CONSTITUTIONAL PRESIDENT OF THE PLURINATIONAL STATE OF BOLIVIA

For the Plurinational Legislative Assembly, has sanctioned the following Act:

PLURINATIONAL LEGISLATIVE ASSEMBLY,

D E C R E T A:

PRIVATE LIFE INSURANCE AND PERMANENT DISABILITY LAW FOR ACCIDENTS, DISEASES IN GENERAL OR OTHER CAUSES, FOR THE WORK AND

WORKERS IN THE PRESS OF BOLIVIA? BROTHERS PENASCO LAYME?

ARTICLE 1. (OBJECT). This Law is intended to provide a Life and Invalidity Private Insurance

Permanent for Accidents, Diseases in General or Other Causes, for Workers and Workers of the Press of Bolivia, through the creation of a Financing Fund, establishing the sources of resources and their destination.

ARTICLE 2. (PRINCIPLES). The principles that govern this Law are:

Solidarity. It is the protection of workers and workers of the Press of Bolivia, without distinction and without any form of discrimination through the Private Life Insurance and Permanent Invalidity for Accidents, Diseases in General or Other Causes.

Equality. It is the full recognition of the right of access under the same conditions to the Private Life Insurance and Permanent Invalidity for Accidents, Diseases in General or Other Causes, for the Workers and the

Bolivia Press workers.

Universality. It is the guarantee of protection and access for workers and workers of the Bolivian Press, to the Private Life Insurance and Permanent Invalidity for Accidents, Diseases in General or Other Causes, without any form of discrimination.

Transparency. It is the responsible management of the Resources of the Private Life Insurance Fund and Permanent Invalidity for Accidents, Diseases in General or Other Causes, for workers and workers of the Bolivia.

Opportunity. benefits and benefits from the Private Life Insurance and Permanent Invalidity for Accidents, Diseases in General or Other Causes, for workers and workers of the Bolivian Press, without delay.

Interculturality. It is the recognition of equal opportunities and rights of coexistence between the cultures of the Plurinational State of Bolivia.

ARTICLE 3. (WORKERS AND PRESS WORKERS). For the purposes of this Law, it is

understands by workers and workers of the Press of Bolivia any person who exercises functions in written, radio, television and digital media, public and private; The communication from the Indigenous Peoples ' Nations and Peoples of the Intercultural and Afrobulivian Communities; and in the media of the Community social sector, as well as to all those who are acting as producers self-managing independent.

ARTICLE 4. (CREATION OF THE FUND). Create the Life Private Insurance Financing Fund and

Permanent Invalidity for Accidents, Diseases in General or Other Causes, for Workers and Workers of the Press of Bolivia, in order to cover the premium Private Insurance for that sector.

ARTICLE 5. (OF THE SECURE). The Insurance for Workers and Workers of the Press of Bolivia, covers risks of death and permanent disability caused by accidents, diseases in general or other causes. Compensation for this insurance shall be made by means of a single payment. The other terms and conditions of this insurance, as well as the selection and contracting procedures of the insurance institution, will be regulated by Supreme Decree.

ARTICLE 6. (SOURCE OF FINANCIAL FINANCING).

I. The Fund will be made up of one percent (1%) contributions of the monthly gross revenue generated by the media

written, radio, television, and digital, private and public. Self-managing independent producers, as well as the media of Indigenous Nations and Indigenous Peoples of Peasants and of the Intercultural and Afrobulivian Communities, and the community social sector, will contribute zero twenty-five percent (0.25%) of your monthly gross receipts.

II. For purposes of compliance with this Law, the National Tax Service? S.I.N. shall provide the

necessary information on the monthly gross receipts of the written, radio, television and digital media, private and public; of the media of the Nations and Peoples Indigenous Native Peasants and the Intercultural and Afro-olivianas Communities, and the community social sector; as well as self-managing independent producers.

ARTICLE 7. (DESTINATION OF RESOURCES).

I. The resources of the Fund created through this Act shall be intended for the hiring of insurance policies

Private Life and Permanent Invalidity for Accidents, Diseases in General or Other Causes, for Workers and Bolivian Press workers, who credit their affiliation to a recognized guild organization, of the workers and workers of the Bolivian Press.

II. For the purposes of the affiliation mentioned in the preceding paragraph of this Article, the means and systems of

communication of Indigenous Nations and Peoples Originating Peasants and of the Intercultural and Afrobulivian Communities, respect their form of communication or press organization, in accordance with their practices, practices, customs and their own worldview, recognized in the Constitution of the State.

III. The fund's surpluses, once the costs of Private Life Insurance and Permanent Invalidity for

Accidents, General Diseases or Other Causes, may be used to cover other general benefits for the workers and the workers of the Bolivian Press, as long as they are sustainable in time, and must be determined in the Supreme Regulatory Decree of this Law.

ARTICLE 8. (DELEGATION OF ADMINISTRATION OF THE FUND).

I. The operation of the Fund for Private Life Insurance and Permanent Invalidity for Accidents,

Diseases in General or Other Causes, for Workers and Workers of the Press of Bolivia, will be delegated to an entity financial, selected by public call, through an administration contract authorized by the Board of Directors.

II. The Fund for Private Life Insurance and Permanent Invalidity for Accidents, Diseases in

General or Other Causes, for Workers and Workers of the Press of Bolivia, is constituted as an autonomous patrimony, inembargable, independent, distinct and diverse of the entity's assets that administer it, are undivided and unaffected by any kind of security or precautionary measures of any kind.

ARTICLE 9. (OBLIGATION AND PROHIBITION).

I. Within the framework of the current regulations, the written, radio, television and digital media, private and

public; the media of the Indigenous Nations and Indigenous Peoples Peasants and Communities Intercultural and Afro-olivianas; and the media of the community social sector; as well as self-managing independent producers; they do not exempt themselves from the obligation to comply with health insurance with their workers.

II. For the purpose of guaranteeing the labor rights of workers and workers of the Bolivian Press, it is

prohibited any discount to their basic remuneration or collateral benefits, arguing the disposition of the same to the Private Life Insurance and Permanent Invalidity for Accidents, Diseases in General or Other Causes, for Workers and Workers of the Press of Bolivia.

ARTICLE 10. (SANTIONS). The written, radio, television and digital media, public

and private; the media of the Indigenous Nations and Indigenous Peoples of Peasants and of the Intercultural and Afrobulivian Communities; and the Community social sector communication media; as well as self-managing independent producers of these means, who do not comply with the contributions provided for in Article 6 of this Law, will be punished for the time delay according to the Regulation.

ARTICLE 11. (COUNCIL DIRECTIVE). The Steering Board is created in charge of management and control of the

Private Life Insurance Financing Fund and Permanent Invalidity for Accidents, Diseases in General or Other Causes, for Workers and Workers of the Bolivia Press.

The Board of Directors has the following attributions:

Set policies for the administration of the Fund and for the operability of the Private Life Insurance and Permanent Invalidity for Accidents, Diseases in General or Other Causes, for workers and workers of the Bolivian Press.

Fiscaling the administration of the Fund's resources.

Signing contracts and agreements for the implementation and enforcement of the Life and Life Insurance for Accidents, Diseases in General or Other Causes, for the workers and the workers of the Press of Bolivia.

Issue guidelines within the framework of your attributions.

Propose rules and mechanisms for improving the Life and Life Insurance system of Permanent Life and Invalidity by Accidents, Diseases in General or Other Causes, for Bolivia's workers and press workers.

Require information and economic data on the monthly gross proceeds of the media to the competent authorities.

Require, in a manner the annual, updating of the lists of each and the members of the Bolivia's recognized guild organization, female workers and press workers.

Call, by public tender, to insurance entities for the hiring of a Life Insurance and Permanent Invalidity for Accidents, Diseases in General or Other Causes, for workers and workers of the Bolivia Press.

Evaluate and approve the use of the Fund's surpluses, in accordance with the Supreme Regulatory Decree.

ARTICLE 12. (COMPOSITION OF THE COUNCIL DIRECTIVE).

I. The Board of Directors of the Fund for Private Life Insurance Financing and Permanent Invalidity for Accidents,

Diseases in General or Other Causes, for Workers and Workers of the Press of Bolivia, is comprised of:

Two (2) representatives of the Ministry of Communication.

One (1) representative of the Ministry of Labor, Employment and Social Security.

One (1) representative of the media owners communication.

A (1) representative of the Confederation of Bolivian Press Workers.

II. One (1) representative of the Bolivian Press Departmental Federations, will act as an observer and with

rotating character.

III. One (1) representative of the Organization of the Press and Communication of Indigenous Nations and Indigenous Peoples

Peasants and of the Intercultural and Afro-olivian Communities, will act as an observer and with a rotating character.

. Members of the Board of Directors shall not receive any allowance or remuneration for their participation in that Board.

V. The Board of Directors may have technical and administrative support staff, determined by Decree

Regulatory Supreme.

ARTICLE 13. (ADVICE AND TECHNICAL ASSISTANCE). The Ministry of Economy and Finance

Public, through the corresponding instance, will provide expert advice and technical assistance to the Board of Directors.

FINAL DISPOSITION

ONLY. The Executive Body, will regulate this Law within one hundred and twenty (120) days of computable time to

from its publication.

OPENING AND ABROGATORY PROVISION

ONLY. All provisions contrary to this Law shall be abrogated and repealed.

Remit to the Executive Body, for Constitutional purposes.

two thousand twelve years.
