DECREE NO 7,075, DE January 26, 2010.

Approves the Regimental Framework and the Framework Demonstrative of the Cargos in Commission and the Gratified Functions of the National Supplementary Pension Oversight-PREVIC, repeal the Decree no 606 of July 20, 1992, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments conferring you the art. 84, incisos IV and VI, point?a?, of the Constitution, and in view of the provisions of the Act No 12,154 of December 23, 2009,

DECRETA:

Art. 1st Ficam approved the Regimental Structure and the Cargos Demonstrative Framework in Commission and Gratified Functions of National Supplemental Security Oversight-PREVIC in the form of Annexes I and II to this Decree.

Art. 2nd In consequence of the provisions of the art. 1st, stay remanded, in the form of Annex III to this Decree, of the Management Office of the Ministry of Planning, Budget and Management for PREVIC, the following posts in Committee of the Group-Direction and Superiors-DAS and Functions Gratified-FG: a DAS 101.6 ; five DAS 101.5 ; twenty seven DAS 101.4 ; thirty-nine DAS 101.3 ; twenty-nine DAS 101.2 ; twenty-six DAS 101.1 ; six FG-1 ; ten FG-2 ; and twelve FG-3.

Art. 3rd The Minister of State for Social Security will be publishing in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree, nominal relation of the holders of the posts in committee of the Group-Direction and Superiors-DAS referred to in Annex II, indicating, inclusive, the number of vacant posts, its denomination and its level.

Art. 4th the internal regiment of PREVIC will be proposed by its Board Colegiated and approved by the Minister of State for Social Security, and is to be published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 5th Ficam held, until its review or revocation by PREVIC, observed the competency of the municipality, the normative and operational acts of the Supplementary Pension Office of the Ministry of Social Security, in force on the date of publication of this Decree.

Single Paragraph. References to the Supplementary Pension Office or the supervisory body or supervisor of the activities of the closed entities of supplementary pension contained in the legislation in force must be understood, as of the publication of this Decree, as references to PREVIC.

Art. 6th Stay transferred from the Ministry of Social Security to PREVIC:

I-the technical and patrimonial hits, obligations, rights and revenues corresponding to the activities assigned to PREVIC ;

II-the budget balances of the Supplementary Pension Secretary ;

III-the contracts or installments of these, up to their term, necessary for installation, maintenance and the operation of PREVIC, the corresponding contractual additives must be formalized ; and

IV-the materials of consumption and congeners acquired to meet, in whole or in part, the needs of the Supplementary Pension Secretary.

Art. 7th Administrative processes in tramway in the Supplementary Pension Office shall be transferred to PREVIC.

Art. 8th The Ministry of Social Welfare and the National Social Insurance Institute-INSS will provide the services and support necessary for the maintenance of PREVIC's activities, up to its complete organization.

Art. 9th This Decree enters into force of the date of its publication.

Art. 10. It is revoked the Decree no 606 of July 20, 1992.

ANNEX I

REGIMENTAL STRUCTURE OF THE NATIONAL Supplementary Pension Supervision

CHAPTER I

OF NATURE, HEADQUARTERS, PURPOSE AND COMPETENCIES

Art. First National Oversight of Supplemental Welfare-PREVIC, special nature municipality, endowed with administrative and financial autonomy and equity, linked to the Ministry of Social Security, with headquarters and venue in the District Federal, will have acting throughout the national territory as the watchdog and supervision of the activities of the closed entities of supplementary pension and implementation of policies for the supplementary pension scheme operated by the referred to entities.

Art. 2nd Competes to PREVIC:

I-carry out the surveillance of the activities of the closed entities of supplementary pension and their operations ;

II-ascertain and judge the infractions by applying the cableable penalties ;

III-expedition instructions and establish procedures for the application of the standards relating to their area of competence, in accordance with guidelines of the National Supplementary Pension Council, the one that refers to the inciso XVIII of the art. 29 of Law No 10,683 of May 28, 2003 ;

IV-authorize:

a) the constitution and operation of the entities closed on supplementary pension, as well as the application of the respective statutes and regulations of benefit plans ;

(b) the merger, fission, incorporation or of any other form of societal reorganization, relating to the closed entities of supplementary pension ;

c) the celebration of arrangements and terms of accession by sponsors and institutors, as well as the withdrawals of sponsors and institutors ; and

d) the sponsorship transfers, groups of participants and assisted, benefit plans, and reservations between closed entities of supplementary pension ;

V-harmonize the activities of the entities closed pension complimentary with the standards and policies set for the segment ;

VI-decreeing intervention and settlement extrajudicial from the closed entities of supplementary pension, as well as nominating interventor or liquidator, pursuant to the law ;

VII-nominate special administrator of plan specific benefits, and may assign you powers of extrajudicial intervention and settlement in the form of the law ;

VIII-promoting mediation and conciliation between closed entities of supplementary pension and between these and their participants, assisted persons, sponsors or institution, as well as to direct disputes that are submitted to it in the form of the Act No 9,307 of September 23, 1996 ;

IX-send annual report of your activities to Ministry of Social Security and, by its intermediary, to the President of the Republic and to the National Congress ; and

X-adopt the arrangements necessary to the fulfillment of your goals.

Single Paragraph. In the exercise of their administrative skills, it is still up to PREVIC:

I-deliberate and adopt the necessary procedures, in accordance with the law, as to:

a) celebration, amendment or extinction of your contracts ; and

b) appointment and exoneration of servers ;

II-hire works or services, according to the applicable legislation ;

III-acquire, administer and alienate your goods ;

IV-submit to the Minister of State for Social Security to your proposed budget ;

V-create regional units, observed the limits and conditions set out in this Decree ; and

VI-exercise other attributions arising from law or regulation.

CHAPTER II

DA ORGANIZATIONAL STRUCTURE

Art. 3rd A PREVIC has the following organizational structure:

I-collegiate body: Colegiated board ;

II-direct and immediate assistance bodies to the Director Superintendent:

a) Cabinet ;

b) Coordination-General of Special Projects ;

c) Notice of Communication Social ; and

d) Advisory on International Relations ;

III-direct and immediate assistance bodies to the Collegiate Board:

a) Coordination-General Support to the Colegiated Directorate ;

b) Ouvidoria ; and

c) CorregIA ;

IV-sectional organs:

a) Directorate of Administration ;

b) Federal Prosecutor's Office ; and

c) Internal Audit ;

V-natural specific organs:

a) Directorate of Analysis Technique ;

b) Director of Surveillance ; and

c) Directorate of Actuarial Affairs, Contábeis and Economic ;

VI-decentralized bodies:

a) Regional Office I-São Paulo ;

b) Regional office II-Rio de Janeiro ;

c) Regional Office III-Minas Gerais ;

d) Regional Office IV-Pernambuco ; and

e) Regional Office V-Rio Grande do Sul.

CHAPTER III

DA DIRECTION AND APPOINTMENT

Art. 4th A PREVIC will be administered by a Colegiated Directorate composed of a Director-Superintendent and four Directors, chosen between persons of reputation and notorious competence, to be appointed by the Minister of State for Welfare State Social and appointed by the President of the Republic.

Art. 5th The Chief Prosecutor shall be appointed by indication of the Advocate General of the Union.

Single Paragraph. The posts in commission and the fulfilling functions of a legal nature within the Federal Prosecutor's Office will be provided by members of the Federal Prosecutor-General's Office and, exceptionally, of the Advocacy-General of the Union, heard the Chief Prosecutor.

Art. 6th The nomination of the Auditor-Chief will be preceded by annuity of the Union Controller-General.

Art. 7th The remaining posts will be provided in the form of the legislation in force.

CHAPTER IV

OF THE COLLEGIATE BODY

Art. 8th The Collegiate Board, consisting of five members, has the following composition:

I-Director-Superintendente;

II-Director of Technical Analysis ;

III-Director of Surveillance ;

IV-Director of Actuarial Affairs, Contábeis and Economic ; and

V-Director of Administration.

Art. 9o The Colegiated Board sessions will be registered in minutes and made available on site on the worldwide computer network (internet), the legal hypotheses of secrecy have been ressaved.

Art. 10. The deliberations of the Board of Directors shall be taken by a simple majority, present to a majority of its members, with the Director-Superintendent, in addition to the ordinary vote, the quality in the event of a tie.

§ 1st The deliberations of the Collegiate Board referring to the incisos III, IV, XI and XII of the art. 11 and to art. 12 will be adopted by an absolute majority.

§ 2nd The decisions of the Collegiate Board will be motivated and each Director will vote with independence, substantiating their vote, vetting abstention.

§ 3rd The internal regiment of the PREVIC shall fix the chances of impediment of the Directors.

CHAPTER V

DAS COMPETENCIES OF ORGANS

I Section

The Collegiate Body

Art. 11. Competes in the Colegiated Directorate:

I-submit proposals and offer information detailed to the Ministry of Social Welfare for the formulation of policies and regulation of the supplementary pension scheme operated by the closed entities of supplementary pension ;

II-approve the criteria and guidelines of the annual supervision programme under the scheme operated by the closed entities of supplementary pension ;

III-to decide, in the first degree, on the completion of the final reports of the administrative proceedings initiated by the dishwasher of an infringement or by initiation of inquiry, with the purpose of ascertaining the responsibility of physical or legal person, and on the application of penalties cableable ;

IV-appreciate and judge, in the first degree, the imputations regarding the tax launches of the Supplementar Health Insurance and Control Rate-TAFIC ;

V-elaborate and disseminate periodic reports of your activities ;

VI-review and refer the demonstratives accounting and the installments of PREVIC accounts to the competent bodies ;

VII-appreciate and judge, ending the instance administrative, the appeals brought against decisions by the Directors and the resources interposed by the servers of the respective Directors, ressaved the cases provided for in the incisos III and IV ;

VIII-expedition instructions and establish procedures for the application of the standards relating to their area of competence, in accordance with the guidelines of the National Supplementary Welfare Council and the National Monetary Council ;

IX-harmonize the activities of the entities closed pension complimentary with the standards and policies set for the segment ;

X-deliberation on the special schemes of intervention, extrajudicial liquidation and special administration within the closed entities of supplementary pension ;

XI-propose to the Minister of State for Welfare State Social the internal regiment of PREVIC ;

XII-approve the Mediation Regulation, Conciliation and Arbitrage ;

XIII-approve the strategic plan of PREVIC ;

XIV-approve the budget proposal to be submitted to the Minister of State for Social Security ;

XV-deliberating on:

a) celebration, amendment or extinction of PREVIC contracts ;

b) appointment and exoneration of servers ; and

c) acquisition, administration and disposal of its goods ;

XVI-to conclude agreement with the Minister of State for Social Security for the establishment of management and performance targets for PREVIC ;

XVII-approve the annual report of activities from PREVIC ;

XVIII-define guidelines regarding the human resource development and the administration of the general framework of PREVIC personnel ;

XIX-set the general guidelines for the preparation of plans, programs and goals for improvement, development, empowerment and human resource management ;

XX-supervise the management of directors, examining the acts practiced, and may ask them for additional information ;

XXI-adopt the necessary arrangements to the fulfilment of your goals ;

XXII-set, annually, the performance targets institutional of PREVIC, taking into consideration the agreement referred to in the inciso XVI ; and

XXIII-exercise others assignments arising from law or regulation.

Art. 12. The Collegiate Board will be able to delegate competence:

I-to any of its members, in the form of its internal regiment, except those whose delegation is veded by law ; and

II-to the Director of Supervision, to exercise the assignments provided for in the incisos III and IV of the art. 11, except in cases where:

a) the infraction indicates application of fine cash worth of more than R$ 30,000.00 (thirty thousand reais), of suspension penalty for period exceeding thirty days or temporary inabilition ; and

b) the administrative collection of the debt relative to the TAFIC correspond to the upper period to two quadrimasters.

Single Paragraph. At the end of each financial year, PREVIC will promote the update, by the National Consumer Price Index-INPC as measured by the Brazilian Institute of Geography and Statistics-IBGE Foundation or by another index that comes to replace it, of the value to which refers to point (?a? of the inciso II.

Section II

of the Direct and Immediate Care Bodies to the Director Superintendent

Art. 13. The Cabinet competes:

I-watch the Director-Superintendent in its tasks of legal and institutional representation and to deal with the preparation and dispatch of their administrative expedient ;

II-arrange for the official publication and the dissemination of the subjects related to the PREVIC acting area ;

III-collaborating on the integration of organs and units of PREVIC ;

IV-coordinate and track the input stream and exit of the institutional documents of responsibility of the Director-Superintendente; and

V-exercise others skills that are committed to it by the Director-Superintendent.

Art. 14. To the Coordination-General of Special Projects competes:

I-elaborate the strategic plan of PREVIC ; and

II-develop special projects, in the area of competence of PREVIC.

Art. 15. To the Social Communication Advisor competes:

I-plan, coordinate, supervise and run the social communication activities ;

II-keep track of the progress of the projects interest of PREVIC in tramping in the National Congress ; and

III-to provide to the Minister of State of Social Security the information necessary for the fulfillment of consultations and applications formulated by the National Congress related to the competencies of PREVIC.

Art. 16. To the Advisory of International Relations competes:

I-co-ordinate, follow up and supervise the activities concerning the conclusion and execution of agreements, contracts, arrangements, partnership terms and similar instruments with foreign public or private organizations, aiming at the realization of the objectives of PREVIC ; and

II-articulate with government entities and foreign bodies for conducting studies, technical conferences, congresses and similar events, as well as for the realization of integrated monitoring actions, exchange of information and supervision, in relation to the pension scheme complementary operated by the closed entities of supplementary pension in the Country.

Section III

of the Direct and Immediate Care Bodies to the Colegiated Directorate

Art. 17. To the General Coordination of Support for the Colegiated Directorate competes:

I-exercise the functions of the Executive Officer of the Collegiate Board and the Commission on Mediation, Conciliation and Arbitration, whose organisation and operation will be disciplined in the regulation referred to as the inciso XII of the art 11 ; and

II-organize the expedients and processes administrative for deliberation of the Colegiated Directorate.

Art. 18. À Ouvidoria competes:

I-receive and refer the complaints, denunciations, representations and suggestions that relate to PREVIC's activities and operations ;

II-inform the person concerned the progress and the result of the arrangements adopted in relation to the demonstrations received ;

III-organize and interpret the set of manifestations received and producing indicative statistics of the level of satisfaction of the agents involved in the closed supplementary pension scheme ;

IV-submit recommendations to the Directorate Collegiate aiming at the enhancement and correction of situations of inadequate operation of the closed supplementary pension scheme ;

V-act as additional channel of communication between the server and the Director-Superintendent of PREVIC ; and

VI-disclose your competencies to the agents involved in the activities of the closed supplementary pension scheme.

§ 1st The Ouvidor will exercise your assignments with autonomy and independence.

§ 2nd The Ouvidor will forward half-yearly report of its activities to the Colegiated Directorate, without prejudice to the forwarding, at any time, of information or recommendations that it understands pertinent.

§ 3rd Ouvidoria will keep the secrecy of the source when the person expressly requests the preservation of his or her identity, without prejudice to the fulfilment of the provisions of the art. 26.

§ 4th The Colegiated Board shall ensure the means appropriate to the exercise of the activities of Ouvidoria.

Art. 19. To Internal Affairs competes:

I-keep track of the performance of the servers and leaders of PREVIC's bodies and units, scrutinizing and evaluating their functional conduct ;

II-give due course to representations or substantiated complaints that you receive, regarding the acting of the servers in exercise at PREVIC ;

III-realizing correction in the various organs and units of PREVIC, suggesting the measures necessary for the rationalization and efficiency of services ;

IV-institution, of office or by determination superior, union and disciplinary administrative proceedings regarding the servers, submitting them to the decision of the Colegiated Directorate ; and

V-propose to the Director-Superintendent to refer to the Federal Prosecutor's Office or to the Advocacy-General of the Union of application for correction in the Federal Prosecutor's Office or of ascertaining of imputed functional fault to its members.

Single Paragraph. The establishment of unionists and disciplinary administrative proceedings relating to acts of the members of the Board shall be within the competence of the Minister of State for Social Security.

Section IV

Of Sectional Organs

Art. 20. To the Directorate of Administration competes:

I-plan, coordinate and supervise the execution of organizational organization and innovation activities, as well as those related to federal human resource, general, planning and budget, accounting, information resources administration, and informatics, financial administration and organization and institutional innovation within the framework of PREVIC ;

II-propose to the Colegiated Directorate:

a) annual and multiannual plans and programmes budget of PREVIC ;

b) General guidelines, including global targets quantitative and qualitative, for the use, maintenance and management of heritage and operational expenses, in line with the action plan approved by the Colegiated Directorate ;

c) General guidelines for the preparation of plans, programs and goals for improvement, development and management of people ;

d) guidelines regarding the proofing of human resources and the administration of the general framework of PREVIC personnel ; and

e) guidelines for the celebration of convenians and contracts with financial institutions ;

III-promote the execution activities fiscal, financial and accounting, within the framework of PREVIC ;

IV-manage the physical-budget execution and financial from the established annual schedule, proposing corrective actions ;

V-adopt the procedures, defined by Collegiate Board, required by:

a) celebration, amendment or termination of contracts ;

b) appointment and exoneration of servers ; and

c) procurement, administration and disposal of goods ;

VI-manage the acquisition, use and maintenance of mobile goods, materials and services, in line with the established targets for operating expenses, adopting corrective actions ;

VII-promote registration, treatment and control of the operations relating to the budgetary, financial and heritage administration of PREVIC, with a view to the elaboration of accounting statements of the activities of the Federal Accounting System ;

VIII-coordinate and manage the execution of the plans, programs and targets for improvement, development, empowerment and management of people ;

IX-realizing the collection, the storage, the treatment and management of data and information from the closed entities of supplementary pension and their benefits plans by making them available to the organs of the other directorates in accordance with their respective competencies ;

X-propose and coordinate the elaboration and execution of projects regarding information technology ; and

XI-propose and coordinate the data security policy and information.

Art. 21. To the Federal Prosecutor's Office, as the implementing body of the Federal Prosecutor-General, it competes:

I-represent judicial and extrajudicially the PREVIC ;

II-to ensure compliance with the Constitution, of the laws and acts emanating from the Public Powers, under the normative guidance of the Federal Prosecutor General and the Advocacy-General of the Union ;

III-exercise the consulting activities and legal advice within the framework of PREVIC, applying, in what couber, the provisions of the art. 11 of the Supplementary Law no 73 of February 10, 1993 ;

IV-coordination and supervising, technical and administratively, the activities developed by the Federal Prosecutor's Office in the regional units of PREVIC ;

V-refer to the Federal Prosecutor-General or the Law-General of the Union, as the case is, request for an investigation of functional lack practiced, in the exercise of their assignments, by their respective members ;

VI-promoting mediation and conciliation between closed entities of supplementary pension and between these and their participants, assisted, sponsor or institution, as well as to address the disputes submitted to PREVIC in the form of the Act No. 9,307 of September 23, 1996, and according to the Regulation, Conciliation and Arbitration ;

VII-set, after approval by the Chief Prosecutor, for the PREVIC units, the interpretation of the legal planning ;

VIII-ascertaining the liquidity and certainty of PREVIC's claims, of any nature, by enrolling them in active debt, for user-friendly or judicial collection purposes ; and

IX-approve, upon prior and conclusive analysis, within the framework of PREVIC:

a) the texts of tender and tender editions, the acts and contracts of them resulting, as well as the terms of the convenon to be firmed ; and

b) the acts by which if intends to recognize the inchargeability or to declare the bidding waiver.

Art. 22. The Internal Audit competes to examine the legal compliance of the acts of financial-financial management, patrimonial, personnel, and other administrative and operational systems, and to verify the faithful compliance with current guidelines and standards, and, specifically:

I-plan, monitor, and control the development of preventive and corrective audits, identifying and evaluating risks, recommending preventive and corrective actions to decentralized organs and units, in line with the management model by results ;

II-subsidizing the Director-Superintendent and the Directors with information on the audits and their results, with a view to the improvement of PREVIC's audit and management procedures ;

III-evaluate the internal controls of management as to their effectiveness, efficiency, effectiveness and economicity, resguarding the interests of PREVIC ;

IV-refer to the Internal Affairs request for ascertaining responsibility, when in its activity prove irregular irregularity of examination under the disciplinary aspect, indicating with clarity the irregular fact ;

V-promote regular inspections to verify the physical and financial execution of the programs, projects and activities and to perform extraordinary audits determined by the Director-Superintendente;

VI-produce knowledge about vulnerabilities and illicit acts concerning the area of acting of the PREVIC, upon the use of research techniques and analyses ;

VII-propose to the Directorate Colegiated the adoption of measures necessary for the improvement of the operation of the internal organs of PREVIC ; and

VIII-answer by the systematization of the information required by the organs of control of the Executive Power.

V Section

Of The Natural Specific Organs

Art. 23. To the Directorate of Technical Analysis competes:

I-parse and authorize:

a) the constitution, operation and cancellation of the closed entities of foresight complementary, as well as the implementation of the respective statutes and regulations of benefit plans and their changes ;

b) the operations of merger, fission, incorporation or any other form of societal reorganization, relating to the closed entities of supplementary pension ;

c) the celebration of arrangements and terms of accession by sponsors and institutors, and their changes, as well as withdrawals from sponsors and institutors ; and

d) sponsorship transfers, participant and assistive groups, benefit plans and reservations among closed entities of supplemental foresight ;

II-proceed to the examination of consultations of the closed entities of supplementary pension, in the sphere of their competence, on matters relating to the supplementary pension scheme operated by the said entities ;

III-prepare, for consideration of the Directorate Collegiate, minutes of normative instructions, resolutions, portaries and other acts of normative or procedural content in the sphere of their competence ; and

IV-manage the enclosed entities cadaster of supplementary pension, of their leaders, as well as the National Cadastro of Benefits Plans-CNPB.

Art. 24. To the Directorate of Surveillance competes:

I-scrutinize the activities of the entities closed on supplementary pension and its operations ;

II-scrutinize, in the various segments of investments, operations and applications of the guaranteed resources of the technical reserves, funds and provisions of the plans administered by the closed entities of supplementary pension ;

III-scrutinise the constitution of reserves techniques, provisions and funds of the pension benefits plans administered by the closed entities of supplemental foresight ;

IV-scrutinizing compliance with legislation applicable to the elaboration of the actuarial, accounting, and investments of the closed entities of supplementary pension and the plans they administer ;

V-proceeding to surveys and syndications, in scope of its competence ;

VI-launder self-infringement when finding out the occurrence of non-compliance with legal or regulatory obligation, when it does not fit the formalization of an adjustment term of conduct ;

VII-proper application of penalties administrative to officers responsible for infractions ascertained in administrative proceedings arising from the action of surveillance, representation or denunciation ;

VIII-constituting, on behalf of PREVIC, upon launch, the claims arising from the non- pickup from TAFIC and promote its administrative collection ;

IX-follow up and guide the related actions to special schemes for intervention, extrajudicial settlement and special administration regarding the closed entities of supplementary pension and their benefits plans ;

X-realizing the interlocution with representatives of national bodies and entities responsible for the supervision of activities correlates to those of the supplementary pension scheme operated by the closed entities of supplementary pension ;

XI-propose, for consideration and approval of the Collegiate Board, the annual surveillance program ;

XII-plan and monitor the execution of the action fiscal ;

XIII-prepare, for consideration of the Directorate Collegiate, minutes of instructions, resolutions, portaries and other acts of normative or procedural content in the sphere of their competence ;

XIV-carry out the analysis and follow-up of proceedings instituted within the Directorate ; and

XV-exercise the functions to which it makes mention of art. 62 of the Supplementary Law no 109 of May 29, 2001.

Art. 25. To the Directorate of Actuarial Affairs, Contábeis and Economic Competes:

I-monitor, control, and analyze the constitution of the technical reserves, provisions and funds, the actuarial, accounting and investment statements, and the operations and applications of the guarantor resources of the plans administered by the closed entities of supplementary pension ;

II-elaborating studies and research in the areas actuarial, accounting and economic and investment, regarding the plans of the closed entities of supplementary pension welfare ;

III-prepare, for consideration of the Directorate Collegiate, minutes of instructions, resolutions, portaries and other acts of normative or procedural content in the sphere of their competence ;

IV-proceed to the analysis of consultation of closed entities of supplementary pension in the sphere of its competence, on the matters relating to the supplementary pension scheme operated by the said entities ;

V-propose the celebration and monitor the execution of arrangements for exchanges of information with other government bodies and public and private entities, with views to the supervision of the enclosed supplementary pension scheme ; and

VI-realizing the interlocation with the representatives of the bodies and entities responsible for drawing up standards that are in the interests of the supplementary pension scheme operated by the closed entities of supplementary pension with respect to actuarial, accounting and of application of the guarantor resources of the plans of such entities.

Section VI

Of Common Obligations

Art. 26. The identity of the complaint author will be preserved during the realization of the respective ascertaining actions.

CHAPTER VI

OF THE ALLOCATIONS OF LEADERS

I Section

Of The Director Superintendent and the Directors

Art. 27. To Director Superintendent it is incumbent:

I-represent PREVIC ;

II-exercise the superior direction and the command hierarchical of PREVIC ;

III-chair the proceedings of the Board Collegiate ;

IV-designate interventor or liquidator of closed entities of supplemental foresight ;

V-assign special administrator of plan of specific benefits operated by closed entity of supplemental pension ;

VI-exercise the skills that you are delegated by the Colegiated Directorate ;

VII-refer to the Minister of State for Social Security, when it is the case, the expedients arising from deliberations of the Colegiated Board ;

VIII-submit to the Minister of State for Social Security the proposal for the PREVIC budget ;

IX-send annual report of your activities to Ministry of Social Security and, by its intermediary, to the President of the Republic and to the National Congress ;

X-nominate and exonerate servers, providing the effective positions and in commission and gratified functions, at the limits of the ministerial delegation, as well as exercise disciplinary power under the legislation ;

XI-propel the quality vote, in cases of tie, in the deliberations of the Colegiated Board ;

XII-decide, ad referendum of the Board Collegiate, the urgent and inadiable issues ; and

XIII-exercise other assignments defined in internal regiment.

Single Paragraph. The internal regiment will discipline the replacement of the Director-Superintendent in its impediments and absences.

Art. 28. To Directors it is incumbent:

I-comply with and enforce the legal provisions and regulatory ;

II-plan, drive, coordinate, orial, monitor and evaluate the execution of the activities affection to the respective units ;

III-promote the credibility of PREVIC ;

IV-comply with PREVIC's plans and programs ;

V-practise and expedite management acts administrative within their own assignments and received by delegation ;

VI-execute the decisions taken by the Directorate collegiate ;

VII-submit proposals for adjustments and modifications to the legislation that makes up the supplementary pension scheme operated by the closed entities of supplemental foresight ; and

VIII-contribute to the modernization of the environment institutional acting of PREVIC.

Section II

Of the other Leaders

Art. 29. To the Chief of Staff, the Chief Prosecutor, the Heads of Advisor, the Corregedor, the Ouvidor, the Chief Auditor, the Coordinators-General and the other leaders is to plan, direct, coordinate, guide, monitor and evaluate the execution of the activities affectionate to the respective units and to exercise other assignments that are committed to them, in their areas of acting, by the Colegiated Directorate.

CHAPTER VII

DOS GOODS AND REVENUE

Art. 30. They constitute the patrimonial acquis of PREVIC the goods and rights of their property, those conferred upon it and those who come to acquire or incorporate.

Art. 31. They constitute recipes from PREVIC:

I-appropriations earmarked in the General Budget of the Union, additional credits, transfers and repasses that are conferred upon you ;

II-resources coming from arrangements, agreements and contracts concluded with entities, bodies and companies, public or private, national or international ;

III-recipes arising from the pickup of the TAFIC ;

IV-product of the collection of resulting fines of the application of penalties arising from supervision or judicial execution ;

V-donations, legacies, grants and others resources that are intended for you ;

VI-values ascertained in the sale or lease of goods, as well as those arising from publications, data and technical information ; and

VII-other possible rents.

CHAPTER VIII

DAS GENERAL PROVISIONS

Art. 32. The organizational and operational standards of the integral bodies of the organizational structure of PREVIC will be established in the internal regiment.

Art. 33. PREVIC will be able to enter into agreements, contracts, arrangements, terms of partnership and adjustment of conduct and similar instruments aiming at the realization of its objectives.

Art. 34. The missing cases and the doubts raised in the application of this Regimental Structure will be directed by the Colegiated Directorate.
