Law 10612? Of 23 DECEMBER 2002 adopts provisions concerning the granting of economic subsidy to the acquisition of motor vehicles that run on hydrated ethanol fuel and other matters.
The PRESIDENT of the REPUBLIC do I know that the National Congress decrees and I sanction the following law: Art. 1st is authorized the granting of economic subsidy to the acquisition of motor vehicles that run on hydrated ethanol fuel, with the purpose of promoting the reduction of emission of greenhouse gases resulting from the combustion of gasoline, by increasing the involvement of alcohol in national fleet vehicles Art. 2 the grant of this Law will have duration of up to three years, counted from January 1, 2003, or until the addition of 100,000 new vehicles powered by alcohol.
§ 1 shall be of R$ 1000.00 (1000 reais) the unit value of the subsidy for the purchase of the new vehicle the alcohol, granted in the form of rebate on the sale price of the goods at the time of acquisition.
§ 2 will have access to grant legal entities governed by private law who acquire vehicles that run on hydrated ethanol new fuel for use in transport of goods and passengers, or to lease, and the organs and entities of the Federal Public Administration, States, Federal District and municipalities, met the requirements laid down in regulation.
(3) non-compliance with the requirements of paragraph 2 will result in the return of the subsidy received in the form of regulation.
Art. 3 the grant of this law will be funded with resources from the National Treasury and resources received from abroad, including donations from financial compensation for reducing emissions under the Kyoto Protocol to the United Nations Framework Convention on climate change, approved by Legislative Decree No. 144, 20 June 2002.
(1) The National Treasury, resources in the amount of R$ 25,000,000.00 (twenty-five million dollars), will be allocated in the budget proposal for the year 2003, in the form of specific allocation to the Ministry of development, industry and foreign trade.
(2) in the course of the financial year of 2003, the appropriation provided for in paragraph 1 may be supplemented where available external resources mentioned in the caput of this article.
§ 3 in the exercises after 2003, the granting of economic subsidy is conditional upon entry of external resources or the existence of budgetary resources for this purpose.
Art. Fourth Is the Executive authority authorized to: I-establish procedures for approval of actions contemplated in art. 1st and projects provided for in (a)? the paragraph 5 of article 12. Clean development mechanism? of the Kyoto Protocol;
II-prepare budget proposal for use of financial resources from abroad under the program of climate change;
III-monitor application of resources for economic subsidy contemplated in this Act;
IV-prepare budget proposal for the application of the subsidy now established; and V-fix criteria and priorities for granting the subsidy.
Art. 5 the Executive power will regulate the provisions of this Law, within 60 days of its publication, including setting priorities and mechanisms to be used in the granting of the subsidy, as well as to request the certification of emission reductions by the competent international bodies of the Kyoto Protocol.
Art. 6. This law shall enter into force on the date of its publication.
