DECREE NO 7,039, DE December 22, 2009.
Promulga the Cooperation Protocol between the Government of the Federative Republic of Brazil and the Government of the French Republic regarding the Creation of a Franco-Brazilian Forum of Higher Education and Research, struck in Brasilia, on May 25, 2006.
THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and
Considering that the Government of the Federative Republic of Brazil and the Government of the French Republic celebrated, in Brasilia, on May 25, 2006, a Cooperation Protocol concerning the Creation of a Franco-Brazilian Forum of Higher Education and Research ;
Considering that the National Congress has approved this Cooperation Protocol by means of the Decree Legislative at 585, August 27, 2009 ;
Whereas the Cooperation Protocol entered into international vigour on August 16, 2009, under the terms of its Article 7 ;
Art. 1st The Protocol of Cooperation between the Government of the Federative Republic of Brazil and the Government of the French Republic regarding the Creation of a Franco-Brazilian Forum of Higher Education and Research, signed in Brasilia, on May 25, 2006, apensed by copy to this Decree, will be executed and fulfilled as entirely as in it contains.
Art. 2nd They are subject to approval by the National Congress any acts that may result in revision of the said Cooperation Protocol, as well as any further adjustments that, in the terms of art. 49, inciso I, of the Constitution, carries charges or engraved commitments to the national heritage.
Art. 3rd This Decree goes into effect on the date of its publication.

OF A FRANCO-BRAZILIAN FORUM OF HIGHER EDUCATION AND RESEARCH

Considering the Framework Agreement for cooperation between the Federative Republic of Brazil and the French Republic, signed in Paris on May 28, 1996 ;
Considering that cultural cooperation, franco-Brazilian university, scientific and technical technique is characterized by dense relationships that have been structured, over the past thirty years, by a set of fruitful cooperation agreements ;
Considering that many of the agreements establish relations between universities and Brazilian and French research institutions, among the most renowned in most fields of knowledge ;
Considering exemplary bilateral programmes of teaching, teaching and research and research (BRAFITEC, BRAFAGRI, Doctoral College Franco-Brazilian, CAPES-COFECUB) ;
Considering the Protocol of Inarrests between the Government of the Federative Republic of Brazil and the Government of the French Republic regarding Cooperation in the Area of Advanced Technologies and their Applications, signed in Paris on July 15, 2005 ;
Considering multilateral programmes in the which Brazil and France play a determining role ;
Considering the central roles assumed by the Brazil and France in favor of regional integration and particularly the role played in the process of rapprochement Latin America and the Caribbean-European Union (ALC-UE) ;
Considering, at last, that Brazil and France seek to emphasize a vision of higher education and research that privileges cultural diversity and an exchange ethic founded on mutual respect and balanced relations,
Wake up the following:
Create a Franco-Brazilian education forum superior and research, henceforth named?Forum?, which concrets a privileged bilateral relationship.
The Forum is an instance of enhanced dialogue intended for:
a) articulate the partnerships and programs of existing cooperation in the field of higher education and research and to give them greater clarity and visibility ;
b) to analyse the complementarity of the programmes, follow their evolution, evaluate regularly whether they correspond to the priorities determined in common by the Parties and whether they undertake the defined objectives ;
c) encourage the mobility of students, of the teachers and researchers ;
d) develop dissemination channels of information to respect of partnerships and cooperation programmes ;
and) bring the different economic actors closer and social ;
f) develop innovative partnerships and ;
g) propose new actions of multilateral cooperation arising from the experience of bilateral cooperation.
The Parties decide to establish a Board of Interministerial Orientation, henceforth named?Advice?, coordinated by the Ministry of Foreign Affairs and the Ministry of Education, by the Brazilian Party, and the Ministry of Foreign Affairs and the Ministry of National Education, of Higher Education and Research, by the French Party, henceforth named?Leading institutions?.
The Council brings together representatives of the actors academics, scientific and technological science of the concerned ministries, national evaluation agencies, university councils, and research institutions. The Council gathers alternately in France and Brazil every two years at the same time as a Franco-Brazilian symposium on higher education and research.
The leading Institutions will form the Registry Council Executive and have for responsibility spoon of the academic, scientific and technological actors, all information relevant to the evaluation and evolution of the various programs underway or anticipated. The leading Institutions may, informed the other Party, delegate to an institution by them chosen the function of the Secretariat of the Forum, entrusted with the centralisation and dissemination of information.
An electronic site presenting the Forum will be created in Portuguese and French.
Each Party shall notify the other of the fulfilment of the internal procedures required with regard to the entry into force of this Protocol of cooperation which will take effect on the day of receipt of the second notification.
The present Protocol of cooperation has validity for five (5) years and is reconducted tacitly. It can be denounced by the Parties, with advance notice of six months notified in writing to the other Party. In the event of non-resumption, the Parties respond by the obligations previously assumed.
Done in Brasilia on May 25, 2006 in two copies in languages Portuguese and French, the two texts making equally faith.
