CONSTITUTIONAL PRESIDENT OF THE PLURINATIONAL STATE OF BOLIVIA

For the Plurinational Legislative Assembly, it has Sanctioned the following Act:

THE PLURINATIONAL LEGISLATIVE ASSEMBLY,

D E C R E T A:

BOOK AND READING LAW

CHAPTER I

GENERAL PROVISIONS

ARTICLE 1. this Law aims to promote the exercise of the right to read and

writing in conditions of freedom, social equity and respect for the diversity of cultural expressions, generating public policies, plans and actions to promote writing, reading and access to the book, cultural, literary, academic and scientific creation.

ARTICLE 2.

Generate policies, plans and actions aimed at the training of readers and writers.

Promote the habit of reading and writing in the population, through the implementation and strengthening of libraries and other public and private spaces for the reading and dissemination of the book.

Promoting the editing and production of books in official languages of the Plurinational State and its translation.

Promote and support the editing of bibliographic material in appropriate formats, for consultation by people with different capabilities.

Promote bibliographic production and the state and private publishing industry.

Promote citizen participation through activities to promote reading, writing and free access to libraries and other interactive spaces.

Encourage the use of new information and communication technology tools.

Drive writing and reading development in official languages recognized by the State Political Constitution.

Implement the System Multi-national Archives and Libraries.

Create the Book Publishing Fund.

Create the Plurinational Book and Reading Committee.

ARTICLE 3. (PRINCIPLES). The book, reading and writing are essential for improving the levels

educational, technical, academic and scientific of the population, and supporting the creation and transmission of knowledge, the cultural development of the State Plurinational and the circulation of information within the framework of a decolonized, diverse, equitable and prosperous society.

The principles that govern this Law are as follows:

Diversity. literary, artistic, scientific, is fundamental in the development of culture, education, science and communications that materializes freedom of expression and creativity.

Decolonization. The book, in its different supports and formats, is a central element of culture, is a carrier of diversity of cultural expressions and an indispensable tool for the preservation and transmission of the nation's cultural heritage.

Equality. The promotion of the book, reading and writing must guarantee access to all population, without economic restrictions, or any discrimination, to the book and to the multiple forms of reading.

ARTICLE 4. (DEFINITIONS). For the purposes of this Act, the following definitions are adopted:

File. Organized information set. Cultural institution where the organic sets of documents for administrative management, information, research and culture are gathered, conserved, ordered and disseminated.

Literary Agent. Natural or legal person responsible for representing the author in the legal, contractual and promotion aspects of his work.

Library. Cultural institution, whose essential function is to give the population has extensive and non-discriminatory access to books, publications and documents published or disseminated on any medium. They can be school, public, university, and specialized libraries.

Public Library. Place of meeting of the community, site of access to information technologies and center for the promotion of culture and reading, which has as its primary function, to offer to the readers a wide access and without discrimination to the bibliographic, audiovisual and multimedia collections or on any other medium, updated on a permanent basis. Public libraries can be state, private, or community.

Private Library. Library formed by a person for exclusive use or by a company, company, private entity, or association, for use by their members; also called Particular Library.

Virtual Library. Library in which a significant proportion of information resources are available in digital format (pdf, doc, microform, etc.), accessible through computers, through the Internet and other accesses.

Legal Deposit. It is a national bibliographic production heritage protection mechanism and is not an instrument for improving collections of Public Libraries.

Territorial Entities Autonomous. Institutionality that administers and governs in the jurisdiction of a departmental, municipal or indigenous territorial unit, in accordance with the powers and powers conferred upon it by the Constitution of the State and Law No. 031, the Framework Law on Autonomy and Decentralization "Andrés Ibanez".

ISBN? International Standard Book Number. Is the International Standard Number of the Book, which serves to identify the country, publisher, and title of each book, without this number being repeated.

ISMN? International Standard Musical Number. Is the international number that identifies written music publications, whether for sale, rent, free circulation or for the purposes of their copyright.

ISSN? International Standard Serial Number (in English). An alphanumeric code used to internationally normalize the recording and identification of serial or periodic publications.

Book. Any unit work published on any medium, composed of text or graphic material, with a beginning and an end, produced by an author or authors, of any nature, capable of reading.

Electronic Book. Book in an appropriate format for reading and/or listening on any electronic device, such as on a computer, mobile phone, or other similar device.

Bolivian Book. All non-periodic unit publication, the record of which is recorded in the Bolivian Legal Deposit.

Journal. Publication of non-daily, generally illustrated, bound periodicity, with writings on several subjects or specialized.

The journals will enjoy the same prerogatives as for the book.

Bolivian Journal. Publication of non-daily periodicity, the record of which is recorded in the Bolivian Legal Deposit.

Plan of Promotion. Instrument that defines actions to protect, promote, promote through programs and activities the production and distribution of books, as well as encouraging the habit of reading.

Plurinational System of Files and Libraries. Organized set of file services and public or private libraries, which are established through coordination and mutual cooperation, in order to to articulate plans, programmes and projects aimed at the development of these plans, allowing democratic access to cultural, educational, informative and recreational goods and services, to which all citizens have

Oral Tradition. Medium of transmission of knowledge, knowledge, values, spiritualities and cosmovisions from generation to generation, for the preservation of our cultural identities.

Transmedia Narrative. It's a story told in a different way that goes beyond the traditional formats, on different platforms and which has the participation of the readers.

A transmedia story expands through the different platforms and supports, incorporating new content, characters and frames. Each medium or medium is part of the story and the set of the editorial product, providing a different reading experience.

21. Reading. An instrument of the cognitive process of certain kinds of information or ideas contained in a

support and transmitted by some type of code, usually a visual, tactile or auditory language, which allows interpreting and deciphering the phonic value of a series of written signs, whether mentally or loudly.

CHAPTER II

PLURINATIONAL PLAN TO PROMOTE BOOK AND READING

ARTICLE 5. (PLURINATIONAL PLAN TO PROMOTE BOOK AND READING).

The Ministries of Cultures and Tourism, and Education, will define and implement the Plurinational Plan for the Promotion of the Book and Reading, in a coordinated and participatory way with all the organizations and institutions linked to the sector, which will contain programmes, projects, strategies and instruments relating to the promotion, dissemination, promotion and awareness-raising.

ARTICLE 6. (OF THE PROMOTION MEASURES). The Multi-National Book and Reading Promotion Plan,

will be implemented through the following promotion measures:

Organization of national, departmental, provincial, municipal, and community books.

Organization and Convocation to Concourses and Awards in various literary, scientific and academic genres in official languages of the Plurinational State.

Organization and Convocation to Concourses and other initiatives of encouraging reading understanding.

Creating Libraries Public, without prejudice to the obligation laid down in this Law by the municipal autonomous governments.

Editing and publishing books for students of the Educational System of the Plurinational State.

Acquisition of movable and immovable assets, aimed at strengthening the Editorial Fund of the Bolivian Book? FONDOLIBRO.

Promote writing and reading in official languages of the Plurinational State.

To promote the research, safeguarding and dissemination of the oral tradition of Indigenous Nations and Indigenous Peoples.

Grant awards, awards, and incentives to publishing and publishing books in official languages.

Educational and informational campaigns for promotion, dissemination, and other promotion measures.

CHAPTER III

PROMOTING BOOK AND READING

ARTICLE 7. (OF THE PUBLISHING INDUSTRY AND THE BOOK TRADE).

I. The Central Government within its public policies, will establish programs to support industry and trade in the

book to ensure plurality, cultural diversity and facilitate access to reading, in consideration of the cultural values that the book represents and its industrial and economic importance.

II. It will contribute to the international expansion of the Bolivian book industry, promoting its participation in the

major national and international fairs and opening new markets abroad.

ARTICLE 8. (IMPORT AND SALE OF BOOKS AND PUBLICATIONS).

I. The import of books, newspapers and magazines, in print, is exempt from the Value Added Tax-VAT.

II. The sale of domestic and imported production books, and of official publications made by institutions of the

Plurinational State of Bolivia, in print, is subject to a zero rate (0) in Value Added Tax-VAT.

ARTICLE 9. (IDENTIFICATION OF THE BOOK).

I. Any book or editorial product produced in the country and recognized by this Law, must display the following

indications:

Title of the work.

Name and/or pseudonym of the author.

The name of the translator, adapter, and/or compiler if there were any.

Symbol of rights reserved (copyright) with indication of the name of the author and year of the first publication.

Identification of the artists graphs that intervened in the work.

Name and address of the editor, followed by the year and the pull of each edition.

Print pie, with the name and address of the player printer.

ISBN or ISSN or ISMN record, as applicable.

Registration in the National Intellectual Property Service-SENAPI.

Legal Deposit Constancy.

The right of natural or legal persons who voluntarily wish to publish, in any format, books or editorial products for their free access and circulation to the public, not subject to the indications set forth in paragraph I of this Article, without this being a disadvantage to the protection and benefits that this Act grants.

CHAPTER IV

THE FILES AND LIBRARIES

ARTICLE 10. (PLURINATIONAL SYSTEM OF FILES AND LIBRARIES).

I. The Plurinational System of Archives and Libraries, dependent on the Ministry of Education, composed of

all Public and Private Archives and Libraries of the Plurinational State, whose purpose is the National administrative register with the Ministry of Education, which contains all the data from the Archives and Libraries existing throughout the national territory.

II. The Public and Private Archives and Libraries of the entire country, must be registered with the System

Plurinational of Files and Libraries.

III. The Ministry of Education will regulate and implement this system.

ARTICLE 11. (LIBRARY IMPLEMENTATION).

I. The Autonomous Territorial Entities must implement at least one Library

Public by district, free access to the population, and must publish on the institutional portal of the entity, the relationship of books available for consultation.

II. Free access to Public Libraries and the removal of books with the single presentation and repository of the

Identity Cedula.

III. Central government through the Ministry of Education, implement the? Multilingual Language Library

State officials, as well as other specialized interactive centers.

CHAPTER V

OF THE BOLIVIAN BOOK EDITORIAL FUND-FONDOLIBRO

ARTICLE 12. (CREATION OF FONDOLIBRO).

I. Create the Editorial Fund of the Bolivian Book-FONDOLIBRO, which will be administered by the Ministries of

Education, and of Cultures and Tourism, according to regulations issued by the Executive Body to this effect.

II. The object of FONDOLIBRO, is to raise resources that will serve for the execution of public policies, of the Plan

Plurinational of Promotion to the Book and the Reading, and the edition of books declared of national interest.

ARTICLE 13. (SOURCE OF RESOURCES). The FONDOLIBRO will be permanent and

made up of the following resource sources:

Resources that are allocated annually by the Ministries of Cultures and Tourism, and Education.

Legacy or donations from private individuals or public or private institutions.

Revenue to be obtained from the sale of the works or editions financed by the FONDOLIBRO.

And any income that is obtained at the departmental, national, and/or international level for the purposes of this Law.

CHAPTER VI

OF THE PLURINATIONAL BOOK AND READING COMMITTEE

ARTICLE 14. (CREATION OF THE PLURINATIONAL BOOK AND READING COMMITTEE).

I. Create the Plurinational Committee of the Book and Reading, as an advisory body to the Plurinational State in the application of this Law.

II. The powers and functioning of the Plurinational Committee of the Book and The Reading, will be normalized through

express regulation, issued by the Executive Body.

III. It will be your competence to declare of national interest the books, whose cultural, historical, technological, scientific content,

academic and educational are a great contribution to society. Its publication will be carried out through the FONDOLIBRO and in accordance with procedures established in the regulation to this effect.

ARTICLE 15. The Plurinational Committee of the Book and Reading will be made up of

the representatives of the following institutions:

A representative of the Ministry of Cultures and Tourism;

Representative of the Ministry of Education;

A representative of the National Intellectual Property Service? SENAPI;

A representative for each Departmental Autonomous Government;

A representative of the Federation of Municipal Associations? FAM;

A representative of the Executive Committee of the Bolivian University? CEUB;

A representative of the Bolivian Chamber of the Book;

A representative of the Bolivian Indigenous Universities;

A representative of the Bolivian National Library and Archive.

ADDITIONAL DISPOSITION

ONLY. Article 76 (h) of Law 843 (Ordered Text) is amended as follows:

? h) The sale of books, newspapers, general information publications, newspapers and magazines on the market

internal or imported, as well as official publications made by institutions of the Plurinational State of Bolivia, in print?

FINAL DISPOSITION

. This Law will be regulated by the Executive Body, within a maximum period of ninety (90) calendar days from the promulgation of this Law.

OPENING DISPOSITION

ONLY. All the provisions contrary to this Law are abrogated.

Remit to the Executive Body, for constitutional purposes.

It is given in the Session Room of the Plurinational Legislative Assembly, at twenty-two days of the month of April two

thousand thirteen years.
