DECREE NO 4,162, DE March 12, 2002

Provides on the implementation of the Fifteenth Additional Protocol to the Economic Supplementation Agreement No. 36, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of the Uruguay, (MERCOSUR), and the Government of the Republic of Bolivia of December 31, 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution,

Considering that the 1980 Treaty of Montevideo, which created the Latin American Integration Association (ALADI), firmed by Brazil on August 12, 1980 and approved by the National Congress, by means of of Legislative Decree no 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement ;

Considering that the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to the MERCOSUR, and the Government of the Republic of Bolivia, firmed in 17 of December 1996, in Fortaleza, the Economic Supplementation Agreement No. 36, to the ampairing of the 1980 Treaty of Montevideo, which has, among others, the goal of reforming an area of free trade between the signatory countries ;

Considering that the Economic Supplementation Agreement No. 36 has been incorporated into the Brazilian legal order by Decree No. 2,240 of May 28, 1997 ;

Considering that the Plenipotentiaries of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay (MERCOSUR), on the one hand, and of the Republic of Bolivia, of another, firmed in 31 of December 2001, in Montevideo, the Fifteenth Additional Protocol to the Economic Supplementation Agreement No. 36, which is aimed at extending until December 31, 2005 the special treatment conferred by ACE-36 to the products incorporating in their manufacturing inputs temporarily imported, or under drawback arrangements ;

D E C R E T A:

Art. 1º The Fifteenth Additional Protocol to the Economic Supplementation Agreement no 36 of December 31, 2001, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to the MERCOSUR, and the Government of the Republic of Bolivia, apse by copy to this Decree, shall be executed and complied with as entirely as it contains.

Art. 2º This Decree goes into effect on the date of its publication.

THE REPUBLIC OF BOLIVIA

Fifteenth Additional Protocol

The Plenipotentiaries of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, in its condition of States Parties to the Common Market of the South (MERCOSUR), on the one hand, and the Republic of Bolivia, on the other hand, accredited by their respective Governments under powers that have been bestowed in good and due form, deposited expeditiously in the General Secretariat of the Latin American Integration Association (ALADI),

VIEW A Resolution MCS-BO No. 01/01 of the ACE Administrator Commission 36.

CONVEEM IN:

Single Article.-Modifying Article 19 of the Economic Supplementation Agreement No. 36, which will be worded as follows:

"Products incorporating in their imported inputs temporarily imported, or under draw-back arrangements, will not benefit from the Liberalization Program set out in this Agreement, from 1º January 2006."

The General Secretariat of ALADI shall be depositary of this Protocol, of which it shall send duly authenticated copies to the signatory Governments.

IN FÉ DO THAT, the respective Plenipotentiaries sign this Protocol in the city of Montevideo, at the thirty-one days of the month of December two thousand and one, in an original in the Portuguese and Spanish languages, both of which are texts equally valid. (a)
