CONSTITUTIONAL PRESIDENT OF THE REPAsBLICA,
FOR HOW much the H. National Convention has sanctioned the following law:
THE H. NATIONAL CONVENTION
ArtA-ass 1A ° .â€ "All act or done in order to produce the increase (a) the price of the products and articles of primary necessity intended for the consumption of the stocks, or to cause their rise in the markets for sale by concealment or hoarding, and, in general, any act or fact that tends to the consequence of illegitimate profits at the cost of the sacrifice of the collective well-being, constitutes a crime of speculation, the authors of which are subject to the penalties provided for in this law.
ArtA-culo 2A ° .â€ "The crime of speculation is a matter of public criticism, the denunciation of which corresponds to every class of people.
ArtA-ass 3A ° .â€ "They are speculators:
l.) â€" " The right price of the subsences and other items of consumption or use that, according to the decrees of the Executive Branch, are considered to be of first necessity including drugs, specific and other substances destined for serve as a medicine.
2) â€ " Those who hide, destroy or use for purposes other than the feeding of the populations, the crops of products that are dueA ± s.
3) â€ "Those who hoard the same products with the purpose of determining their scarcity and the consequent increase in sales prices.
4) â€" Those who trade with this class of products or items of first necessity, counter- the provisions which the administrative or municipal authorities adopt to monitor and control their activities.
5) â€ " Those who trade with items that are not of primary necessity, charge prices that exceed the limits of utility fixed by legal provisions, or hide goods with the purpose of increasing its price.
6) â€ " Those who contract with the State at higher prices than those that govern in the places where they must deliver the consumer goods and those who receive foreign currency in a way that gives them a virtual monopoly of import.
ArtA-arse 4A ° .â€ "It is also considered speculators, to the dueAs of urban houses that without fair grounds raise the rent of the houses, apartments or rooms occupied for housing.
ArtA-ass 5A ° .â€" It is speculation every alteration or mixtification of food products and substances, as well as the adulteration or mixtification of alkalics.
ArtA-culo 6A ° .â€ "They are included in this law, the Mining Companies and Leras that speculate in the service of pulperA-as.
ArtA-arse 7A ° .â€ " The owners, users, depositors or lessees of the same, non-indigenous, are obliged to declare to the respective municipal authorities, the quantities of the products (a) a special book in which sales are recorded; with indications of the persons to whom they have sold such products. As for the indigenous and illiterate producers, they will limit themselves to making sworn declarations before the municipalities. The previous declaration will be made semi-annually, under the penalty of a fine of five hundred to two thousand Bolivians in case of omission or falsehood, chargeable by the urban police by means of the coactive procedure.
ArtA-ass 8A ° .â€ "The speculators In the previous provisions, they will be fined fifty to ten thousand Bolivians, or in their default of one to five years. In case of recidivism it shall be applied jointly. The fine when applied, will be graduated taking into account the importance of the fact and the economic capacity of the culprit. The authorities may also order, according to the circumstances, the confiscation of goods and goods and the definitive closure of the establishment, industry or factory where the speculation is committed.
Employees or public officials who are directly or indirectly involved in the crime of speculation will be subject to the maximum penalty referred to in this article.
ArtA-culo 9A °.â€ " The authors, who are responsible, auxiliators or authors of the crime of speculation and for violations of this law, will be tried verbally and summarily in the maximum of fifteen days for the Intendente de la Police-to Municipal of the place in which the punishable or infringing fact had been committed, with recourse of appeal to the Municipal Mayor, prior to the deposit of the sum imposed as a sanction; and the one of nullity before the respective Superior Court of the District, according to the procedure.
ArtA-ass 10A ° .â€ "Out of resources In this law, no other is ordinary or extraordinary, nor the demand for recusal, may suspend the summary procedure of the causes, nor the coercive execution of the resolutions that the competent authorities dictate.
ArtA-ass 11A ° â€ "The Executive Branch, when issuing the corresponding regulation, will set the percentage of utility lA-quote to which the merchants, industrialists and owners of the urban and urban fundos are entitled.
ArtA-ass 12A ° .â€ " The requirements contrary to those of this law are expressly repealed.
