DECREE OF January 31, 2013

Declares of public utility, for the purposes of dispropriation, in favor of the Seller Litoral S.A. S.A. dealership, the real estate it mentions, located in the Municipality of Itajaí, in the State of Santa Catarina.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers him on art. 84, caput, inciso IV, of the Constitution, in view of the provisions of art. 3º, art. 5º, caput, points "h" and "i", and art. 6º of Decree-Law No. 3,365 of June 21, 1941, at art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987 of February 13, 1995, and in accordance with the one in the ANTT Case No 50500.032105 /2012-15,

D E C R E T A:

Art. 1º Stay declared of public utility, for the purposes of dispossession, total or partial, in favor of the South S.A. Litoral Autopista dealership, the real estate covered and delimited by the topographic coordinates described below, excluded the goods of public domain, adjacent to the Highway Governor Mário Covas, BR-101/SC, located in the Municipality of Itajaí, in the State of Santa Catarina, necessary for the execution of the lateral street implantation works in the stretch between the km 119 + 045m and the km 121 + 991m, in the North lane:

I-Area 01: starts at section 1, georreferenced in the Brazilian Geodetic System, DATUM-SIRGAS 2000, MC-51 °W, coordinates Relative Retangular Plan, UTM System: E= 727,434.170 m and N= 7,020,663.948 m, dividing it with property of Drisan Participants and Ancioria Entrepreneurship Ltda. ; hence, it follows, confronting with property of Drisan Participants and Ancillary Entrepreneurship Ltda., with the azimute of 100 ° 46' 24 " and the distance from 23.05 m to point 2 (E=727.456, 811 m and N=7.020.659, 640 m) ; hence, it follows, confronting with property of Drisan Participants and Ancillary Entrepreneurial Ltda., with the azimute of 160 ° 35' 01 " and the distance from 20.83 m to point 2A (E=727.463, 735 m and N=7.020.639, 995 m) ; hence, it follows, confronting with the 101/SC, with the azimute of 309 ° 00' 45 " and the distance from 38.05 m to point 1 (E=727.434, 170 m and N=7.020.663, 948 m), start of description, thus closing the perimeter of the polygon above described with the area of 207.47 m² ; and

II-Area 02: starts if at point 2B, georreferenced in the Brazilian Geodetic System, DATUM-SIRGAS 2000, MC-51 °W, coordinates Relative Retangular Plan, UTM System: E= 727,520.452 m and N= 7,020,479.087 m, dividing it with property of Transniva Trade of Vehicles and Transport Ltda. ; hence, it follows, confronting with Transniva property Trade of Vehicles and Transport Ltda., with the azimute of 160 ° 35' 01 " and the distance from 40.69 m to point 3 (E=727.533, 978 m and N=7.020.440, 711 m) ; hence, it follows, confronting with Transniva property Trade of Vehicles and Transport Ltda., with the azimute of 208 ° 33' 30 " and the distance from 26.92 m to point 4 (E=727.521, 107 m and N=7.020.417,063 m) ; hence, it follows, confronting with the 101/SC, with the azimute of 340 ° 35'01 "and the distance from 25.27 m to point 4A (E=727.512, 707 m and N=7.020.440, 896 m) ; hence, it follows, confronting with public utility area, with the azimute of 11 ° 27' 49" and the distance from 38.97 m to the point 2B (E=727.520, 452 m and N=7.020.479,087 m), start of description, thus closing the perimeter of the polygon above described with the area of 659.59 m².

Art. 2º Stay the Automotive Autopic S.A. S.A. Dealership authorized to promote, with own resources, the dispossession of the areas of land and benefits of which it treats art. 1º, in the form of the current legislation and regulations.

Single Paragraph. The exproprier is allowed to invoke the urgency character in the process of dispossessing that it treats the caput, for purposes of immission in possession, in the terms of art. 15 of Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exonerate the dealership of the prior obtaining of the licensees and the fulfilment of the obligations to the environmental entities and other bodies of the public administration, necessary to the effector of activities referred to in art. 1º.

Art. 4º This Decree shall enter into force on the date of its publication.
