DECREE NO 5,842, DE July 13, 2006.

Approves the Regimental Framework and the Framework Demonstrative of the Cargos in Commission and the Gratified Functions of the National Institute of Metrology, Normalization and Industrial Quality-Inter, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments conferring you the art. 84, incisos IV and VI, point?a?, of the Constitution, and in view of the provisions of the Act No 10,683 of May 28, 2003,

DECRETA:

Art. 1st Ficam approved the Regimental Structure and the Cargos Demonstrative Framework in Commission and Gratified Functions of the National Institute of Metrology, Normalization and Industrial Quality-Inter, in the form of Annexes I and II to this Decree.

Art. 2nd In consequence of the provisions of art. 1st, stay remanded, in the form of Annex III to this Decree, of the Management Secretariat, the Ministry of Planning, Budget and Management, to the Inmeter the following posts in Committee of the Group-Direction and Higher Education and Gratified Functions: two DAS 101.5 ; ten DAS 101.4 ; a DAS 101.3 ; fourteen DAS 101.2 ; seven DAS 102.4 ; twenty and four DAS 102.2 ; and eight FG-1.

Art. 3rd The apostillations arising from the approval of the Regimental Structure of which it treats the art. 1st shall occur within the period of twenty days, counted from the date of publication of this Decree.

Single Paragraph. After the apostillations provided for in the caput, the Minister of State for Development, Industry and Foreign Trade shall publish in the Official Journal of the Union, within thirty days, counted from the date of publication of this Decree, nominal relationship of the holders of the posts in committee of the Group-Direction and Advisor Superiors-DAS, referred to in Annex II, indicating, inclusive, the number of vacant posts, their denomination and their level.

Art. 4th the inner regiment of the Inter will be approved by the Minister of State for Development, Industry and Foreign Trade and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 5th This Decree goes into effect on the date of its publication.

Art. 6th is revoked the Decree no 4,630 of March 21, 2003.

ANNEX I

REGIMENTAL STRUCTURE OF THE NATIONAL INSTITUTE OF

METROLOGY, NORMALIZATION AND INDUSTRIAL QUALITY-INMETRO

CHAPTER I

OF NATURE AND PURPOSE

Art. 1st The National Institute of Metrology, Normalization and Industrial Quality-Inmeter, federal municipality established by Law No 5,966 of December 11, 1973, with headquarters and venue in the Federal District, linked to the Ministry of Development, Industry and Foreign Trade, is the central executive body of the National System of Metrology, Normalization and Industrial Quality-Sinmeter, and has for purpose:

I-run national metrology and quality policies ;

II-check compliance with the technical and legal standards, as far as units of measurement are concerned, measurement methods, materialized measures, measuring instruments and pre-medidal products ;

III-maintain and conserve the standards of the units of measurement, as well as deploy and maintain the chain of traceability of the standards of the units of measurement in the Country, in order to make them harmonic internally and compatible in the international plan, targeting, at a primary level, their universal acceptance and, at secondary level, their use as support for the productive sector, with views on the quality of goods and services ;

IV-strengthen the participation of the Country in international activities related to metrology and quality, in addition to promoting the exchange with foreign and international entities and bodies ;

V-provide technical and administrative support to the National Council of Metrology, Normalization and Industrial Quality-Conmeter, as well as your advising committees, acting as your Secretariat-Executiva;

VI-fomenting the use of quality management technique in Brazilian companies ;

VII-plan and execute the accreditation activities of calibration and essays, proficiency testing providers, certification bodies, inspection, training and other necessary for the development of the technological services infrastructure in the Country ; and

VIII-coordinate, within the framework of the Sinmeter, compulsory and voluntary certification of products, of processes, services and voluntary certification of personnel.

CHAPTER II

DA ORGANIZATIONAL STRUCTURE

Art. 2nd The Inmeter has the following organizational structure:

I-bodies of direct and immediate assistance to the President:

a) Cabinet ;

b) Coordination-General of the Brazilian Network of Legal Metrology and Quality ;

c) Coordination-General of International Articulation ; and

d) Coordination-General Accreditation ;

II-sectional bodies:

a) Internal Audit ;

b) Federal Prosecutor's Office ;

c) Directorate of Planning and Development ; and

d) Director of Administration and Finance ;

III-singular specific organs:

a) Directorate of Quality ;

b) Directorate of Scientific and Industrial Metrology ;

c) Directorate of Legal Metrology ; and

d) Directorate of Technology and Innovation ; and

IV-decentralized bodies: Superintendencies.

CHAPTER III

DA DIRECTION AND APPOINTMENT

Art. 3rd The Inmeter is run by its President and by its Directors.

Art. 4th nominations for positions in commission and fulfilling functions integral to the Inmeter's regimental structure will be effected in accordance with the current legislation.

CHAPTER IV

DAS COMPETENCIES OF ORGANS

I Section

of the Direct and Immediate Care Bodies to the President

Art. 5th To Cabinet competes:

I-attend the President in his social and political representation ;

II-to be entrusted with the preparation and dispatching of the personal expedient of the President of the Inmeter ;

III-to monitor the plotting of the legal acts of interest of the Inmeter ;

IV-coordinate social communication activities ;

V-arrange for the publication and dissemination of the subjects of interest of the Inmeter ;

VI-coordinate the Internal Quality System of the Inmeter ;

VII-to provide technical-administrative support to the President of the Inter, in the quality of Executive Secretary of the Conmeter ; and

VIII-exercise other tasks assigned to it by the President of the Inmeter.

Art. 6th To the Coordination-General of the Brazilian Network of Legal Metrology and Quality competes to plan, direct and promote modernizing and standardizing actions of the technical and administrative procedures adopted in the execution of the delegated actions and activities to states and, specifically:

I-plan, implement, and support the training actions of the personnel involved in the execution of the delegated activities, in accordance with the programmes proposed by the respective areas of competence of the Inmeter ;

II-support, integrate and harmonize the actions of the executor bodies of the decentralized activities in the implementation of methodologies and procedures aimed at the optimization of results and integration with the Inmeter ;

III-coordinate the activities of the Superintendencies of the Inter ;

IV-propose changes in form and content and promote modernizing actions in the execution of activities delegated to the best care for Brazilian society ; and

V-exercise other tasks entrusted to it by the Chairman of the Inter, relating to the Network Brazilian of Legal Metrology and Quality.

Art. 7th To Coordination-General of International articulation competes:

I-co-ordinate, plan, articulate and promote the activities aimed at the relationship international of the Inmeter ;

II-monitor negotiations for the celebration of arrangements, agreements and contracts, with entities foreign and international, in addition to the participation of the Inmetre

III-supervise and monitor the realization of technical and exchange cooperation programmes with international and foreign organizations, in the areas of metrology, standardization and industrial quality, including for the development of human resources ;

IV-propose, coordinate and monitor, in articulation with the other areas of the Inter, the allocation of the resources indispensable to the fulfillment of international commitments ; and

V-coordinate, within the framework of the Inmeter, the international, technical-commercial negotiations, involving the areas of metrology, technical regulation and quality, acting as the Focal Point of Technical Barriers to Exports, with the aim of assisting small and medium-sized enterprises in their exporter effort.

Art. 8th The General Coordination of Accreditation competes to plan, drive, guide, coordinate, and perform accreditation activities and, specifically:

I-act as the accreditation body of certification, inspection, verification bodies of performance, training and proficiency testing provider, as well as accreditation body of calibration and testing laboratories and other bodies necessary for the development of the technological services infrastructure in the Country ;

II-coordinate the international and regional recognition actions related to the activities of accreditation ; and

III-participate in international and regional forums related to the activities of accreditation.

Section II

Of Sectional Organs

Art. 9th To Internal Audit competes to verify compliance, in relation to the prevailing standards, of the budgetary, accounting, financial, equity and human resources procedures, as well as, when determined by the President of the Inter, the suitability between the means employed and the results achieved and, specifically:

I-create indispensable conditions for ensuring the effectiveness of internal and external controls, seeking to ensure regularity in the realization of revenue and expenditure ;

II-examine specific legislation and correlates standards, orienting them as to their observance ;

III-promote regular inspections in the areas of Inmetro acting, to check physical execution and financial of the projects and activities, including those executed by third parties ;

IV-carrying out financial, accounting and administrative audits, for the purpose of assessing and certify the accuracy and regularity of the accounts and prove the efficiency and effectiveness in the application of the Inmeter's resources ; and

V-run extraordinary audits, of specific draft, which, in the interest of the administration, come to be determined by the President of the Inmeter.

Art. 10. To the Federal Prosecutor's Office, as the executive body of the Federal Prosecutor-General, it competes:

I-exercise the judicial and extrajudicial representation of the Inmetre, acting in the processes in which the Autarquia for author, ré, opponent or assistant ;

II-comply with and ensure compliance with the normative guidelines emanating from the Advocacy-General of the Union ;

III-to provide direct and immediate advice to the President and the organs of the Regimental Structure of the Inmetre, in the subjects of a legal nature, applying, in what couber, the provisions of the art. 11 of the Supplementary Law no 73 of February 10, 1993 ;

IV-examine and approve minutes of bidding editions, contract instruments, arrangements, and of other acts creators of rights and obligations, which should be concluded by the Inmeter ;

V-analyse and issue opinions and demonstrations on issues raised by the implementation of laws and of the regulations concerning the activities developed by the Inmeter ;

VI-to examine and issue opinions on projects of normative acts to be exclaims or proposed by the Inter, when they contain legal matters ; and

VII-ascertaining the liquidity and certainty of claims of any nature, resulting from the activities implemented by the Inter, signing them into active debt, for the purposes of friendly or judicial collection.

Art. 11. To the Directorate of Planning and Development competes:

I-coordinate, drive, supervise, promote, monitor, and evaluate the execution of activities related to the organization and administrative modernization of the Inmetro ;

II-obtain, in articulation with the relevant areas of government, the allocation of budget resources required to comply with the Inter's institutional mission and coordinate the elaboration of its budget proposal ;

III-promote and coordinate the elaboration of Inmetre proposals for the multiannual plan ;

IV-provide advising to the other Inmeter Directors in planning and managing their activities ;

V-plan, coordinate, supervise, promote and monitor the actions concerning development of human resources ;

VI-promote, coordinate, supervise and evaluate the planning process, elaboration and deployment of the Inter Systems Director of Informatics and Systems Director Plan ; and

VII-develop studies to subsidize strategic orientation and decision making process on the Inter.

Art. 12. The Directorate of Administration and Finance competes to plan, coordinate, direct, supervise, monitor, monitor and evaluate the implementation of the concernant actions to the Civil Personnel Systems of the Federal Administration, General Services, Financial Administration, Human Resources and Federal Accounting within the framework of the Inter.

Section III

Of The Natural Specific Organs

Art. 13. To the Directorate of Quality competes to plan, drive, guide, coordinate and perform compliance assessment activities and, specifically:

I-articulate with the different segments of the society, objecting to identify and prioritize the demands for compliance assessment programs ;

II-effecting feasibility, development, deployment, monitoring and evaluation studies of the different conformity assessment programmes, within the framework of the Sinmeter ;

III-promote actions to scrutinize and verify compliance of products, processes, and services to relevant technical standards and regulations ;

IV-guide and educate the different segments of society in the issues linked to the evaluation of compliance, quality and consumer relations ;

V-encourage the development of national standardization ; and

VI-elaborating technical regulations in the area of quality and coordinating recognition actions international of conformity assessment programs.

Art. 14. To the Directorate of Scientific and Industrial Metrology competes to plan, drive, coordinate and supervise the execution of activities within the framework of basic metrology and, specifically:

I-carry out or reproduce the units of measurement as well as maintain and conserve standards national metrologics ;

II-referencing, directly or indirectly, national metrological standards to international, aiming for harmonisation through key comparisons, international comparisons, regional comparisons and tracking ;

III-disseminating the units of the International System of Units-SI, their multiple and submultiples, by means of appropriate metrological methodologies ;

IV-to provide traceability to the metrological standards of the various laboratories in the Country ;

V-develop scientific and technological research relating to metrology and correlates areas ;

VI-render services of metrological nature, including designating reference laboratory national, for a given greatness, as per resolutions emanating from the Conmeter, and follow up on the performance of the activities concerning your acting as?Designated Laboratory?;

VII-to provide support to the areas of legal metrology, quality and accreditation, within the framework of metrology basic ;

VIII-participate in the international and regional forums related to the metrology activities scientific and industrial, as well as representing Brazil in the International Bureau of Poids et Mesures-BIPM, France, and other international instances of metrology ;

IX-coordinate the international recognition actions related to the standardization of units from SI ; and

X-disseminate knowledge of metrology to society, by means of courses, publication of instructional material, methodologies and presentation of works at technical events.

Art. 15. To the Directorate of Legal Metrology competes to guide, plan, direct, coordinate, monitor and promote the execution of activities within the framework of legal metrology, propose projects of technical regulations and, specifically:

I-propose programs for training and improvement of human resources in legal metrology ;

II-specify the requirements that models of materialized measures and measuring instruments should fill in, examining them, defining them and approving-os;

III-enunciating the requirements and specifications that pre-measured products should satisfy ;

IV-approve and supervise the programming of the activities to be developed by organs executors of the operational activities of metrology ;

V-establish the specifications of equipment, standards and facilities to be used by the executor organs of the operational activities of metrology ; and

VI-participate in the international and regional forums related to metrology activities legal.

Art. 16. To the Directorate of Technology and Innovation competes:

I-support the actions of industrial policy, fostering innovation and competitiveness of the sector productive ;

II-develop prospecting studies of strategic areas, analysis of scenarios and conjunctures, to subsidize the strategic orientation and decision making process in the Inmeter ;

III-support the other Inmeter Directors in analyzing new economic and financial impacts targeted projects for technological innovation and development of new products ;

IV-articulating, at national and international level, with research bodies and entities of the sector productive for the joint development of activities aimed at technological innovation and modernization of the industrial sector ;

V-coordinate, plan, direct, promote, and execute the technological and information activities activities support for dissemination of information in metrology, standardization, quality and on technical barriers to the business, technological, academic and scientific sectors, contributing to the process of technological

VI-orient, plan, drive, coordinate, control, and promote actions aimed at the development of the Inmeter Business Technology Park and Incubator ; and

VII-develop economic studies on trends in new technologies and innovation of products, to subsidize strategic orientation and decision making process in the Inter.

Section IV

Of The Decentralized Organs

Art. 17. The Superintendencies competes to comply with the guidelines and determinations emanating from the Inmeter Presidency and, where applicable, the implementation of the decentralized activities by the Inmeter.

CHAPTER V

OF THE ALLOCATIONS OF LEADERS

Art. 18. To the President of the Inter rests:

I-administer the Inmetre and practice all acts of operational, budgetary and financial management, authorizing expenses and ordering the respective payments ;

II-represent the Inter in judgment or outside of it, and may delegate this attribution ;

III-supervising and coordinating the activities of the integral organs of the Regimental Structure of the Inmetro ;

IV-render accounts of its management to the Union's Court of Auditors ;

V-regulate the subjects pertinent to the competencies and activities of the Inmeter ;

VI-submit to the approval of the Ministry of Development, Industry and Exterior Trade the inner regiment of the Inter ;

VII-practice the acts of effective posts of the Inmeter Personnel Framework, in Habilitation in public tender, as well as exercise disciplinary power under the legislation in force ;

VIII-grant retirement to the servers that it does jus for ;

IX-avocar, for decision or review, matters inherent in the integral bodies of the Structure Regimental of the Inter, without prejudice to the continuity of the exercise, by the same organs, of the assignments within it ;

X-firmar, as legal representative of the Inmetro, contracts, arrangements, agreements, adjustments and other similar trading acts ; and

XI-delegate any of its assignments, except those which, by their very nature or by legal sealing, can only be by it implemented privately.

Art. 19. The Directors, the Chief Prosecutor, the Chief Auditor, the Coordinators-General, the Chief of Staff and the other leaders of the Inmeter shall be required to plan, direct and coordinate the execution of the activities affected to their respective units and exercise other assignments being entrusted to them by the President.

CHAPTER VI

DAS GENERAL AND TRANSITIONAL PROVISIONS

Art. 20. The President of the Inmeter will be replaced, in his impediments and legal departs, by one of the Directors, designated by the Minister of State for Development, Industry and Foreign Trade.

Art. 21. The internal regiment shall define the detailing of the integral organs of the Regional Structure of the Inter, the competences of the respective units, the tasks of their leaders and the area of jurisdiction of Superintendencies.

Art. 22. The missing cases and the doubts raised in the application of the present Regimental Framework shall be directed by the President of the Inmeter, ad referendum of the Minister of State for Development, Industry and Foreign Trade.
