DECREE of 1st JUNE 2011 Grants to Caldas Novas Broadcast S.A. concession for the exploitation of public service electric power transmission on the Substation Corumbá, 345/138 kV, in the State of Goiás.
The President of the REPUBLIC, in the use of the role that gives the art. 84, section IV, of the Constitution, in view of the provisions of the laws on 8,987, of 13 February 1995, 9,074, of 7 July 1995, and 9,648, of 27 May 1998, and in the processes in 48500.005018/2010-73 and 48500.001390/2011-91, DECREES: Art. 1 Is granted to Caldas Novas Transmissão concession to exploit the public service electric power transmission through construction, operation, maintenance and other associated facilities needed for measurement functions, supervision, protection, command, control, telecommunications, administration and support of the enterprise Substation Corumbá, 345/138 kV, in the State of Goiás.
Art. 2 the grant of this Decree shall remain in force for a period of thirty years from the date of signature of the contract for granting Public Service Electric power transmission.
§ 1 the contract must be signed within 30 days counted from the convened by the National Electric Energy Agency-ANEEL, under penalty of ineffectiveness of the concession now given.
§ 2 on request of Caldas Novas Transmissão to ANEEL, presented until 36 months before the end of the term appearing in the caput, the grant may be extended under the conditions that are laid down.
Art. 3 the goods and existing installations according to the electric power service are linked to public services granted, sealed the sale, assignment, transfer or restitution under warranty without prior and express authorization from ANEEL.
Sole paragraph. After the term of the concession, the assets and facilities linked to the provision of public service electric power transmission granted shall revert to the Union, as provided for in the law and the concession contract.
Art. 4 this Decree shall enter into force on the date of your publication.
