CONSTITUTIONAL PRESIDENT OF THE PLURINATIONAL STATE OF BOLIVIA

For the Legislative Assembly Plurinational, has sanctioned the following Law:

THE PLURINATIONAL LEGISLATIVE ASSEMBLY,

DECRETA:

INDIGENOUS TERRITORY PROTECTION LAW

AND PARQUE NATIONAL ISIBORO SECURE-TIPNIS

Article 1. (DECLARATORY OF THE TIPPIS HERITAGE).

I. The Indigenous Territory and Isiboro National Park Secure-TIPNIS is declared a sociocultural and natural heritage, an area of

ecological preservation, historical reproduction and habitat of the indigenous Chiman, Yuracare and Mojeno-Trinidadian peoples whose protection and conservation are of primary interest of the Plurinational State of Bolivia.

II.

, in the framework of Articles 30, 385, 394 and 403 of the Constitution of the State and other existing rules

is ratified

Indigenous Territory and Isiboro Secure National Park? TIPNIS as indigenous territory of the Chiman, Yuracare and Mojeno-trinittarius peoples, of an indivisible, immeasurable, unembargable, inalienable and irreversible character and as a protected area of national interest.

III. is also declared to the Indigenous Territory and Isiboro Secure National Park? TIPNIS, as zone

intangible.

Article 2. (INDIGENOUS TERRITORY AND PROTECTED AREA). Having the Indigenous Territory and Park

National Isiboro Secure? TIPNIS, in addition to the category of indigenous territory, the category of protected area, is constituted, in guarantee of conservation, sustainability and integrity of the systems of life, the functionality of the ecological cycles and the natural processes in harmonious coexistence with Mother Earth and her rights.

Article 3. (ROADS BY TIPNIS). It is available that the road Villa Tunari-San Ignacio de

Moxos, like any other, will not pass through the Indigenous Territory and Isiboro Secure National Park? TIPNIS.

Article 4. (PROTECTION). Given the intangible character of the Indigenous Territory and Isiboro National Park

Secure? TIPNIS shall be required to take appropriate legal action to reverse, annul or otherwise terminate acts that contravene this legal nature.

Article 5. (PROHIBITION OF ILLEGAL HUMAN SETTLEMENTS IN THE TERRITORY

INDIGENOUS AND NATIONAL PARK ISIBORO SECURE-TIPNIS). In accordance with Article 1 of this Law, when it is declared an intangible territory, the settlements and occupations in fact promoted or carried out by persons other than the owners of the Indigenous Territory and Isiboro National Park Secure? TIPNIS, are illegal and will be liable for eviction with public force intervention if necessary at the request of a competent administrative or judicial authority.

Remit to the Executive Body, for constitutional purposes.
