DECREE No. 3370, OF 23 2000.
FEBRUARY Approves the Regimental Structure and the Table showing the positions in the Commission and Gratified Functions of the National Institute of Metrology, Standardization and Industrial Quality - INMETRO, and other providences.
THE PRESIDENT OF THE REPUBLIC, using the powers conferred upon him by art. 84, sections IV and VI of the Constitution, Decrees
:
Art. 1 are approved the Regimental Structure and the Table showing the positions in the Commission and Gratified Functions of the National Institute of Metrology, Standardization and Industrial Quality - INMETRO, in the form of Annexes I and II to this Decree.
Art. 2 As a result of the previous article, are relocated the following positions in committee of the Superior Group Directorate and Advisory - DAS and Gratified functions - FG:
I - the Department of Management, the Ministry of Planning, Budget and Management, from extinct Federal Public Administration for the INMETRO, a DAS 101.5 and 102.4 oF; and
II - INMETRO for the Department of Management, the Ministry of Planning, Budget and Management, a DAS 101.4; two FG-1; Thirteen FG-2; FG-3-six.
Art. 3 The apostilamentos resulting from the approval of the regimental structure pursuant to art. 1 shall take place within twenty days from the publication of this Decree date.
Sole paragraph. After apostilamentos provided for in this article, INMETRO shall publish in the Official Gazette within thirty days from this Decree publication date, the nominal list of the holders of positions in Group Directorate of the Commission and Higher advisory - DAS referred to in Annex II, indicating, including the number of vacant positions, its name and its level.
Art. 4. The Internal INMETRO will be approved by the Development State Minister, Industry and Foreign Trade and published in the Official Gazette, within ninety days from the publication of this Decree date.
Art. 5 This Decree shall enter into force on the date of its publication.
Art. 6 are hereby repealed Decree No. 10 of 16 January 1991; Annex L? to Decree No. 1.351, of December 28, 1994; and Annex II to Decree No. 2600 of 19 May 1998.

ANNEX I STRUCTURE OF REGIMENTAL METROLOGY NATIONAL INSTITUTE, Standardization and Industrial Quality - INMETRO

Chapter I NATURE AND COMPETENCE
Art. 1. The National Institute of Metrology, Standardization and Industrial Quality INMETRO federal agency created by art. 4 of Law No. 5,966, of December 11, 1973, with headquarters in Brasilia - DF, under the Ministry of Development, Industry and Foreign Trade, is the central executive body of the National System of Metrology, Standardization and Industrial Quality - SINMETRO and aims at:
I - perform the national metrology and quality policies;
II - checking compliance with the technical and legal standards in relation to average units, measurement methods, material measures, measuring instruments and pre-measured products;
III - keep and maintain the standards of measurement units, as well as deploy and maintain the chain of traceability of standards of measurement units in the country, in order to make them harmonious and internally consistent at international level aimed at primary, to their universal acceptance, and secondary to its use as a support to the productive sector, with a view to the quality of goods and services;
IV - strengthen the country's participation in international activities related to metrology and quality, and promote exchanges with entities and foreign and international organizations;
V - provide technical and administrative support to the National Council of Metrology, Standardization and Industrial Quality - CONMETRO, as well as its advisory committees, acting as its Executive Secretariat;
VI - promote the use of quality management techniques in Brazilian companies;
VII - plan and execute the activities of accreditation of calibration and testing laboratory, proficiency testing providers, certification bodies, inspection, training, and other necessary for the development of infrastructure services technology in the country;
and VIII - to coordinate, within the SINMETRO, compulsory and voluntary certification of products, processes, services and voluntary personnel certification.


Chapter II ORGANIZATIONAL STRUCTURE
Art. 2 INMETRO has the following organizational structure:
I - direct and immediate assistance agencies to the President:
a) Executive Board;
B) Office;
C) Legal Department; and
d) International Joint Coordination General;
II - Sectional bodies:
a) Planning Department General;
B) Directorate of Administration and Finance; and
c) Auditing;
III - Natural specific organs:
a) Accreditation and Quality Management;
B) Board of Scientific and Industrial Metrology; and
c) Board of Legal Metrology; and
IV - decentralized bodies: Superintendents.
Sole paragraph. The President of INMETRO shall be appointed by the President.

Chapter III POWERS OF BODIES Section
I
Of Direct Assistance Directors and the President Immediate
Art. 3. The Office is responsible for:
I - assist the President in his social and political representation;
II - take charge of the preparation and processing of your personal device;
III - make the monitoring of the conduct of legal acts of interest of the Municipality;
IV - coordinate the activities of media and technical cooperation;
V - arrange for the publication and dissemination of materials of interest INMETRO; and
VI - provide technical and administrative support to the President of INMETRO, the Executive Secretary of the quality of the National Council of Metrology, Standardization and Industrial Quality - CONMETRO.
Art. 4. In the Legal Department, an agency of the Union Attorney General, is responsible for:
I - exercise the judicial and extrajudicial representation of the Municipality, acting in cases where the same is author, re, opponent or assistant;
II - to comply and ensure compliance with the prescriptive guidance from the central and sectoral bodies of the Attorney General's Office;
III - provide direct and immediate assistance to the President and members of the Regimental Structure bodies INMETRO in legal matters, applying, as appropriate, the provisions of art. 11 of Complementary Law No. 73 of February 10, 1993;
IV - to examine, approve and prepare drafts of bidding documents, contracts instruments, agreements and other creative acts of rights and obligations, which should be concluded by the Municipality;
V - analyzing and finding solutions to issues raised by the application of laws and regulations relating to the activities developed by Inmetro;
VI - to examine and advise on projects of normative acts to be issued or offered by the Municipality, when they contain legal matters; and
VII - the calculation of liquidity and certainty of credits of any nature relating to the activities of INMETRO, inscribing them in outstanding debt, for purposes of friendly or judicial collection.
Art. 5 In the General Coordination of International Articulation is responsible for:
I - coordinate, plan, coordinate and promote activities for the International INMETRO relationship;
II - to coordinate, promote and monitor the negotiations for conclusion of agreements, agreements and contracts, as well as participation of INMETRO in international events;
III - supervising and controlling the realization of technical cooperation and exchange programs with international and foreign organizations in the areas of metrology, standardization and industrial quality, including human resource development;
IV - propose, coordinate and monitor, in conjunction with the various areas of INMETRO, the allocation of resources needed to comply with international commitments; and
V - coordinate within the Municipality, international, technical and commercial negotiations involving the areas of metrology, standardization and industrial quality.
Section II
The Organs Sectionals
Art. 6 In the Planning Department General responsible for coordinating, directing, supervising, promote, monitor and evaluate the implementation of planning, budget, information technology, administrative modernization, realization of statistical work and specifically:
I - provide the authority the means necessary to achieve the efficiency, efficacy and effectiveness of their services;
II - to coordinate the strategic planning process and deployment of the mission of the Municipality, in guidelines, objectives, goals and plans;
III - subsidize INMETRO Directors in action planning and implementation of programming;
IV - to monitor and evaluate the performance of INMETRO activities; and

V - coordinate the preparation of the budget of the Municipality.
Art. 7 To the Board of Directors and Finance it is to plan, coordinate, direct, supervise, promote, monitor and evaluate the implementation of actions relating to human resources activities, material, property, surveillance, transport, finance, accounting, engineering, maintenance, procurement and implement the adoption of procedures, aiming to streamline and improve the quality of services it provides.
Art. 8 To Audit is responsible for checking compliance with current regulations, procedures of budgetary nature, accounting, financial, patrimonial and human resources, and when determined by the President, the verification of compatibility between the means employed and the results achieved and, specifically:
I - create necessary conditions to ensure effectiveness in the internal and external controls, seeking to ensure regularity in the realization of revenue and expenditure;
II - examine the specific standards and related legislation, advising as to its compliance;
III - carry out regular inspections in the areas of INMETRO action to verify the physical and financial execution of projects and activities, including those performed by third parties;
IV - carry out financial, accounting and administrative audits for the purpose of evaluating and certifying the accuracy and regularity of the accounts and prove the efficiency and effectiveness in the implementation of the Local Authority's resources; and
V - perform extraordinary audits, specific nature, that in the interests of management, may be determined by the President.

Section III Of Target Organ Singular
Art. 9 At the Accreditation and Quality Board is liable to plan, manage, guide, coordinate and implement the activities of accreditation and conformity assessment, and specifically:
I - act as accrediting agency certification bodies, inspection and training, and calibration laboratories and testing and proficiency testing providers;
II - coordinate within the SINMETRO, certification of conformity, the declaration of conformity by the supplier, inspection and other forms of compulsory evaluation of products, services and personnel;
III - encourage the development of national standards and voluntary certification of products, processes, services and personnel;
IV - prepare technical regulations in the area of ​​quality;
V - coordinate the international recognition of actions related to accreditation activities;
VI - promote actions to monitor the conformity of products, processes and services to the standards and relevant technical regulations; and
VII - guide and enlighten consumers on quality issues.
Art. 10. In the Scientific and Industrial Metrology Board is liable to plan, direct, coordinate and supervise the execution of activities within the basic metrology and specifically:
I - perform, reproduce, maintain, store and track national standards of units measure;
II - reference, directly or indirectly, the national to international standards;
III - disseminate the units of the International System of Units - SI, its multiples and submultiples through appropriate metrological methodologies;
IV - track the patterns of the various country's laboratories, verifying their compliance with national standards;
V - develop scientific and technological research related to metrology;
VI - provide metrological nature services, and coordinate and supervise the provision of these services, when performed by other entities;
VII - provide support to the areas of legal metrology, standardization, quality and productivity within the basic metrology;
VIII - participate in the implementation of agreements and agreements between Brazil and other countries in the framework of basic metrology;
IX - to coordinate international recognition of actions related to the standardization of SI units; and
X - disseminate knowledge of the metrological science to society.
Art. 11. In the Board of Legal Metrology fit guide, plan, direct, coordinate, monitor and promote the implementation of activities in the framework of legal metrology, technical regulations propose projects and specifically:
I - interact together with the Board Scientific and Industrial Metrology, in the International Weights and measures Bureau jobs - BIPM and other notorious prominent entities in the metrological context and participate in the work of the International Organization of legal Metrology - OIML;

II - specify the requirements that the models of material measures and measuring instruments shall meet, examining them, defining them and approving them;
III - specify the requirements to which the pre-measured products must comply;
IV - propose training programs and improvement of human resources in legal metrology;
V - to approve the schedule of activities to be undertaken by implementing agencies operating metrology activities; and
VI - establish equipment specifications, standards and facilities to be used by the implementing agencies operating metrology activities.

Section IV Of Decentralized Organs
Art. 12. At Superintendencies fit to perform the activities of INMETRO assigned to it in accordance with the rules, criteria and procedures, reporting to the President and, specifically:
I - supervise the activities carried out by accredited bodies; and
II - support the development of metrology, standardization, conformity assessment and technical information in accordance with the guidelines downloaded by the President of the Municipality.

Chapter IV DUTIES OF OFFICERS Section I


The President Art. 13. The Chairman of the INMETRO shall:
I - manage the INMETRO and perform all acts of operational management, budgetary and financial authorizing expenditure and ordering the payments;
II - represent the INMETRO in and out of court;
III - supervise and coordinate the activities of members of the Regimental Structure bodies INMETRO;
IV - accountable for its management to the Court of Auditors of the Union;
V - regulatory matters pertaining to the powers and activities of the Municipality;
VI - to appoint holders of permanent posts;
VII - name holders and appoint office holders substitutes in committee and reliable functions, subject to ministerial delegation and their level of competence;
VIII - call back for decision or review matters relating to the members of the Regimental Structure bodies of the Municipality, without prejudice to the continuity of the powers contained therein;
IX - firm, as legal representative of INMETRO, contracts, agreements, agreements, settlements and other similar acts negotiation, may delegate this assignment; and
X - delegate any of its powers, except those which by their very nature or by legal prohibition, can only be implemented by him privately.

Section II The Executive Director
Art. 14. The Chief Executive of INMETRO shall:
I - replace the President of the Municipality in its impediments and legal and regulatory clearances;
II - coordinate the Quality System INMETRO;
III - coordinate, plan, direct, promote and implement the information technology activities; and
IV - perform other duties as assigned by the President of the Municipality.
Section III

Art. 15. The Executive Officers, the Attorney General, the Auditor-Chief, the Chief of Staff, the General-Coordinators and the other INMETRO leaders shall:
I - plan, direct and coordinate the implementation of their respective activities afetas organizational units; and
II - perform other activities assigned as the President.

Chapter V GENERAL PROVISIONS AND TEMPORARY
Art. 16. INMETRO must observe the technical guidelines issued by the Central Organ Systems of the Federal Administration.
