DECREE NO 7,248, DE August 2, 2010

Disposes on the execution of the Septuageth Third Additional Protocol to the Agreement on Economic Supplementation No. 18 (73PA-ACE18), signed between the Governments of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, on May 19 2010.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and

Considering that the 1980 Treaty of Montevideo, which created the Latin American Association of Integration (ALADI), signed by Brazil on August 12, 1980 and promulgated by Decree No 87,054 of March 23, 1982, provides for the modality of Economic Supplementation Arrangement ;

Considering that the Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and the Eastern Republic of Uruguay, based on the 1980 Treaty of Montevideo, signed on November 29, 1991, in Montevideo, the Economic Supplementation Agreement No. 18, promulgated by Decree No 550 of May 27, 1992 ; and

Considering that the Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and the Eastern Republic of Uruguay, on the basis of the Treaty of Montevideo of 1980, signed, on May 19, 2010, in Montevideo, the Septuagenth Third Additional Protocol to the Economic Supplementation Agreement No. 18, among the Governments of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay,

DECRETA:

Art. 1º The Septuagth Third Additional Protocol to the Agreement on Economic Supplementation no 18, between the Governments of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, of May 19, 2010, apse by copy to this Decree, shall be executed and complied with as entirely as in it if it contains.

Art. 2º This Decree shall enter into force on the date of its publication.

ECONOMIC SUPPLEMENTATION AGREEMENT NO 18 CONCLUDED BETWEEN ARGENTINA, BRAZIL, PARAGUAY And URUGUAY

Septuagth Third Additional Protocol

The Plenipotentiaries of the Argentina republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, accredited by their respective Governments under powers bestowed in good and due form, deposited expeditiously in the Secretarial-General of the Latin American Integration Association (ALADI),

VISTA the Eighteenth Protocol Additional to ACE-18 and GMC Resolution No. 43/03,

CONVEEM IN:

Article 1-Incorporation to the Agreement of Economic Supplementation N ° 18 a Guideline No. 27/08 of the MERCOSUR Trade Commission on?Modification of the CCM Guideline No. 10/07 MERCOSUR Origin Regime?, which is listed as an annex and integrates the present Protocol.

Article 2º-This Protocol shall enter into force thirty days after the notification by the General Secretariat of ALADI to the signatory countries that it received the communication from the MERCOSUR Registry informing the incorporation of the MERCOSUR standard and its corresponding Additional Protocol to the ordinates legal of the four States Parties to MERCOSUR.

The General Secretariat of ALADI is expected to perform such notification, as far as possible, on the same day as it receives the communication from the Registry of MERCOSUR.

Article 3º-Once in force, the present Protocol will replace the provisions in the specific origin requirement for the tariff position NCM 8517.12.21, set out in the Annex to the Sexaggeration Second Additional Protocol to ACE 18.

The General Secretariat of ALADI will be depository of the this Protocol, of which it shall send duly authenticated copies to the Governments of the signatory countries and to the Registry of MERCOSUR.

MODIFICATION OF GUIDELINE CCM # 10/07

?MERCOSUR ORIGIN REGIME?

VISTA: The Treaty of Assumption, the Preto Gold Protocol, Decision N ° 01/04 of the Common Market Council and Guideline N ° 05/04 of the MERCOSUR Trade Commission ;

CONSIDERING:

That the MERCOSUR Origin Regime provides to the The MERCOSUR Trade Commission to establish specific requirements of origin, in an exceptional and justified manner, as well as review the requirements already established ; and

That you need to suit the source requirements in force on the changes recorded in the productive structures of the States Parties to the MERCOSUR,

THE COMMISSION OF TRADE APPROVES THE FOLLOWING

GUIDTRIZ:

Art. 1º-If the specific requirement of origin constant in the Annex of the CCM Guideline No. 10/07 is modified for the tariff position NCM 8517.12.21, which will become the following:

?Fulfillment of the following productive process:

A-Montage of at least 80% of printed circuit boards by product ;

B-Montage and welding of all components on the plates of printed circuit ;

C-Montage of the electrical and mechanical parts totally disaggregated at basic level of components ; and

D-Integration of printed circuit boards and parts electrics and mechanics in the formation of the final product.?

Art. 2º-Calls on States Parties to instruct their respective Representations together with the Latin American Integration Association (ALADI) to protocolize this Guideline in the framework of the Economic Supplementation Agreement No. 18, under the established terms in Resolution GMC No. 43/03.

Art. 3º-States Parties shall incorporate the present Guideline to their respective internal legal ordinations before 31 /XII/08.
