Decree No. 3774, of 15 MARCH 2001 Approving the Regimental Structure and the framework Statement of Positions and Functions functions of the Ministry of health, and other matters.
The PRESIDENT of the REPUBLIC, in the use of the powers conferred. 84, subparagraphs IV and VI, of the Constitution, D and C R E T a: Art. first Get approved Regimental structure and the framework Statement of Positions and Functions functions of the Ministry of health, in the form of annexes I and II to this Decree.
Art. 2 as a result of the article above, are redeployed, in the form set out in annex III to this Decree, the following positions in the Group's Commission-direction and Advice-of and functions Functions-FG: I-Management Secretariat, the Ministry of planning, budget and management, from the extinction of the Federal Public Administration bodies, to the Ministry of health, four of 101.5; one of 101.3; Sixteen of 101.2; one of the 102.5; six of the 102.2; Twenty-three FG-1; and a FG-2; and (II)-the Ministry of health to the Department of management, the Ministry of planning, budget and management, two of 101.4; 36 of 101.1; three of 102.4; one of the 102.3; three of 102.1; and eleven FG-3.
Art. 3 The apostilamentos arising from the adoption of the Regimental Structure of the art. 1 shall occur within 20 days, counted of the date of publication of this Decree.
Sole paragraph. After the apostilamentos referred to in the caput of this article, the Minister of State of health will publish, in the Official Gazette, within thirty days, counted of the date of publication of this Decree, a nominal relationship of holders of positions in the Group's Commission-direction and Advice-of, referred to in annex II, indicating even the number of vacant positions , your name and their level.
Art. 4 The internal regulations of the agencies of the Ministry of health will be approved by the Minister and published in the Official Gazette, within 90 days, counted of the date of publication of this Decree.
Art. 5 this Decree shall enter into force on the date of its publication.
Art. 6 Is repealed Decree No. 3496, June 1, 2000.

FERNANDO HENRIQUE CARDOSO José Serra Martus Tavares annex I REGIMENTAL STRUCTURE of the MINISTRY OF HEALTH, chapter I of the NATURE and JURISDICTION Art. 1 the Ministry of health, organ of the direct administration, its area of competence the following subjects: (I)-national health policy;
II. coordination and monitoring of the Sistema Único de Saúde-SUS;
III-environmental health and actions for the promotion, protection and recovery of individual and collective health, including that of workers and of the Indians;
IV-health information;
V-critical inputs for health;
VI-preventive action in General, health surveillance and control of borders and seaports, inland waterways and air;
VII-health surveillance, especially drugs, medicines and food; and VIII-scientific research and technology in the area of health.
CHAPTER II ORGANIZATIONAL STRUCTURE Art. 2 the Ministry of health has the following organizational structure: I-direct and immediate assistance agencies when Minister of State: a) Office;
b) Executive Secretariat: 1. Secretariat for Administrative Affairs;
2. Department of planning and budget;
3. Department of computer science of the SUS-DATASUS;
4. Executive Board of the National Health Fund;
5. Decentralised Units: State Nuclei; and 6. Department of Health Strategic Programs;
c) National Audit Department of SUS; and (d)) legal advice;
II-specific natural organs: a) secretariat of health care: 1. Department of systems and Social Networks;
2. Department of Decentralisation of the management of the assistance;
3. Department of Control and evaluation systems; and 4. The National Cancer Institute;
b) Secretary of Health policies: 1. Department of basic attention;
2. Department of Strategic Programmatic Actions; and 3. Department of Science and technology in health;
c) secretariat of health care management: 1. Board of projects; and 2. Board of investments in health;
III-collegial body: National Health Council;
IV-linked entities: the local authority: 1). The national health surveillance agency; and 2. National supplementary health agency;
b) Public Foundations: 1. National Health Foundation; and 2. Oswaldo Cruz Foundation;
c) mixed Societies: 1. Hospital Nossa Senhora da Conceição S.A.;
2. Hospital Fêmina S.A.; and 3. Cristo Redentor Hospital S.A.
CHAPTER III the JURISDICTION of section I of the Direct and immediate Assistance to the Minister of State Art. 3 the Office of the Prime Minister shall: I-watch the Minister of State in its political and social representation, deal with public relations, the ceremonial and the preparation and dispatch of your mail room personnel;

Art. 4 the Executive Secretariat shall: I-watch the Minister of State in supervising and coordinating the activities of the secretariats of the structure of the Ministry and related agencies;
II-supervise and coordinate the activities related to the federal systems of planning and budget, organization and administrative modernization, accounting, financial management, information resources management and Informatics, human resources and general services within the Ministry;
III-supervise and coordinate activities related to internal management systems and information systems relating to activities related to the health system;
IV-supervise and coordinate the activities of the National Health Fund;
V-assist the Minister of State in the definition of and guidelines on the implementation of actions in the area of competence of the Ministry; and I advise the organs of the Ministry in formulating strategies for cooperation with international financial institutions.
Sole paragraph. The Executive Secretariat shall exercise the role of sectoral body of civilian personnel systems of the Federal Administration-SIPEC, organisational and administrative modernization-SOMAD, administration of the information resources and Informatics-SISP, General Services-SISG, and Federal budget planning, Financial Administration and Federal accounting, through the Subsecretarias of Administrative Affairs and planning and budget her subordinate.
Art. 5 the Secretariat for Administrative Affairs shall: I-plan, coordinate and monitor the implementation of activities related to the Federal Systems of organization and administrative modernization, Human resources and general services within the Ministry;
II. promote liaison with the central agencies of the federal systems, referred to in the previous paragraph, and inform and guide the agencies of the Ministry regarding the compliance with administrative rules established;
III-to manage contracts and bidding processes for contracting and procurement of goods and services;
IV-to plan, coordinate and supervise the execution of documentation, information, archive and library, within the Ministry; and V-promoting the development and consolidation of plans and programs of activities of your area of expertise and submit it to top decision.
Art. 6. The Secretariat for planning and Budget shall: I-plan, coordinate and monitor the implementation of activities related to the Federal Systems of planning, budgeting, Accounting and financial management within the Ministry;
II-promoting the articulation with the central organ of the federal system, referred to in the previous paragraph, and inform and guide the agencies of the Ministry regarding the compliance with the established rules;
III-to coordinate the preparation and consolidation of plans and programs of the Ministry related activities and submit them to the decision; and IV-monitor and promote the assessment of projects and activities.
Art. 7 The Department of Informatics of the SUS-DATASUS competes: I-promote, regulate and assess the actions of computerization of SUS, directed to the maintenance and development of the health information system and the internal systems of management of the Ministry;
II-developing, researching and incorporate computer technologies that allow the implementation of systems and the dissemination of information needed for health actions;
III-set standards, guidelines, standards and procedures for transfer of information and contracting of goods and services within the agencies and entities of the Ministry;

IV-set standards for the collection and transfer of information on health, aiming at the integration of databases and operating systems developed and deployed within the SUS;
V-maintain the acquis of the databases necessary for the health information system and the internal systems of institutional management;
VI-to ensure the managers of SUS and similar bodies access to it services and data bases maintained by the Ministry;
VII-set technical cooperation programmes with research and teaching exploration and transfer of technology and information methodologies and health informatics;
VIII-supporting States, Municipalities and the Federal District, on computerization of activities of the SUS; and IX-coordinate the implementation of the national health information system, in accordance with the legislation in force.
Art. 8 the Board of Executive Directors of the National Health Fund shall: (I)-to plan, coordinate and control the budget, financial and accounting activities of the National Health Fund, including those performed by decentralized units;
II-promoting technical cooperation activities in the budget and financial areas to support the formulation and implementation of health policies;
III-to establish standards and criteria for the management of sources of revenues and the implementation of the budget and financial resources;
IV-to plan, coordinate and supervise the activities of funding of programs and projects;
V-to monitor and evaluate the implementation of programmes and projects funded with resources from the National Health Fund;
VI-to plan, coordinate and supervise the activities of covenants, agreements, and similar adjustments under the responsibility of the Ministry of health, as well as promote the monitoring of the implementation of resources transferred to SUS (national health system); and VII-to plan, coordinate and supervise the activities of accountability and making special accounts of the resources allocated to the National Fund SUS health.
Art. 9 to the State, through their organizational units, develop technical activities-administrative and logistical support, as well as practice the other acts necessary for the performance of the agencies of the Ministry of health.
Art. 10. The Department of Health Strategic Programs shall: I-to formulate and propose guidelines for the areas and strategic issues with a view to implementing the National Health Policy;
II-to coordinate the preparation and implementation of programmes and projects in areas and issues of national scope;
III-to coordinate the acquisition and distribution of strategic inputs for health;
IV-propose arrangements and agreements with the States, Federal District and municipalities for the decentralised execution of programs and special projects within the SUS;
V-Guide, empower and promote actions of technical support to agents, with a view to the sustainability of programmes and projects in its area of operation; and I saw him set goals, monitor and evaluate the performance of programs and projects.
Art. 11. The National Audit Department of SUS competes: I-audit the regularity of scientific-technical, accounting procedures, and financial assets by individuals and legal entities under the SUS;
II. check the suitability, the resolution and the quality of the procedures and health services available to the population;
III. establish guidelines, standards and procedures for the systematization and standardization of audit actions under the SUS;
IV-to promote the development, the interaction and integration of actions and audit procedures between the three levels of SUS management;
V-promote, in their area of expertise, technical cooperation with organs and federal, State and municipal entities, with a view to integration of the actions of the agencies that make up the national audit System-SNA with members of the internal control systems, external and social;
I saw an opinion conclusive and management reports to: a) instruct the National Fund reimbursement processes of health of values established in the audit actions; and (b)) inform the higher authority on the results obtained through the audit activities undertaken by members of the SNA; and VII-Guide, coordinate and supervise technically and administratively, the execution of the audit activities conducted by the organizational units of State Audit.
Art. 12. The legal counsel shall: (I)-assist the Secretary of State on matters of legal nature;
II-exercise the coordination of legal activities of the Ministry and of the linked entities;
III-set interpretation of the Constitution, treaties and laws, other normative acts to be uniformly followed in their area of expertise and coordination, when there is no normative guidance of the Attorney-General's Office;
IV-prepare studies and prepare information for request of the Minister of State;
V-watch the Minister of State in the internal control of the legality of administrative acts to be performed by him or already in place, and those from agencies or entities under its legal coordination; and VI-examine, and conclusively, under the Ministry: a) the texts of notice with invitation to bid, as well as of their contracts or similar instruments to be published and concluded; and (b)) the acts for which go to recognize the enforceability or decide the exemption from bidding.
Sole paragraph. Legal advice carries, the sectorial organ paper of the General Law of the Union.
Section II Specific Natural Bodies Art. 13. The secretariat shall: healthcare I-participate in the formulation and implementation of health care policy, in compliance with the principles and guidelines of SUS;
II-define and coordinate integrated networks systems and health services;
III-set standards, criteria, parameters and methods for quality control and assessment of health care;
IV-supervise and coordinate evaluation activities;
V-identify the reference services for the establishment of technical standards of health care;
VI-to elaborate and propose rules for disciplining relations between the managing authorities of the SUS and the private services contracted health care;
VII-to coordinate, monitor and evaluate, at the national level, the activities of assistance units of the Ministry;
VIII-to provide technical cooperation for the improvement of the managerial and operational capacity of States, Municipalities and the Federal District; and IX-to formulate and propose criteria and standards for the regulation of health care.
Art. 14. The Department of Welfare systems and networks shall: I-prepare, coordinate and evaluate the implementation of specific programmes of national health;
II-to develop tools for monitoring and evaluation and quality management assistance services;
III-create technical and legal instruments for the implementation of assistance management models;
IV-create technical and legal instruments for the management of development assistance networks;
V-draw parameters and management indicators for the health services administration;
VI-coordinate and monitor actions and health services of the hospital units;
VII-regular high-complexity procedures; and VIII-regulate and coordinate the activities of the national system of organ transplants.
Art. 15. The Department of Decentralisation of the management of Assistance shall: I-regulate, promote and coordinate the Organization and development of the decentralization of the management of the assistance, in compliance with the principles and guidelines of SUS;
II-develop monitoring mechanisms of decentralisation of the management of the assistance;
III-monitoring and proposing instruments for managerial and operational organisation of the decentralisation of the management of the assistance; and IV to provide technical cooperation to States, Municipalities and the Federal District in the Organization of the decentralization of the management of assistance.
Art. 16. The Department of Control and evaluation of systems shall: I-monitor and evaluate: a) the provision of assistance services of health, within the SUS, in qualitative and quantitative aspects; and (b)) the transfer of financial resources of the Ministry of health to States, Municipalities and the Federal District;
II-to provide technical cooperation to the SUS managers for the use of data collection instruments and information;
III-to subsidize the development of information systems of the SUS;
IV. conduct studies for the improvement and application of instruments of control and evaluation of health care services;
V-evaluate the actions, methods and instruments implemented by the control and assessment of the States, the municipalities and the Federal District;
VI-to establish standards and set criteria for the systematization and standardization of the techniques and procedures related to the areas of control and evaluation; and VII-define, within its area of expertise, technical cooperation with the States, Municipalities and the Federal District for the improvement of the managerial and operational capacity of healthcare services.
Art. 17. The National Cancer Institute shall: (I)-watch the Minister of State in the formulation of the national policy of prevention, diagnosis and treatment of cancer;

II-plan, organize, execute, manage, control and supervise plans, programs, projects and activities at the national level, related to the prevention, diagnosis and treatment of malignant neoplasms and related disorders;
III-exercise training activities, training and enhancement of human resources, at all levels, in the field of Oncology;
IV-coordinate, schedule and perform clinical, epidemiological and experimental research in Oncology; and V-médico-assistenciais services to patients with malignancies and related disorders.
Art. 18. The secretariat of Health policies shall: I-coordinating the process of formulating health policies, strengthening the deliberative bodies of the SUS (Advice and Health conferences);
II-to promote the development of strategic actions aimed at reorientation of health care model, with the structuring axis the basic attention;
III-to coordinate, together with other agencies of the Ministry, the evaluation process of health policies;
IV. participate in the development, deployment and implementation of standards, tools and methods that strengthen the management capacity of the SUS, the three levels of Government;
V-coordinate the Organization and development of the basic attention actions in health;
VI-to coordinate the management of human resources policy for the SUS;
VII-to coordinate the management of science and technology policy in health; and VIII-provide technical cooperation to States, Municipalities and the Federal District, aiming to enhance the managerial capacity and promote new health practices.
Art. 19. The Department of primary health care shall: I-regulate, promote and coordinate the Organization and development of the basic attention in health, in compliance with the principles and guidelines of SUS;
II-regulate, promote and coordinate the Organization of pharmaceutical assistance, within the framework of the basic attention;
III. develop mechanisms for control and evaluation of the basic attention;
IV-follow and propose instruments for managerial and operational organisation of the basic attention;
V-to provide technical cooperation to States, Municipalities and the Federal District in the Organization of the basic attention actions;
SAW-set guidelines for permanent education of human resources involved in the basic attention.
Art. 20. The Department of Strategic Programmatic Actions shall: (I)-coordinate, so articulate with other agencies of the Ministry of health, the formulation of programmatic content, technical and management standards, methods and tools that reorient the health care model;
II-to promote the development of strategies that allow the Organization of health care, with emphasis on primary health care, in order to facilitate access, equity and the completeness of the actions and services provided;
III-to provide technical cooperation to States, Municipalities and the Federal District in the Organization of strategic programmatic actions;
IV develop mechanisms of control and evaluation of strategic programmatic actions; and V-inducing mechanisms that strengthen the organizational logic of health systems, articulated between the three levels of SUS management;
Art. 21. The Department of Science and technology in health shall: (I)-participate in the process of formulating the policy of Science and technology in health and promote their implementation;
II-set standards and strategies for evaluation and incorporation of health technologies;
III. promote, in conjunction with science and technology institutions and funding agencies, the strategic health research;
IV-producing and disseminating guidelines for research and technological development related to impacts caused by environmental factors on health;
V-promote the diffusion of scientific and technological knowledge in health, with a view to its adoption by institutions and health services;
Saw set strategies of the Ministry of health in the field of biosafety, in conjunction with related bodies;
VII-deploying mechanisms of cooperation for the development of science and technology institutions that act in the area of health;
VIII-promote intersectoral articulation within the National System of science and technology;
IX-to coordinate the activities of the Executive Secretariat of the National Commission on ethics in research, established within the framework of the National Health Council; and X-develop mechanisms of control and evaluation of the incorporation of technologies.
Art. 22. The secretariat of health care management shall: (I)-propose guidelines for investments in health;
II-articulate, with other agencies and entities of the Ministry of health, studies contributing to improved management and streamlining of actions in the area of health;
III-to coordinate the preparation of programmes and investment projects, financed by national and international agencies and entities and aliens;
IV-coordinating actions with the national agencies and entities, foreign and international funders of programs and investment projects in the area of health;
V-manage and monitor the execution of investments in health, financed with resources from national and international agencies and entities and aliens;
VI-structure management information for monitoring the implementation of investments in health; and VII-define and implement operational procedures of implementation of investment facilitators.
Art. 23. The project Board shall: i. identify, together with the other agencies and entities of the Ministry of health, areas likely to improve with the implementation of programs and projects of investment in health;
II-to conduct studies that contribute to the improvement of the management and rationalization of investments in health;
III-to develop and structure, in conjunction with agencies and entities of the Ministry of health, programs and projects of investment in health; and IV-link up with national government agencies and entities, foreign and international to make the financing of investment projects and programmes.
Art. 24. The health care Board shall: I-manage and monitor the implementation of programmes and investment projects in the area of health, in accordance with specific regulations of the Ministry of health;
II-link up with agencies and entities, international and foreign lenders to ensure the execution of investments in health;
III-to support the organs and entities of the Ministry of health responsible for the areas covered by the programmes and investment projects;
IV-preparing management reports on the performance of the implementation of programmes and projects of investment in health;
V-analyze and evaluate experiences of implementation of investments in health.
Section III of the collegial body Art. 25. The National Board of Health shall: I-deliberate on: the formulation of strategy and control) of the implementation of the national health policy framework; and b) criteria for the definition of standards and assistance parameters;
II-manifest about national health policy;
III-decide on: a) State health plans when prompted by their counsel;
b) disagreements raised by State and Municipal Health Councils, as well as by the representative bodies in the area of health; and c) accreditation of healthcare institutions applying to undertake research in humans;
IV-express an opinion on the creation of new courses in the area of health, in conjunction with the Ministry of education;
V-establish guidelines to be observed in the development of health plans depending on the epidemiological characteristics and the Organization of services;
VI-monitor the implementation of the schedule for transfer of financial resources, contained in the SUS, the States, Federal District and Municipalities;
VII – approve the criteria and values for the remuneration of the services and welfare coverage parameters;
VIII-monitor and control the activities of private health institutions, accredited by contract, adjustment or agreement;
IX-follow the process of scientific and technological development and incorporation in the area of health, for the observance of ethical standards compatible with the socio-cultural development of the country; and X-propose the convening and organizing the national health Conference, ordinarily every four years and, extraordinarily, pursuant to law No. 8142, of 28 December 1990.
§ 1 the composition, organization and functioning of the National Board of health will be established in accordance with the provisions of law No. 8142, of 1990, and in Decree No. 99438, of 7 August 1990.
§ 2 the National Health Council has a general coordination to coordination of the activities of the Executive Secretariat and technical and administrative support.
Art. 26. The organs and entities of the Ministry of health is the responsibility of managing the data and information relating to its area of operation, adding them to the National Health Information System, in accordance with the provisions of paragraph "d" item III of art. 16 of law No. 8080, September 19 1990.
CHAPTER IV of the POWERS of the DIRECTORS Section 1 of Executive Secretary Art. 27. The Executive Secretary shall: (I)-to coordinate, consolidate and submit to the Minister of health the global plan of action of the Ministry;
II-oversee and assess the implementation of the projects and activities of the Ministry of health;

III-supervise and coordinate the articulation of the organs of the Ministry of health with the central organs of the affections systems competence of the Executive Secretariat; and IV-perform other duties as assigned by the Minister of State.
Section II of the Secretaries and other Officers. 28. The Secretary shall be responsible for planning, directing, coordinating, directing, monitoring and evaluating the implementation of the activities of the units that integrate their respective secretariats, and exercise other powers they are committed in internal regulations.
Sole paragraph. Still, the Secretary shall be responsible for exercising the powers expressly delegated to them, admitted the sub-delegation of authority directly subordinate.
Art. 29. The Chief Minister's Office, the legal adviser, the Undersecretaries, directors, coordinators and the other leaders is up to plan, direct, coordinate and guide the implementation of the activities of their units and perform other duties that they are committed in its areas of competence.
Chapter V GENERAL and transitional PROVISIONS Art. 30. control activities, evaluation and audit under the Ministry of health are organized in the following way: I-the National Audit Department of the SUS will act on the monitoring of approved application programming of resources transferred to the States, the municipalities, the Federal District and in the verification of the regularity of the procedures practiced by individuals and legal entities, by examination of contents , on-the-spot inspection and expert witnesses; and (II)-the Department of Control and evaluation of systems will act on the implementation of the activities of control and evaluation, through monitoring and continuous monitoring of the actions and services developed within the SUS, without prejudice to the control and evaluation activities relevant to each agency or entity of the Ministry.
Art. 31. The Executive Board of the National Health Fund will adopt procedures for reimbursement to the values established in audit and control actions.
Art. 32. The internal regulations shall define the details of the members of the Regimental Structure, the powers of the respective units and assignments of their leaders.
