CONSTITUTIONAL PRESIDENT OF THE PLURINATIONAL STATE OF BOLIVIA

For the Legislative Assembly Plurinational, has sanctioned the following Law:

THE PLURINATIONAL LEGISLATIVE ASSEMBLY,

DECRETA:

LAW OF THE GENERAL PERSONAL IDENTIFICATION SERVICE

AND OF THE GENERAL SERVICE OF LICENSES TO DRIVE

TITLE I

FIRST CHAPTER

GENERAL CHOICE

Article 1. (OBJECT). This Law aims at the creation of the General Staff Identification Service

and the General Licensing Service for Driving, determining its legal nature, principles, attributions and structure organizational.

CHAPTER SECOND

PERSONAL IDENTIFICATION SERVICE? SEGIP

Article 2. (CREATION AND LEGAL NATURE).

I. The General Personal Identification Service is created? SEGIP, as a decentralized public institution, with

legal personality and its own patrimony, with administrative, financial, legal, technical and operational capacity, under the Ministry of Government, with jurisdiction and competence in all the territory of the Plurinational State of Bolivia.

II. The General Personal Identification Service? SEGIP, is the only public entity entitled to grant the

Identity? C.I., within and outside the national territory, create, manage, control, maintain and protect the Single Identification Record? RUI, natural persons to the effect of their identification and exercise of their rights, within the framework of this Law and the Political Constitution of the State.

Article 3. (DOMICILE).

I. The legal address of the General Personal Identification Service? SEGIP, will be the city of La Paz, owing

to establish offices in all the departments of the Plurinational State of Bolivia, in order to fulfill the assigned functions.

II. The General Service of Personal Identification? SEGIP, will be able in coordination with the diplomatic delegations to open

offices abroad.

Article 4. (ENTITY PRINCIPLES). The General Personal Identification Service? SEGIP, will hold

its action to the following principles:

Universality. Access to the Identity Cedula? C.I., it is undeniable and egalitarian for all Bolivians and Bolivians, as well as the foreigners based in Bolivia.

Confidentiality. It is the respect and rigorous protection of the administration and control of the information provided by Bolivians and Bolivians, and foreign nationals based in Bolivia.

Oneness. The Identity Cedula? C.I., it is non-transferable and one of the only allocation for each Bolivian and Bolivian.

Security. The inviolability of the identity of Bolivians and Bolivians is guaranteed through appropriate, timely and reliable mechanisms.

Article 5. (ATTRIBUTIONS). The General Personal Identification Service? SEGIP, has the following

attributions:

Establish procedures for handling, administering, and recording identification data for Bolivians, Bolivians, and Foreigners based in Bolivia.

Set in coordination with the Civic Registry Service? SERECI, a system of biometric registration of natural persons that guarantees the reliability and authenticity of the data recorded permanently.

Regular use, update, administration and storage of the Registry Unique of Identification? RUI.

Implement mechanisms and/or procedures that ensure the privacy, confidentiality, and security of the recorded data.

Register the information needed to grant the Identity Cedula? C.I., Bolivians, Bolivians and naturalized foreigners, complying with international technical parameters.

Register the information needed to grant the Foreign Identity Cedula? CIE, for foreigners with legal residency in Bolivia, in coordination with the Directorate General of Migration, complying with international technical parameters.

Rectifying, changing or supplementing the data established in the Single Register of Identification? RUI.

Promote, manage, and subscribe Conventions with institutions and entities for the fulfillment of their attributions.

Maintain and administer the Single Identification Record? RUI, under current technology parameters.

Develop the mechanisms for the home registration of people throughout the territory of the Plurinational State of Bolivia.

Other established by Supreme Regulatory Decree.

Article 6. (ORGANICA STRUCTURE). The organic structure of the General Identification Service

Personnel? SEGIP, comprises the following levels:

Technical Level? Operational

Article 7. (DIRECTORY). The General Personal Identification Service? SEGIP, will have a Directory

formed by the Minister or Minister of Government, by the Minister or the Minister of Justice and the President or the President of the Supreme Electoral Tribunal.

Article 8. (DIRECTORY ATTRIBUTIONS).

I. Are the attributes of the General Staff Identification Service Directory? SEGIP:

Design, approve policies and institutional guidelines aimed at guaranteeing the right to the identification of Bolivians, Bolivians and foreigners, foreigners based in Bolivia.

Approve the structure, manual of functions and requirements of the operational technical level, according to current regulations.

Evaluate the execution and compliance of institutional policies and guidelines.

Require reports to the Executive Directorate of the General Personal Identification Service? SEGIP regarding the fulfillment of the goals and goals raised.

Authorizing and regulating the use of Biometrics by other public and private institutions.

II. The Directory will be chaired by the Minister or the Minister of Government who will periodically convene the sessions.

Article 9. (EXECUTIVE LEVEL).

I. The Director or Executive Director is the Maximum Executive Authority (MAE) of

II. The Director or Executive Director General of the General Personal Identification Service? SEGIP, will exercise its

functions for a period of six years, not being able to be designated again, but after a new period.

III. The Director or the Executive Director General will be appointed by the President of the State Plurinational of Bolivia,

by Supreme Resolution of a terna proposed by the Chamber of Deputies approved by absolute majority.

Article 10. (ATTRIBUTIONS OF THE DIRECTOR OR EXECUTIVE DIRECTOR). Are

attributions of the Director or the Executive Director General of the General Personnel Identification Service? SEGIP:

Exercise the legal representation of the institution.

Direct, coordinate, and monitor technical and operational activities.

Perform and authorize the administrative acts necessary for the operation of the institution.

Subscribe contracts, conventions, and agreements for the execution of plans, programs and projects.

Designate and appoint the institution's personnel according to legal provisions.

Implement mechanisms for the development, use and exploitation of information and communication technologies.

Issue Provisions

Approve the institution's budget and its modifications.

Approve the Institutional Strategic Plan, Operational Plan Annual, regulations and internal manuals.

Approve the opening of offices throughout the territory of the Plurinational State of Bolivia.

Coordinate the provision of the country's foreign identification service with the Ministry of Government and the Ministry of Foreign Affairs.

Approve the institution's budget execution and annual memory.

Report to the President or the President of the Plurinational State of Bolivia, through the Minister or Minister of Government on the actions implemented and their results, without prejudice to compliance with the control rules fiscal.

Other activities regarding compliance with the attributions of the institution.

Article 11. (financial).

I. The General Personal Identification Service? SEGIP, for its operation, will be able to access the following sources

of financing:

Specific Public Resources coming from the exercise of their activities.

General Treasury of the Nation, according to financial availability.

Donations and/or credits from national and international agencies.

II. The resources referred to in point (a) of the preceding paragraph, shall be transferred to a book in the Single Account of the

Treasury, through tax-checking accounts of a tax-collecting nature.

III. The revenues that the Bolivian Police will stop perceiving, for the transfer of the services it gives for the granting of

Identity in favor of the General Personal Identification Service? SEGIP, will be covered with the resources mentioned in the preceding paragraph, considering the average of the last three steps submitted by the National Directorate of Personal Identification, after audit and bank reconciliation with the Ministry of Economy and Public Finance. In case of surplus there will be transferred to the General Treasury of the Nation.

Article 12. (UNIQUE IDENTIFICATION RECORD).

I. The Unique Identification Record? RUI is the set of identification data recorded through

Unique Identification Record

System? SRUI.

II. The identification data contained in the Unique Identification Record? RUI, will be set by Decree

Supreme.

Article 13. (UNIQUE IDENTIFICATION RECORD SYSTEM). The

Unique Record System

Identification? SRUI is a Personal Identification System of the Plurinational State of Bolivia, which records, stores, processes, updates and protects the data of Bolivians, Bolivians, and foreigners, foreign-based in Bolivia, under criteria and parameters established by the General Staff Identification Service? SEGIP.

Article 14. (VALIDATION AND IDENTIFICATION VERIFICATION).

I. Public entities and others that issue official documents, if required, will validate the identification of the

natural persons with the information from the General Personal Identification Service? SEGIP.

II. Natural persons may request verification of their data and public and private institutions, prior to

justification of legal interest, may request verification of identification of natural persons to the General Service of Personal Identification? SEGIP.

III. For compliance with what is set forth in the preceding paragraphs, the corresponding rulemaking will be issued

by Administrative Resolution.

Article 15. (UPDATE OF SINGLE LOG SYSTEM INFORMATION

IDENTIFICATION? SRUI).

For the purposes of the SRUI update, public entities competent in accordance with their privileges shall report periodically to the General Personal Identification Service? SEGIP, on the cases of temporary, permanent residences, and naturalization of foreign persons.

Article 16. (BANS).

Personal Identification Service Public Servers and Servers

SEGIP, are prohibited from modifying, deleting or disseminating data corresponding to the identification of persons, under executive, administrative, civil and criminal responsibility, where appropriate.

THIRD CHAPTER

IDENTITY CARD

Article 17. (IDENTITY CARD).

I. The Identity Cedula? C.I., is the document of a public, individual, unique and non-transferable character, which credits the

identification of Bolivians and Bolivians, individualizing them from the rest of the shelves and inhabitants of the Plurinational State of Bolivia, Valid and valid in the territorial jurisdiction. It will also be valid in other states with which the Plurinational State of Bolivia has reciprocity agreements in place.

II. The Identity Cedula? C.I., will contain data that individualize each Bolivian and Bolivian in a univocal way, from

the Law notes.

IV. The identification data contained in the Identity Code? C.I., they will be regulated by Decree

Supreme.

Article 18. (GRANTING THE IDENTITY CARD).

I. The General Personal Identification Service? SEGIP, is the only institution of the Plurinational State empowered to

grant the Identity Cedula? C.I., to:

All Bolivians and Bolivians by birth, based on the comparison of the database of the Civic Registry Service? SERECI and the Birth Certificate.

All Bolivians and Bolivians by naturalization, upon presentation of the document issued by the Directorate General of Migration.

II. The number of the Cedula will be maintained Identity? C.I., assigned prior to this Act, with exception

of those cases where irregularities are noticed.

III. The General Personal Identification Service? SEGIP, will also grant Identity Cedulos? C.I., by refresh,

update or loss.

IV. The General Personal Identification Service? SEGIP, is the only entity of the Plurinational State of Bolivia,

entitled to grant the Foreign Identity Cedula? CIE to foreign persons located in the Plurinational State of Bolivia, upon presentation of the documentation issued by the competent entity.

V. The components related to the modality, procedures, types and requirements for the granting of

Identity? C.I., and Foreign Identity Cedula? ICN will be regulated through Regulatory Decree.

Article 19. (COMPULSORY).

I. The Identity Cedula? C.I., is a mandatory public procurement and renewal document.

II. Persons naturalized as Bolivian in accordance with the provisions of the Constitution of the State

Plurinational of Bolivia, shall obtain the Identity card? C.I..

III. The Identity Cedula? C.I., will be granted indefinitely to Bolivians and Bolivians from the

fifty-eight (58) years and to those with severe and very serious disabilities qualified according to regulation.

Article 20. (SECURITY MEASURES). The security measures, grant mode, structure

and the validity time of the Identity Cedula? C.I., they will be established by Supreme Regulatory Decree.

TITLE II

FIRST CHAPTER

GENERAL LICENSE SERVICE TO DRIVE? SEGELIC

Article 21. (CREATION AND LEGAL NATURE).

I. The General License Service is created for Driving? SEGELIC, as a decentralized public institution without

directory, with administrative, financial, legal, technical and operational management capacity, with legal personality and own patrimony, under the Ministry of Public Works, Services and Housing.

II. The General License Service for Driving? SEGELIC, is the entity in charge of granting, registering, renewing and

executing the revocation of the Licenses to drive land vehicles throughout the territory of the Plurinational State of Bolivia, in addition to the international licenses.

III. The headquarters of the General License Service for Driving? SEGELIC, is located in the city of La Paz, owing

to establish offices in all the Departments of the Plurinational State of Bolivia.

Article 22. (ATTRIBUTIONS). The General License Service for Driving? SEGELIC, has the

following attributions:

Grant, register, and renew licenses to drive land vehicles.

Fulfilling provisions emanating from competent authority related to the temporary or permanent suspension of licenses to drive land vehicles.

Grant provisional authorizations.

Grant official permissions to foreign mission personnel who perform special duties in the country.

Grant international driving permits.

Establish mechanisms and procedures To categorize licenses.

Authorize, credit and regulate the operation of institutions dedicated to the teaching of vehicle driving.

Other established by a Supreme Regulatory Decree.

Article 23. (MAXIMUM EXECUTIVE AUTHORITY). The General License Service for Driving?

SEGELIC, is in charge of an Executive Director General, who exercises the legal representation of the institution and is designated by Supreme Resolution.

Article 24. (STRUCTURE, ORGANIZATION, AND FUNCTIONS) The structure, organization, and functions of the

General License Service for Driving? SEGELIC, will be established by Supreme Decree.

Article 25. (financial).

I. The General License Service for Driving? SEGELIC, you can access the following sources of financing:

Article 26. (PUBLIC SCHOOL OF VEHICLE DRIVERS). Is the Public School of

Land Vehicle Drivers in the entire territory of the Plurinational State as the unit of the General Licensing Service for Driving? SEGELIC, whose functions, attributions, and others will be established by Supreme Decree.

TITLE III

ADDITIONAL PROVISIONS

FIRST. The General Personal Identification Service? SEGIP, will identify and inform the interested party about

the errors in the data recorded by the National Directorate of Personal Identification, and will proceed free of charge to the sanitation of the same by express administrative resolution.

SECOND. The Police Insurance Mutual (MUSEPOL) will continue to manage and pay for the

assignments and obligations that correspond to it.

TRANSIENT provisions

I. As of the publication of this Law, the National Directorate of Personal Identification, the School of Drivers and

the repartitions in charge of the licenses to drive vehicles, dependent on the Bolivian Police

Personal Identification and the Operational Agency for Transit will be undertaken by the General Staff Identification Service. ? SEGIP, and the SEGELIC.

SECOND. The Bolivian Police will have to take effect from the validity of this Law:

Relocate the police and civilian personnel of the National Directorate of Personal Identification and Licensing, in civil security functions, to the police. respecting your degree and age.

THIRD. Once the present rule for the start of the Service activities

information and documentation regarding the granting of identity cards and licenses to the General Personal Identification Service? SEGIP. Subsequently the General Personal Identification Service? SEGIP, within the maximum period of eight (8) months will transfer all this documentation and information to the General License Service for Driving? SEGELIC.

As long as the organization process of the General License Service for Driving is consolidated? SEGELIC, the General Personal Identification Service? SEGIP, will manage and manage the driver's license granting service.

The General Personal Identification Service? SEGIP, and the General License Service for Driving? SEGELIC will serve temporarily at the facilities of the Bolivian Police as long as you have another infrastructure.

FOURTH.

II. At the request of the Ministry of Government, the Ministry of Economy and Public Finance will carry out the transfers of

budget balances from the General Treasury of the Nation? TGN del? Free Identity Card Program for all Bolivianos? in favour of the General Personal Identification Service? SEGIP.

QUINTA. In the framework of the Constitution of the State and the Law, the Plurinational Electoral Body, through

of the Civic Registry Service? SERECI, will cooperate and coordinate with the General Personnel Identification Service? SEGIP, in the contrast of data from the Civic Registry Service and the Biometrics Register.

PROVISIONS

FIRST. The officials of the Bolivian Police will be subject to executive, administrative,

civil and criminal responsibility that corresponds according to the legal regulations in force, in case of hindering, hiding, preventing, subtracting, damaging, altering or destroy the files, tax values, information and documentation relating to the granting of identity cards and licenses to drive vehicles.

SECOND. The Treasury General of the Nation, with extraordinary character, will assign resources according to your

financial availability, for the start of operations and equipment of the General Personal Identification Service? SEGIP and the General License Service for Driving? SEGELIC.

THIRD. Authorize the Plurinational State Electoral Body, the delivery in quality of the service as a Service

General of Personal Identification? SEGIP and the General License Service for Driving? SEGEIC, the biometric registration computer equipment, for the period of eight (8) years, which are not being used by the aforementioned Authority, and therefore do not affect the administrative and registration technical operations of the same.

REPEAL AND ABROGATORY PROVISIONS

ONLY. Article 7, Article 27, and Article 117 (h) and (g) of the Law

No. 734 of 8 April 1985, Organic Law of the National Police and Articles 109, 110, 111, 112, 113, 114, 116, 117 and 119 of the Transit Code and the inc. e) of Article 25 of Supreme Decree No. 24423.

All provisions contrary to this Law are repealed and abrogated.

Remit to the Executive Body, for constitutional purposes.
