DECREE NO 7,139, DE March 29, 2010.

Approves the Regimental Framework and the Framework Demonstrative of the Cargos in Commission and the Gratified Functions of the Superintendence of the Franca Zone of Manaus-SUFRAMA, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments conferring you the art. 84, incisos IV and VI, point?a?, of the Constitution, and in view of the provisions of art. 50 of Law No 10,683 of May 28, 2003,

DECRETA:

Art. 1st Ficam approved the Regimental Structure and the Cargos Demonstrative Framework in Commission and Gratified Functions of the Superintendence of the Franca Zone of Manaus-SUFRAMA, in the form of Annexes I and II.

Art. 2nd In consequence of the provisions of the art. 1st, stay remanded, in the form of Annex III, the following posts in Committee of the Group-Direction and Superior aides-DAS:

I-from the Office of Management, the Ministry of Planning, Budget and Management, to SUFRAMA: a DAS 101.4 ; and

II-from SUFRAMA to the Office of Management, Ministry of Planning, Budget and Management: a DAS 102.4.

Art. 3rd The apostillations arising from the approval of the Regimental Structure of which it treats the art. 1st shall occur within the period of twenty days, counted from the date of publication of this Decree.

Single Paragraph. After the apostillations provided for in the caput, the Superintendent of SUFRAMA will be to publish in the Official Journal of the Union within thirty days, counted from the date of publication of this Decree, the nominal relationship of the holders of the posts in committee of the Group-Direction and Advisor Superior-DAS referred to in Annex II, indicating, inclusive, the number of vacant posts, their denomination and their level.

Art. 4th The Minister of State for Development, Industry and Foreign Trade will be able to edit internal regiment to detail the integral administrative units of the Regimental Structure of SUFRAMA, its competencies and the assignments of its leaders.

Art. 5th This Decree goes into effect on the date of its publication.

Art. 6o It is revoked the Decree no 6,372, February 14, 2008.

ANNEX I

REGIMENTAL STRUCTURE OF THE SUPERINTENDENCY OF THE LINGUA FRANCA OF MANAUS-SUFRAMA

CHAPTER I

OF NATURE AND PURPOSE

Art. 1st The Superintendency of the Franca Zone of Manaus-SUFRAMA, municipality set up by Decree-Law No 288 of February 28, 1967, linked to the Ministry of Development, Industry and Foreign Trade, aims to promote development socioeconomic, sustainably, in its area of acting, upon generation, attraction and consolidation of investments, supported in technological empowerment, aiming for competitive international insertion, from the following actions:

I-identify opportunities with views to attraction of ventures for the region ;

II-identify and stimulate investments public and private in infrastructure ;

III-stimulates and strengthen investments in the formation of intellectual capital and in science, technology and innovation by the public and private sectors ;

IV-intensifying the articulation process and of partnership with public and private bodies and entities ;

V-stimulates foreign trade actions ; and

VI-administer the provision of incentives fiscal.

CHAPTER II

DA ORGANIZATIONAL STRUCTURE

Art. 2nd The Superintendency of the Franca Zone of Manaus-SUFRAMA has the following organizational structure:

I-superior body of deliberation: Council of Administration of SUFRAMA ;

II-direct and immediate assistance bodies to the Superintendent:

a) Cabinet ;

b) Coordination-General of Social Communication ;

c) Coordination-General of the Council of Administration ;

d) Coordination-General for Economic Studies and Business ;

e) Coordination-General Representation Institutional ;

f) Coordination-General Trade Exterior ; and

g) Coordination-General Commercial Promotion ;

III-sectional bodies:

a) Federal Prosecutor's Office ;

b) Internal Audit ;

c) CorregIA ; and

d) Adjoint Superintendency of Administration ;

IV-singular specific organs:

a) Superintention Adjunta of Planning and Regional Development ;

b) Adjoint Superintention of Projects ; and

c) Additional Superintention of Operations ; and

V-decentralized units:

a) Coordination-General of the Amazon Portal Western ;

b) Free Trade Areas ; and

c) Regional Coordinations.

CHAPTER III

DA DIRECTION AND APPOINTMENT

Art. 3rd A SUFRAMA is directed by a Superintendent and four Adjoined Superintendents.

Single Paragraph. Nominations for the posts in commission and fulfilling functions integral to the regimental structure of SUFRAMA will be effected in accordance with the current legislation.

CHAPTER IV

DA COMPETENCY OF ORGANS

I Section

The Superior Body of Deliberation

Art. 4th To the Board of Directors of SUFRAMA competes:

I-approver:

a) the general guidelines for the elaboration of the annual and multi-year work plans ;

b) its internal regiment ;

c) the projects of companies objecting enjoy the tax benefits provided for in the arts. 7th and 9th of Decree-Law No 288, 1967, and at art. 6th of Decree-Law No 1,435 of December 16, 1975, as well as to establish standards, requirements, limitations and conditions for the approval of the said projects ; and

d) the standards and criteria for the execution of plans, programs, projects, works and services to be charged to the entity, in particular:

1. the arrangements, agreements and contracts ; and

2. the credit and financing operations, including for the cost of studies, services and works ;

II-deliberation on the formation of teams techniques for analysis of specific content matter ; and

III-enjoy and deliberate on:

a) the schedule and annual budget of the entity ; and

b) the partial and annual reports of the activities developed.

Single Paragraph. The composition of the Board of Directors of SUFRAMA is set out in the Supplementary Law no 134 of January 14, 2010.

Section II

of the Direct and Immediate Care Bodies to the Superintendent

Art. 5th To Cabinet competes:

I-watch the Superintendent of SUFRAMA in its political and social representation ;

II-to be entrusted with the preparation of the expedient personal of the Superintendent ;

III-distribute and monitor the progress of documentation and processes of interest of the Superintendent, in tramway in SUFRAMA ; and

IV-exercise other skills that you are committed by the Superintendent of SUFRAMA.

Art. 6th The Coordination-General for Social Communication competes to plan, coordinate and supervise the activities of social communication, publication, institutional dissemination, public relations, events and monitoring of matters of interest of SUFRAMA.

Art. 7th To the Coordination-General of the Board of Directors competes for secretarial and administrative support for meetings of that Council, Sectoral Chambers, Committees, Working Groups and other meetings assigned to it by the Superintendent.

Art. 8th To the Coordination-General for Economic and Business Studies competes to advise the Superintendent on the elaboration of studies in the economic areas and tax incentives.

Art. 9o To Coordination General of Institutional Representation competes:

I-represent SUFRAMA in Brasilia and prestain support for the Superintendent and other servers when the service in that locality ;

II-promote and monitor the progress of matters of interest of SUFRAMA ; and

III-run other skills that the interest of SUFRAMA demand.

Art. 10. To the Coordination-General Trade Exterior competes:

I-formulate proposals for trade programs exterior, aimed at the acting area of SUFRAMA ;

II-watch SUFRAMA in matters of cooperation, technical assistance, arrangements and international agreements, business rounds, trade missions, seminars, export platforms, product distribution centres, promotion of fairs and exhibitions ;

III-represent SUFRAMA in the forums of discussions of the Federal Government, pertinent to the negotiation of international agreements, treaties and cooperations ; and

IV-orient and accompany the exporter in issues pertinent to the foreign trade activities.

Art. 11. To the Commercial Promotion-General Coordination competes:

I-plan and organize the International Fair of the Amazon ;

II-watch SUFRAMA in the organization of commercial missions, participation in congresses, seminars, business rounds, fairs, exhibitions and promotional events in Brazil and abroad, concernates the planning and organization of the International Amazon Fair ;

III-promoting the participation of companies installed in the area of jurisdiction of SUFRAMA at setorial and multissetorial fairs in Brazil and abroad ; and

IV-to provide support for visits and missions of importers and foreign investors of interest from the Industrial Pole of Manaus.

Section III

Of Sectional Organs

Art. 12. To the Federal Prosecutor's Office, as the executive body of the Federal Prosecutor-General, it competes:

I-exercise judicial representation and extrajudicial of SUFRAMA, acting in the processes in which the municipality is author, ré, opponent or assistant ;

II-provide advice and legal advice to the Superintendent and the units of SUFRAMA, by applying, in what couber, the provisions of the Supplementary Act no 73, of February 10, 1993 ;

III-watch the Superintendent in control internal of the administrative legality of the acts to be carried out by him or already effective ;

IV-fixate, for SUFRAMA units, the interpretation of the legal order, when there is no normative orientation of the Advocacy-General of the Union and the Legal Consulting of the Ministry of Development, Industry and Foreign Trade ; and

V-ascertaining the liquidity and certainty of credits of any nature, inherent in the activities of SUFRAMA, by enrolling them in active debt, for administrative or judicial collection purposes.

Art. 13. The Internal Audit competes:

I-check compliance with standards accounting, financial and administrative within the framework of SUFRAMA ;

II-follow up on the work of the organs of internal and external control ;

III-monitor the elaboration and issue opinion prior to the provision of annual accounts of SUFRAMA, as well as special account outlets ;

IV-propose actions in such a way as to ensure the legality of the acts and the scope of the results, contributing to the improvement of management ;

V-subsidarily guide the leaders of the SUFRAMA as to the principles and rules of internal control, including on how to account ;

VI-check for consistency and fidedignity of the data and information that will conduct the accounts of the President of the Republic in the Union General Balance Sheet ; and

VII-give prior and periodic guidelines to the sectors of SUFRAMA regarding the execution of its activities.

Single Paragraph. In the exercise of their competencies, the Internal Audit links administratively to the Board of Directors, in accordance with the Art. 15 of Decree No 3,591 of September 6, 2000.

Art. 14. To Internal Affairs competes:

I-manage and perform the activities of disciplinary investigation and other correction activities ;

II-check, in the interest of the activity correctional, data and information constants of SUFRAMA information systems ;

III-check the disciplinary aspects of the tax made and other administrative procedures ;

IV-examine and instruct processes disciplinary administrative and other expedients on functional ethics and discipline that should be submitted to the competent authorities ;

V-appreciate consultation and manifest on matters relating to duties, prohibitions and other themes that verwithout on functional ethics and discipline ;

VI-examination of complaints, representations and other expedients dealing with functional irregularities and promoting their ascertainment, met the legal requirements ;

VII-follow up, evaluate, execute and define criteria, methods and procedures for correctional and disciplinary investigation activities ;

VIII-apply for or conduct démarches, including tax, requisition information, processes and documents necessary for examination of matter in the area of its competence ;

IX-follow up on the progress of lawsuits relating to correctional activities ;

X-adopt preventive and repressive actions on the functional and disciplinary ethics of the servers ; and

XI-administer the information regarding the administrational-disciplinary made.

Art. 15. The Adjoining Superintendency of Administration competes:

I-plan, coordinate and supervise the execution of activities concerning federal systems of organization and institutional innovation, accounting, budgetary and financial execution, administration of information and informatics resources, human resources and general services

II-carry out takeaways of the payers of expenditure and too much in charge of public goods and values and of any one that gives cause for loss, extraction or other irregularity that results in damage to the erary.

Section IV

Of The Natural Specific Organs

Art. 16. The Adjoining Supervision of Regional Planning and Development competes to plan, coordinate and supervise the execution of activities concerning:

I-management of the planning system and budget programming of the entity ;

II-formulation, implementation and assessment plans and programmes aimed at regional development, in line with national policies ;

III-celebration and follow-up of the arrangements confirmed by SUFRAMA, as well as analysis of the accountability of the transferred resources ; and

IV-formulation, implementation and assessment programs and projects aimed at the development of science, technology and innovation, in the acting area of SUFRAMA, in articulation with the Ministry of Science and Technology and other public and private entities.

Art. 17. The Adjoining Superintendency of Projects competes to plan, coordinate and supervise the execution of activities concerning:

I-analysis of industrial projects, agrolivestock and service delivery with views on the granting of tax incentives administered by SUFRAMA ;

II-analysis and approval of the listing of the imported inputs intended for industrialization of products in the Franca Zone of Manaus ;

III-monitoring, monitoring and evaluation of industrial, agrolivestock and service projects ;

IV-administration of occupation of areas of Industrial Districts and Agrolivestock ; and

V-analysis and surveillance of projects of engineering and architecture relating to works in areas of the Marshal Marshal Castle White Castle.

Art. 18. The Adjoining Oversight of Operations competes to plan, coordinate and supervise the execution of activities relating to:

I-control of the physical and documentary input of domestic and documentary goods of foreign goods, encouraged, in the area of acting of SUFRAMA ;

II-enrollment and habilitation of companies that come to plead the fiscal incentives administered by SUFRAMA ;

III-administration of finalistic operations of the decentralized units, in articulation with the other units of SUFRAMA ;

IV-monitoring of operationalization of the merchandise entertaining activities in the acting area of SUFRAMA ; and

V-analysis, control, follow-up and evaluation of the operationalisation of processes for special export programmes.

V Section

Of Decentralized Units

Art. 19. To the Coordination-General of the Western Amazonian Portal, to Free Trade Areas and Regional Coordinations competes:

I-administer the incentive instruments relevant fiscal ;

II-operationalization of the mechanisms of import and internment of domestic and foreign goods ; and

III-represent SUFRAMA in its area of jurisdictions.

CHAPTER V

OF THE ALLOCATIONS OF LEADERS

I Section

The Superintendent

Art. 20. To Superintendent it is incumbent:

I-set the acting guidelines and exercise the general direction of the units of SUFRAMA ;

II-propose the annual plan and the budget and, after their approval, to give knowledge to the Board of Directors of SUFRAMA, as well as of the partial and annual reports of the activities developed ;

III-submit to the approval of the Ministry of Development, Industry and Exterior Trade the internal regiment of SUFRAMA ;

IV-dispower on the operation of the units, as well as on the performance of special activities ;

V-propose changes in the operational structure depending on the regional development plans or new programs of the Federal Government for the Western Amazon and other areas of comprehension, observed the prevailing standards ;

VI-firming agreements, contracts and arrangements with national and international entities, observed the legislation in force ;

VII-practise the acts of office proofing effective SUFRAMA Personnel Board, in due course of enabling in public tender, as well as exercising disciplinary power, under the legislation in force ;

VIII-represent SUFRAMA in judgment or outside of him ;

IX-present, within the time limits set, the provision of accounts corresponding to the management of the previous financial year ;

X-authorize the proofing of resources financial and materials required to run programs, projects and activities ;

XI-hire the provision of technical services with physical or legal persons in the form of relevant legislation for the performance of specialized functions ;

XII-practise all acts pertinent to financial, accounting, material and general services administration in the form of the legislation in force, as well as to determine periodic audits and verifications in these areas ;

XIII-determine the establishment of inquiries as per the relevant standards and legislation ;

XIV-submit to the Board of Directors of SUFRAMA subjects that depend on the appreciation or approval of that collegiate ;

XV-propose to the Board of Directors of the SUFRAMA the disposal of mobile and real estate to it belonging ;

XVI-comply and enforce the decisions of the SUFRAMA Board of Directors ; and

XVII-promote, dispense, and type-approval tenders, as well as to firm contracts for material acquisition, execution of works and services and rental of real estate, in the form of the current legislation.

Section II

Of The Adjoining Superintendents

Art. 21. The Adjoined Superintendents is to plan, direct, coordinate and guide the evaluation and execution of the activities of their respective units and to exercise other assignments that are committed to them by the Superintendent of SUFRAMA.

Section III

Of the other Leaders

Art. 22. To the Chief of Staff, the Chief Prosecutor, the Auditor-Chief, the Corregedor, the Coordinators-General and the other leaders is to plan, direct and coordinate the execution of the activities affected to the respective units and to exercise others assignments that are committed to them.

CHAPTER VI

DAS GENERAL PROVISIONS

Art. 23. The internal regiment will be able to define the detailing of the integral bodies of the Regimental Structure, the competences of the respective units and the tasks of their leaders.

Art. 24. The Free Trade Areas run by SUFRAMA are in number seven and are located in Tabatinga, Amazon State, Macapá / Santana, Amapá State, Guajará-Mirim, Rondônia State, Boa Vista and Bonfim, Roraima State, and Brazilian / Epitacioland and South Cruzeiro, State of Acre.

Art. 25. The missing cases and the doubts raised in the implementation of this Regimental Framework will be directed by the Superintendent of SUFRAMA, ad referendum of the Minister of State for Development, Industry and Foreign Trade.
