Decree No. 8423, of 30 MARCH 2015 Regulates the criteria to functional progression and career promotion specialist in Environment, in law No. 10410, of 11 January 2002, and the special plan of offices of the Ministry of the environment and of the Brazilian Institute of environment and renewable natural resources-IBAMA-PECMA , which deals with law No. 11357, of 19 October 2006.
The President of the REPUBLIC, in the use of the role that gives the art. 84, heading, paragraph IV, of the Constitution, and in view of the provisions of art. 14 the art. 18-A of law No. 10410, of 11 January 2002, and in § 10, art. 16 of law No. 11357, of 19 October 2006, DECREES: Art. 1 this Decree regulates the criteria to functional progression and career promotion specialist in Environment, in law No. 10410, of 11 January 2002, and the special plan of offices of the Ministry of the environment and of the Brazilian Institute of environment and renewable natural resources-IBAMA-PECMA, which deals with law No. 11357 October 19, 2006.
Art. 2 the development of occupants of offices of servers providing effective career Expert in Environment and PECMA will occur through functional progression and promotion. Art. 3 for the purposes of this Decree: I-functional progression – the pass from the server to the next higher maturity pattern within the same class; and II-promotion-the passage of the last pattern of a class to the first standard of the next higher class.
Art. 4 the development of the career of Server Environment and specialist in PECMA will notice the following requirements: (I)-for purposes of functional progression: a) line of interstitial a year of effective exercise in each standard; and (b)) a result equal to or greater than 70% the ceiling score on individual performance evaluations, in the interstitial considered for progression; and II-for purposes of promotion: a) line of interstitial a year of effective exercise in the last pattern of each class;
b) result equal to or greater than 80% the ceiling score on individual performance evaluations, in the interstitial considered for promotion;
c) participation in training events with content and minimum hours set out in the form of the annex; and (d)) for the servers of PECMA, the existence of a vacancy in the next higher class.
§ 1-the individual performance assessment applied for perception of Performance bonus Environmental Expert activity-GDAEM will be used for the purposes of performance evaluation to functional progression and promotion of career Specialist members servers in the environment.
§ 2 the individual performance assessment applied for perception of Performance bonus of Executive technical Activity and the Environment-GTEMA will be used for the purposes of performance evaluation to functional progression and promotion of members of PECMA servers.
(3) to the server, a member of the career of specialist in Environment, occupant of Office of special nature or in group-Commission direction and Advice-DASníveis 4, 5, or 6 or equivalent applies to functional progression and promotion purposes, only the paragraph "a" of items I and II and in subparagraph "c" of item II of the caput.

Art. 5 the interstitial required for functional progression and promotion provisions of paragraph "a" of items I and II of the caput of the art. 4 will be computed in days and the date of entry into Office of the server in the Office.
§ 1 in case of servers already in Office, the interstitial will notice the last functional progression or promotion granted to the server.
(2) the count of the interstitial for functional progression and promotion shall be suspended in the absences and departures from the server, except the cases considered by law No. 8112 of 11 December 1990, as effective exercise, being taken over the statement from the server return to the activity.
§ 3 In case of removal considered as effective exercise, without prejudice to the remuneration, the server will receive the same score earlier in the performance evaluation to functional progression and promotion purposes, until it is processed its first evaluation after returning.
§ 4 there will be no functional progression or promotion if there have been no previous review, albeit under removal order considered to be of effective exercise.
§ 5 in the case of redistribution of servers between the personnel of the Ministry of the environment, of IBAMA and the Chico Mendes Institute for biodiversity conservation, the server will take for the new organ the interstitial period computed already in the form of the heading.
Art. 6. It is the responsibility of the body or to the server capacity to implement permanent training program, training and development, intended to ensure the professionalization of the holders of the offices of career members expert in Environment and PECMA.
(1) training and qualification will observe the annual training plan contemplated in Decree No. 5707, of 23 February 2006, with the objective of improving the training of staff effective servers and the performance of the activities of each unit.
(2) training and qualification needs of the server whose performance has been considered inadequate will be prioritized in the planning of the annual training plan of the agency or entity of the server.
(3) the exercise of the tasks typical of the positions that make up the career as a specialist in environment and PECMA in towns located in Legal Amazon will ensure their holders priority to the completion of specific training course for purposes of promotion and contests.
Art. 7 For promotion purposes, can be considered courses and training events held in national or foreign institutions, whose contents are compatible with the duties of the position effective or the area of operation of the server.
paragraph 1 May be accepted the accumulation of courses and training events with a minimum duration of 20 class hours to proof of minimum hours set out in the annex.
§ 2 The lato sensu postgraduate courses, master's and doctoral degrees will only be considered if completed successfully and acknowledged by the Ministry of education and, when carried out abroad, must be revalidated by competent national institution, in the form of legislation.
(3) the adequacy of the courses and training events from Office effective assignments or the area of operation of the server, its content and its duration will be object of Special Committee evaluation to be established within each organ or entity, in Act of its maximum leader.
paragraph 4 for the purposes of the provisions of paragraph 3, the Special Committee may be used for granting the Qualification fee contemplated in art. 82 of Decree No. 7922, of 18 February 2013.
§ 5 Each training event can only be computed only once.
Art. 8 the amount of slots the class PECMA will notice the following percentages: I-to 25% of total vacancies in the class;
II-to 35% of total vacancies in Class B;
III-to 20% of the total number of vacancies in the class C; and IV-up to 20% of the total number of vacancies in the Special Class.
(1) the Minister of the environment shall, annually, in the Diário Oficial da União, the amount of slots available for promotion in each class.
§ 2 in the case of the percentages referred to in the caput result in fractional number of slots, should be held until the first rounding subsequent integer, privileging the final grades in descending order.
§ 3 of the Act the State Minister of the environment will have on tiebreakers in the event that the amount of servers that meet the requirements for promotion is greater than the amount of slots available for each class.
Art. 9 shall be disregarded for purposes of promotion, participation in training events of the integral server: I-career specialist in Environment, for a period of two years, from 4 September 2014;
II-the PECMA, until July 1, 2016.
Art. 10. The acts of functional progression and promotion will be published, respectively, in internal bulletin of the agency or entity of the server and in the Diário Oficial da União, yielding financial effects from the first day following the date on which the server completed the requirements.
Art. 11. Act of maximum leader of the agency or entity of the server will have on the procedures specific to functional progression and promotion purposes, and on the systematic training and specific functional qualification for promotion purposes of the occupants of the Office of career specialist in Environment and PECMA.
Art. 12. This Decree shall enter into force on the date of its publication.
Art. 13. Is repealed Decree No. 8158, of 18 December 2013.
