DECREE OF October 26, 2004

Declares of social interest, for agrarian reform purposes, rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of Supplementary Law No. 76 of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964 and 2º of Law No. 8,629 of February 25, 1993,

D E C R E T A:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"Farm Soliety", with registered area of three hundred and sixty-four hectares, and area measure of three hundred and twenty-three hectares, three airs and fifties and nine centiars, situated in the Municipality of Monte Santo, object of the Records n the R-1-2.616, fls. 191, Book 2A-5 ; R-1-2.630, fls. 06, Book 2-A-6 and R-1-2.664, fls. 44, Book 2-A6, of the Estate Registration Card of the Comarca of Monte Santo, State of Bahia (Process INCRA/SR-05/nº 54160.000657/200403) ;

II-"Sossego I Farm", with registered area of seven hundred and twenty hectares, and measuring area of seven hundred and five hectares and forty-six ares, situated in the Municipality of Santa Luzia, object of Registration n o R-6-1.791, Book 2-RG, of the Office of Registration of Real Estate of the Una Comarch, State of Bahia (Process INCRA/SR05/nº 54160.004076 /2002-71) ;

III-"Flechal Farm", with area of twenty-two thousand, one hundred and sixty-nine hectares and eighty ares, situated in the Municipality of Santa Luzia, object of Registration n o R-4-193, fls. 193, Book 2, of the Charter of the 1 the Oftice of the Comarch of Santa Luzia, State of the Maranhão (Process INCRA/SR-12/nº 54230.001674 /2000-20) ;

IV-"Cheerful Farm", known as the "Frontier Farm", with area of a thousand, three hundred and forty-nine hectares and twenty-five ares, situated in the Municipality of Riachão, object of the Registrars n the R-1-1.453, fls. 43, Book 2-G ; R-1-1.454, fls. 44, Book 2-G and R1-1.559, fls. 149, Book 2-G, of the 1 Carthorium of the Riachin Comarch, State of the Maranhão (Process INCRA/SR-12/nº 54234.000291 /2003-72) ;

V-"Fazenda Uru", with area of five thousand, two hundred and seventy and three hectares and four ares, situated in the Municipality of Terra Nova do Norte, object of Registration n o 4,181, Ficha 01, Book 2, of the Estate Registration Office of the Comarca of Colder, State of Mato Grosso (Process INCRA/SR-13/nº 54245.000379 /97-47) ;

VI-"Beautiful Bar Farm", with area of three thousand, two hundred and twenty-five hectares, thirty three airs and sixty centiars, situated in the Municipality of Poxoréo, object of Registration n o R-1-1.534, fls. 100, Book 2-F, of the Estate Registration Card of the Comarca of Poxoréo, State of Mato Grosso (Case INCRA/SR-13/nº 54240.001203 /97-25) ; and

VII-"Fazenda São Geraldo", with area of seishundred and seventy-seven hectares, seventy and two airs and eighty-six centiars, situated in the Municipality of Saint Geraldo of the Araguaia, object of Registration n o R-2-5.445-L2Z, Ficha 01, Book 2, of the Registration Office of Buildings of the Xinguara Comarca, State of Pará (Process INCRA/SR-27/nº 54600.001984 /2003-67).

Art. 2º Delete from the effects of this Decree the semovents, machinery and agricultural implements as well as the existing benefits in the real estate referred to in art. 1º and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute for Colonization and Agrarian Reform-INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Act No. 76 of July 6, 1993, and to maintain the areas of Legal reservation and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferably in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree shall enter into force on the date of its publication.
