risk and violation of rights.

Art. 21. To the Department of the Private Socio-Assistive Network of the Single Social Assistance System competes:

I-deploy, manage and maintain updated the National Cadaster of Entities and Social Care Organizations, in articulation with advice and bodies managers of social assistance ;

II-carry out the certification of social welfare benefit entities that provide service or carry out assistive actions, pursuant to the Law No 12,101 of November 27, 2009 ;

III-propose parameters and procedures for the establishment of the linking of private socio-assistecial entities to SUAS ;

IV-propose criteria for the enrollment of the services, programs and projects of the social welfare entities together with the Councils of Assistance Social ; and

V-evaluate the compatibility of imported goods with the purposes of the social welfare entities and organizations, of which it treats art. 141, § 2nd, of Decree No 6,759 of February 5, 2009.

Art. 22. The National Food Safety and Nutritional Secretaries competes:

I-plan, implement, coordinate, supervise and monitor food and nutritional safety programs, projects and actions ;

II-foster the execution of programs of food and nutritional security, in partnership with federal, state, Federal District, municipal and civil society bodies ;

III-articular and integrate security actions food and hunger-fighting in the states, Municipalities and the Federal District with the participation of civil society organizations integral to the National Food Safety System-SISAN and its State Congeners, the Federal District and Municipal, in accordance with the decisions emanating from the Interministerial Food and Nutritional Safety Chamber ;

IV-provide technical support and advising to Interministerial Chamber of Food Safety and Nutritional ;

V-support the implementation of SISAN in form coordinated with the Interministerial House of Food and Nutritional Safety ;

VI-supporting the structuring of state and municipal food and nutritional safety systems, in accordance with the terms advocated by the Act in 11,346, of September 15, 2006 ;

VII-coordinate and secretarial the Gestor Group of the Family Agricultural Food Acquisition Program, depending on the provisions contained in the art. 19 of the Act No 10,696 of July 2, 2003 and of Decree No 6,447 of May 7, 2008 ;

VIII-plan and monitor the execution and evaluate food and nutritional safety programs, projects and actions for the structuring of systems municipal public and the planning of production, circulation and food consumption in the perspective of the realization of the human right to food under Law No. 11,346 of 2006 ;

IX-plan, monitor the execution and evaluate programs, projects and actions of government food purchases from family agriculture to the distribution to families in a situation of food insecurity within the scope of their competence ;

X-subsidizing the Registry of Evaluation and Information Management in the elaboration of performance indicators of the programs and projects, of this area of acting, for realization of monitoring and evaluation ;

XI-accompany the National Food Safety and Nutritional Security Council-CONSEA, interacting with the policy guidelines it has defined ; and

XII-keep close articulation with the other social development programs, with the aim of integrating convergent interests in the area of food and nutritional security.

Art. 23. To the Department of Discentralized Food and Nutritional Security Systems competes:

I-plan, coordinate and monitor execution of actions and activities of decentralized systems ;

II-supporting the municipal public power in the realisation of government purchases from family and traditional agriculture for the supply of the integrated entities in the municipal social protection network and public equipment network ;

III-supporting implantation, structuring and consolidation of municipal agri-food systems ;

IV-supporting actions of urban agriculture and periurban for the social inclusion of families in the situation of food insecurity ;

V-support the implantation of collective systems of familial production of food for self-consumption ; and

VI-support structuring of municipal network of urban public equipment to ensure the right to adequate food for families in food insecurity situation.

Art. 24. To the Department of Family Production Support and Access to Food competes:

I-plan, coordinate and monitor execution of actions and activities of the National Food and Nutritional Security Policy ;

II-plan and monitor the distribution of food baskets to people in a situation of social vulnerability or in an emergency situation ;

III-supporting the Gestor Group in the formulation of shares of the federal government related to the Family Agricultural Food Acquisition Program ;

IV-propose guidelines concernable to the Program of Food Agricultural Food Acquisition ;

V-supervise the execution of the Program of Food acquisition with regard to the care for people in the situation of food and nutritional insecurity and the fostering of the socio-economic inclusion of family farmers ;

VI-promote the implementation of systems of monitoring of the implementation of the Family Agricultural Food Acquisition Program ; and

VII-realizing joints along with other government policies and actions with a view to the potentialization of actions in regions with higher index of food insecurity and nutritional insecurity.

Art. 25. To the Department of Food Promotion Suitable competes:

I-plan, coordinate and track the development of actions for the promotion of proper food, in respect of food and nutritional education, social development consortia and traditional peoples and communities ;

II-coordination, articular and supervising programs and projects for mobilization and education for food and nutritional security ;

III-plan, coordinate and accompany the implementation of intermunicipal socio-territorial development programs and projects ;

IV-realizing and promoting education actions and training in food and nutritional security, to strengthen the implementation of SISAN ;

V-develop and coordinate promotion actions of food safety, for broadening access to water for human consumption and for the production of food for self-consumption ;

VI-support the diffusion and multiplication of innovative initiatives in food safety and nutritional ; and

VII-plan, implement and coordinate actions, projects and programs aimed at the food security of traditional peoples and communities.

Art. 26. To the Registry of Evaluation and Information Management competes:

I-develop and implement instruments of evaluation and monitoring of social development policies and programmes and combating hunger and information management within the Ministry ;

II-elaborate, propose, coordinate and support the implementation of plans, programs, projects and actions of social development and combat hunger, aimed at promotion:

a) of the capacity of strategic formulation, including development of systems of identification of populations and vulnerable areas, monitoring, evaluation and dissemination of results and organizational performance ;

b) of information prop to the formulation of policies aimed at social development and combating hunger ;

c) of conceptions of management models volted for results ;

d) of transparency, social control and conduct ethics in public management ;

e) of the resource allocation optimization for the reach of the results targeted ;

f) of information systems, learning, skills and knowledge necessary for the excellence of organizational processes ; and

g) of evaluation and monitoring methodologies of social development policies and combating hunger ;

III-promote the training and empowerment of public and social actors at the federal, state and municipal levels ;

IV-promote the management of knowledge, the dialogue of policies and technical cooperation in public management in an articulated manner with organs, entities, powers and federal spheres and other countries ; and

V-support the proposition, evaluation, validation, calculation and dissemination of indicators within social development policies and combating hunger.

Art. 27. The Department of Evaluation competes:

I-evaluate the reach of results and the compliance with the proposed objectives for programs, projects, services and actions of the Ministry ;

II-develop and support the evaluation of programs, benefits, projects, services and actions of the Ministry, in line with the other organs ;

III-offer subsidies that guide management of programs, benefits, services and actions of the Ministry, based on studies and analysis ; and

IV-support the proposition and validation of indicators within the Ministry's policies, in articulation with the information management area.

Art. 28. To the Department of Monitoring competes:

I-monitor the effectiveness and impact of the programs, benefits, projects, services and actions of the Ministry ;

II-develop instruments and systems of monitoring of policies, programs and actions of social development and combating hunger ;

III-offer subsidies that guide management of the Ministry's programs, services and actions, based on the results of the monitoring actions ;

IV-support the proposition and validation of indicators within the Ministry's policies, in articulation with the area of information management ; and

V-support partnerships, proposals by other bodies of the Ministry, to strengthen monitoring processes together with state and municipal instances.

Art. 29. To the Department of Information Management competes:

I-identify the needs and problems of information at the strategic and managerial level that give support to social programs, proposing solutions and alternatives for decision making ;

II-orial the elaboration of systems of social information and informational tools aimed at managing the information ;

III-support the evaluation and calculation of indicators within the framework of social development policies and combating hunger for the Ministry ; and

IV-auxiliary technically in institutional joints involving state bodies and companies affected to the area of information management.

Art. 30. To the Department of Training and Dissemination competes:

I-propose, coordinate and articulate the formation and empowerment of public and social actors who act in social development policies and combat hunger ; and

II-disseminate results and methodologies of evaluation and monitoring, and knowledge correlating to social development policies and combat hunger.

Art. 31. To the Registry of Articulation for Productive Inclusion competes:

I-foster, plan, run and follow up productive inclusion projects for the public recipient of the Ministry's programmes, in articulation with their other units ;

II-support, assist, and monitor the implementation and consolidation of productive inclusion projects, within the framework of the National Commitment by the Social Development, established by Decree No. 6,393 of March 12, 2008 ;

III-maintain close cooperation with the other Secretaries of the Ministry, with the aim of expanding and optimizing the inclusion actions productive ;

IV-foster productive inclusion projects, promoting the protagonism and cooperation of the public recipient of the Ministry's programs and their organizations ;

V-stimulate social participation in the planning, implementation and monitoring of productive inclusion projects supported by the Ministry ;

VI-contribute with other federal government bodies in the formulation of projects and productive inclusion activities ;

VII-plan and support, together with state governments, the Federal and Municipal District, civil society entities and the private initiative the implementation of actions that promote the productive inclusion of the beneficiaries of the Ministry's policies ;

VIII-identify and harness opportunities generated by major investments and public funding that contribute to productive inclusion of the beneficiaries of the Ministry's programmes ;

IX-articulating support for productive endeavors of social segments and communities, in particular social vulnerability ;

X-articulate partnerships with the private initiative aiming at the productive inclusion of the public recipient of the Ministry's programmes ;

XI-establish guidelines, in consonance with the other organs of the Ministry, and proceed to the receipt and destination of the donated goods and intended for the Zero Hunter Strategy ; and

XII-subsidizing the Secretary of Evaluation and Information Management in the elaboration of performance indicators, to develop the monitoring and evaluation of productive inclusion projects.

Art. 32. The Department of Projects competes:

I-promote pactuation with the States and the Federal District, aiming for the promotion of productive inclusion, relative to the National Commitment for Social Development ;

II-establish technical cooperation and financial, with the states and the Federal District, for the implementation of productive inclusion projects, within the framework of the National Commitment for Social Development ; and

III-establish articulations with the other organs and federal entities of direct and indirect administration with the aim of creating convergences and synergies that contribute to the productive inclusion of the beneficiaries of the Ministry's programs.

Art. 33. The Department of Articulation and Partnerships competes:

I-to do the management of the donated goods and resources and intended for the Zero Hunger, ensuring its best use for recipients of the Ministry's programs ;

II-organize and support activities that improve the conditions of entry into the labour market of the public recipient of the Ministry's programmes ; and

III-establish cooperation with competent bodies and entities, aiming at the provision of technical assistance to productive inclusion endeavors and the development and application of technologies aimed at productive inclusion.

Art. 34. To the Department of Prospection for Productive Inclusion competes:

I-establish partnerships with entities public and private, aiming at the exploitation of opportunities for productive inclusion of the public recipient of Ministry programs ;

II-develop studies in conjunction with public and private entities, objecting to meeting local potentials for structuring productive inclusion actions ;

III-develop methodologies for inclusion productive of the public recipient of the Ministry's programmes ;

IV-investigate opportunities to be used for productive inclusion of the public beneficiary of the Ministry's programmes ;

V-identify the capabilities and abilities of the public recipient of the Ministry's programmes, aiming at their exploitation and insertion into productive activities ; and

VI-give technical support and informational to productive ventures, identified by the Registry as possessor of high potential for insertion of the public recipient of the Ministry's programmes.

Section III

Of The Collegiate Organs

Art. 35. To the CNAS, created by Law No 8,742 of December 7, 1993, it is up to exercise the powers set out in specific regulation.

Art. 36. To the Advisory and Monitoring Board of the Combating And Eradication Fund of Poverty, instituted by the Supplementary Law no 111 of July 6, 2001, it is up to exercise the powers set out in specific regulation.

Art. 37. To the Council for the Articulation of Social Programmes, established by Law No 10,683 of May 28, 2003, it is up to exercise the powers set out in specific regulation.

Art. 38. To the Gestor Council of the Family Exchange Program, established by Law No 10,836 of 2004, it is up to exercise the powers set out in specific regulation.

CHAPTER IV

I Section

From the Executive Secretary

Art. 39. To the Executive Secretary it is incumbent:

I-co-ordinate, consolidate and submit to Minister of State the Ministry's global plan of action ;

II-supervise and evaluate the execution of the projects and activities of the Ministry ;

III-supervising and co-ordinating the joint of the central bodies of the systems affected to the area of competence of the Secretariat-Executiva; and

IV-exercise others assignments that are entrusted to it by the Minister of State.
