DECREE OF January 22, 2008.

Declaration of public utility, for the purposes of misappropriation, by the National Department of Works Against Secas-DNOCS, the area of land it mentions.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the willing in the arts. 5th, letters?e? e?p?, of the Decree-Law No 3,365 of June 21, 1941, and 28 of the Act No 6,662 of June 25, 1979,

DECRETA:

Art. 1st It is declared of public utility, for the purposes of dispropriation, by the Department National Works Against Secas-DNOCS, area of land and respective benefits, titled to various private individuals, with approximately 22,634.3080 ha, situated in the Municipalities of Marco, Bela Cruz and Acaraú, all in the State of Ceará, initial object of the Decree No 97,144 of November 29, 1988, according to the constant plant of the Administrative Process at 59400.004561 /2007-01, thus described: the polygon has its start at the zero point of coordinates (UTM) N 9,653,000m and E 379,490m (Meridian Central 39º), located on the right bank of the EC Highway-161, at a distance of 1,520 ,00m south of the RN-27 milestone of AEROPHOTO CRUISE S.A., landlocked on the right bank of the same CE-161 Highway with the CE-118 Route ; from point zero takes the azimute of 270º30'00 "and follows at a distance of 2,645 ,02m until you find point 1 ; in this one, it is an external angle of 269º47' 00" and follows at a distance of 880 ,00m until you find the point 2 ; in this one, it is an external angle of 269º28' 28 " and follows at a distance from 545 ,02m until it finds section 3 ; in this one, it is an external angle of 91º13'59 "and follows at a distance of 405 ,03m until you find point 4 ; Single Paragraph. They are excluded from the dispossession that it treats the caput the areas of land and benfection already acquired by the DNOCS as a result of the provisions of the Decree No 97,144 of November 29 de1988.

Art. 2nd DNOCS will promote, with resources from the Growth-PAC Acceleration Program, allocated in their budget, the misappropriation that it treats this Decree, and may, for the purpose of immission in possession, aller the urgency to which the art refers. 15 of Decree-Law No 3,365 of June 21, 1941, combined with the Act No 6,662 of June 25, 1979.

Art. 3rd This Decree goes into effect on the date of its publication.
