Declaration of public utility, for the purposes of impropriation, total or partial, or of institution of administrative servitude of passage, in favor of Brazilian Petroleum S.A. -PETROBRAS, the real estate you mention, situated in the State of Rio de Janeiro, needed to continue the project of deploying the Petrochemical Complex of Rio de Janeiro-COMPERJ, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers you the art. 84, inciso IV, of the Constitution, in view of the provisions of art. 5^o, points?i? e?p?, from Decree-Law n^o 3,365, June 21, 1941, in Decree-Law n^o 1,075 of January 22, 1970, and what is stated in the MME Process n^o 48000.000483 /2010-59,

DECRETA:

Art. 1^o Ficam declared of public utility, for the purposes of dispropriation, total or partial, or of institution of administrative servitude of passage, in favor of Brazilian Petroleum S.A. -PETROBRAS, or of company by it controlled, directly or indirectly, real estate constituted of land and benfection, of particular property, excluded public domain goods, understood in land area of approximately nine million, novice and twenty-three thousand, five hundred and twenty-eight square meters, situated in the Municipality of Itaboraí, State of Rio de Janeiro, necessary for the construction of paved access of the Petrochemical Complex of Rio de Janeiro-COMPERJ à Rodovia BR-493 and enabling the installation prediction of other logistic interconnections in the aforementioned stretch such as: railway, chemical tubulations, electrical installations, fertilizers, telecommunications structures and other facilities necessary to allow for its construction, perfect functioning, and safe transport of chemicals, also ensuring the safety of populations.

§ 1^o The area required for the deployment of operation and logistics support structures of the COMPERJ is located in full in the Municipality of Itaboraí, extends from the intersection with the domain strip of the Federal Rodovia BR-493, felt Itaboraí-Magé, in the Itambi District, between the left bank of the Caceribu River and the domain strip of the Municipal Road IB-44, up to the COMPERJ area, in the Port District of the Boxes, passing through the Viscount District of Itaboraí, as per Drawing DE-6000.67-8100-112-PHN-001.

§ 2^o The area of which treats the caput of this article is described from points in the left bank of the Caceribu River, points in the IB-44 Municipal Road domain range, in the domain range of the Rodovia BR-493 and other notable points, all identified by their coordinates in the Universal Transverse System of Mercator-UTM, Datum Horizontal SAD-69, which thus describes itself and characterizes: The Point P1 is located in the domain range of the BR-493 Highway in the Manilha-Magé sense, near the banks of the Caceribu River, with coordinates N=7.486.813, 2242 and E=710.294.7884 ; of this point, follows with general east bearing, on an extension of 81 ,4026m, up to Point P2, of coordinates N=7.486.813, 2242 and E=710.376, 3954 ; from this point, it follows with general northeast heading, in an extension of 1,273 ,1970m, up to Point P3, at the mouth of the Tambutaí River, from coordinates N=7.487.546,0047 and E=711.330, 7377 ; from this point, it follows with a general northwest heading, on an extension of 2,155 ,9310m, at the intersection with Via Férrea, up to Point P4, of coordinates N=7.488.972, 6062 and E=712.125, 9478 ; Art. 2^o The Petroleum Brazilian S.A. -PETROBRAS, or company by it controlled, directly or indirectly, is authorized to promote, with own resources, amicable or judicially, the dispossession, total or partial, or the institution of administrative servings of passage, in case of that will be compensated, when cabin, the values already compensated in the perpetual servings of passage instituted in favor of PETROBRAS over the area of land of which it treats this Decree, and may, including, invoke the urgency character for the purposes of provisional immission in possession of the goods, pursuant to art 15, of Decree-Law n^o 3,365, June 21, 1941., and of Decree-Law n^o 1,075, of January 22, 1970.

Art. 3^o This Decree goes into effect on the date of its publication.
