Law No. 459 law of 19 of December of 2013 ALVARO GARCIA LINERA President in exercise of the PLURINATIONAL State of BOLIVIA, by how much, the plurinational Legislative Assembly, has sanctioned the following law: the Assembly Legislative PLURINATIONAL, D E C R E T A: law of medicine traditional ANCESTRAL BOLIVIAN title I provisions General Chapter the first object, scope and scope of application article 1. (OBJECT). This Act aims to: Regular exercise, practice and the articulation of the Bolivian ancestral traditional medicine in the national health system.

Regulate the structure, organization and operation of instances associative, advisory, training and research; and the rights and obligations of users and the users of the Bolivian traditional medicine in all its forms, modalities and therapeutic procedures.

Promote and strengthen the exercise and practice of ancient Bolivian traditional medicine.
ARTICLE 2. (SCOPE). This Act reaches: to the medical and traditional healers, spiritual guides, midwives, midwives and naturists who pursue their individual activities outside the territorial scope of the Nations and peoples originally indigenous peasants and afrobolivianos.

The medical and traditional doctors, guides recognized as part of a nation or native peasant indigenous people and establishing, spiritual, midwife, midwives and naturists that pursue their activities in its territory, in the framework of the collective rights recognized in the political Constitution of the State and the regulations in force.
ARTICLE 3. (SCOPE OF APPLICATION). This law's scope of application to the organs of the national, autonomous territorial entities and instances associative, advisory, training and research of the Bolivian traditional medicine.
SECOND CHAPTER PRINCIPLES AND DEFINITIONS ARTICLE 4. (PRINCIPLES). This law, is governed by the following principles: Ama Qhilla, Ama Llulla and Ama Suwa (don't you be lazy, don't be a liar, nor be thief), jan Jairamti, jan q? arimti, jan lunthatamti.

Ayni, whereby the medical and ancestral Bolivian traditional doctors, must practice reciprocity to help each other.

Taypi, is the gathering of knowledge and knowledge of the medical and traditional doctors, through the practice of reciprocity, of Nations and farmers originally indigenous peoples and afrobolivianos.

Honesty, is an ethical expression of human quality, it is to tell the truth all the time, it is simple respect for the truth, involves the relationship between people and others, and the person with itself.

Community work, is that is done in a complement between the entities of the State, medical and traditional doctors, and autonomous territorial entities and agencies of cooperation, for the development and strengthening of the traditional medicine.

Social interest, such as exercise and practice of the Bolivian traditional medicine in social benefit, collective, community, without lucrative interest nor of commodification.
ARTICLE 5. (DEFINITIONS). For the purposes of this Act, means: Bolivian traditional medicine. It is a set of concepts, knowledge, knowledge and ancient practices ancestral, based on the use of material and spiritual resources for the prevention and cure of diseases, respecting the harmonious relationship between people, families and community with nature and the cosmos, as part of the national health system.

Medical and ancestral traditional doctors. People who practice and exercise, in its different forms and modalities, the Bolivian traditional medicine, are resorting to traditional therapeutic procedures, attending to the plants, animals, minerals, spiritual and technical manual therapies, to maintain and preserve the balance of people, family and community for the? Spiritual leaders of the Nations and farmers originally indigenous peoples and afrobolivianos. They are the women and men who practice principles spiritual, historical and cultural of indigenous peoples originating, in complementarity with the nature and the cosmos, are recognized as spiritual authorities in your community and are the guardians for the conservation, reconstruction and restitution of all the sacred sites of ancient ancestral spirituality.

Traditional obstetrician or midwife. They are the women and men who care and attend the women before, during and after childbirth, and care of the newborn.

Naturists. They are women and men with extensive knowledge of national natural medicinal plants and other resources of the nature of different geographical areas of Bolivia, which applied in the prevention and treatment of ailments and diseases.

Exercise and practice of the medicine traditional ancestral Bolivian. Consists in recognize, revalue and strengthen them knowledge, practices and knowledge of the medicine traditional ancestral Bolivian and them forms of identify and treat them diseases, making use of its methods and technical therapeutic traditional in benefit of the person, the family and the community.
CHAPTER THIRD PROVIDERS OF SERVICES FROM THE MEDICINE TRADITIONAL ANCESTRAL BOLIVIAN AND REQUIREMENTS ARTICLE 6. (PROVIDERS OF SERVICES). Will constitute in health providers of services of the medicine traditional ancestral Bolivian, the following people: medical and medical traditional ancestral.

Guides spiritual of the Nations and peoples indigenous native peasants and afrobolivianos.

Birth attendants and midwives traditional.

Naturist traditional.

ARTICLE 7. (CLASSIFICATION AND REQUIREMENTS).
I. classification by specialties and sub-specialties Bolivian ancestral traditional medicine, will be established in the regulation of this law.
II. the requirements to be recognized as the Bolivian traditional medicine providers, will be established in the regulation of this law.
CHAPTER FOURTH RIGHTS AND DUTIES OF MEDICAL AND TRADITIONAL DOCTORS, GUIDES SPIRITUAL OF THE NATIONS AND PEOPLES ORIGINALLY INDIGENOUS PEASANTS AND AFROBOLIVIANOS, MIDWIFE, MIDWIVES AND NATURISTS.
ARTICLE 8. (RIGHTS). The medical and traditional healers, spiritual guides of the Nations and farmers originally indigenous peoples and afrobolivianos, midwives, midwives and naturists, have the following rights: exercise of the Bolivian traditional medicine practice in free form, no pressures, no discrimination in the entire territory of the plurinational State, no more requirements than those established by the laws and regulations.
Receive decent treatment according to the exercise of their functions in the national health system.

Declined any patient care, for ethical reasons or other duly justified.

Be recognized in the exercise of their practices, knowledge, expertise and original peasant indigenous spirituality.

Free membership of organizations in the sector of the Bolivian traditional medicine.

Implement, manage and operate production centres of medicinal plants, according to specific regulations.

Participate in the processes of scientific and technological research in health, disease and care processes.

Intellectual property protection of their ancestral, individual and collective knowledge.

Be evaluated or assessed with criteria, established by the same medical or traditional healers, spiritual guides of the Nations and rural native indigenous peoples and afrobolivianos, midwives, midwives and naturists, based on parameters established by the Ministry of health and sports, through the Vice-Ministry of intercultural and traditional medicine.

The validity of the certificates issued on treatments carried out.

To promote the operation of laboratories craft, industrial, trade, productivity and ancient Bolivian traditional medicine research.

Respect, appreciation and protection of ancestral knowledge, traditional knowledge, belief, identity and cultural belonging to the symbols, sacred places, ritualistic and their Bolivian worldview - Chaco.
ARTICLE 9. (DUTIES). The medical and traditional healers, spiritual guides of the Nations and farmers originally indigenous peoples and afrobolivianos, midwives, midwives and naturists, the duty of: comply with the ethical principles of indigenous peoples originally farmers, on their ancestral knowledge.
Care for life, harmony with mother earth and all forms of existence.


Preserve the essence of life, the flora and wildlife, to know and identify the climate aspect and production of the year.

Register in the single national registry of medical and traditional healers, spiritual guides of the Nations and farmers originally indigenous peoples and afrobolivianos, midwives, midwives and naturists, in charge of the Ministry of health and sports.

Participate articulated and complementary with the national system of health, epidemics, disasters and emergencies.

Respect the decision of the individual, family and community, when these reject treatment or practice that has been indicated.

Care of Bolivian ancestral traditional medicine, to any person who requests it, without distinction and without more limitations than those set forth by this law and its regulations.

Inform the person, the family or the community, as appropriate, on the treatment or practices to be carried out, and health authorities when they require it.

Do not extend certificates away from the truth.

Refer to the patients in the event of complications, and risk to a nearest health facility.

Denounce the illegal practice and malpractice of the Bolivian traditional medicine.

Promote appreciation and native indigenous spiritual guides of the Nations and peoples meeting spaces peasants and afrobolivianos, for the transmission of ancestral wisdoms.

TITLE II STRENGTHENING AND DEVELOPMENT OF THE EXERCISE AND PRACTICE OF ANCIENT BOLIVIAN TRADITIONAL MEDICINE CHAPTER REGISTRATION FIRST SINGLE OF THE BOLIVIAN TRADITIONAL MEDICINE ARTICLE 10. (SINGLE RECORD OF THE BOLIVIAN TRADITIONAL MEDICINE).

ARTICLE 11. (LOG).
I. the medical and traditional doctors, spiritual guides, midwives, midwives and naturists that pursue their activities outside the territorial scope of the Nations and peoples originally indigenous peasants and afrobolivianos, must register obligatorily in the registry only of the medicine traditional ancient Bolivian - RUMETRAB for the practice of the ancient traditional medicine, without which may not exercise it.
II. the medical and traditional healers, spiritual guides, midwives, midwives and naturists recognized as part of a nation or native peasant indigenous people and establishing, carrying on its business within its territorial scope, can register through their own mechanisms of organization, registration only of the medicine traditional ancient Bolivian - RUMETRAB.
CHAPTER SECOND ARTICULATION OF THE ANCIENT TRADITIONAL MEDICINE BOLIVIAN IN THE NATIONAL SYSTEM OF HEALTH ARTICLE 12. (JOINT). Autonomous territorial entities, within the framework of its powers recognized in the political Constitution of the State, are empowered to create the best conditions of infrastructure, equipment and human resources required, intended for the articulation of the ancestral Bolivian traditional medicine, in health facilities and networks of the national health system with intercultural approach.
ARTICLE 13. (HUMAN RESOURCES).
I. the medical and traditional healers, spiritual guides of the Nations and farmers originally indigenous peoples and afrobolivianos, midwives, midwives and naturists, are human resources to be gradually incorporated within the national health system, as the ancient traditional medicine providers.
II. autonomous territorial entities, pursuant to the law N ° 031, law framework of autonomy and decentralization? Andrés Ibáñez?, may Fund items in health ensuring its sustainability financial.
III. the Ministry of health and sports, through the Vice-Ministry of traditional medicine and interculturality, establish policies related to human resources of traditional medicine ancient Bolivian within health facilities and networks of the national health system.

ARTICLE 14. (INTERSECTORAL ACTION).
I. the Ministry of health and sports, through the Vice-Ministry of intercultural and traditional medicine, will promote the implementation of intersectoral actions for the design, implementation and evaluation of standards and indicators of intercultural health.
II. the intersectoral action be co-ordinated through the National Council of ancient Bolivian traditional medicine - CONAMETRAB.
III. the Bolivian traditional medicine, will be part of the project of telehealth for Bolivia, within the framework of the exercise and practice of it.
THIRD CHAPTER IN BOLIVIAN TRADITIONAL MEDICINE EDUCATION ARTICLE 15. (VALUATION OF MEDICAL AND TRADITIONAL DOCTORS). l Ministry of education, in coordination with the Ministry of health and sports, will establish the necessary mechanisms for the enhancement of the medical and traditional doctors, guides spiritual of Nations and farmers originally indigenous peoples and afrobolivianos, midwife, midwives and naturists, based on experiences, practices and knowledge, according to the regulations of this law.
ARTICLE 16. (PLURINATIONAL CENTER OF BOLIVIAN TRADITIONAL MEDICINE KNOWLEDGE). You create the multinational centre of knowledge of medicine traditional Ancestral Boliviana, which aims at the preservation, transmission, training, dissemination and strengthening the knowledge and wisdoms of the Bolivian traditional medicine.
ARTICLE 17. (TRANSMISSION OF SKILLS AND KNOWLEDGE). The medical and traditional healers, spiritual guides of Nations and farmers originally indigenous peoples and afrobolivianos, midwives, midwives and naturist experience and accreditation community, according to their worldview may transmit their knowledge and wisdom about the exercise and practice of ancient Bolivian traditional medicine, applicants to any of the practices, according to the uses and customs of Nations and farmers originally indigenous peoples and afrobolivianos.
ARTICLE 18. (NATIONAL STATISTICS). The national system of health information - SNIS, is responsible for the collection, classification and data obtained on Bolivian ancestral traditional medicine, with national statistical effects on health.
CHAPTER FOUR HUMAN AND FINANCIAL RESOURCES OF THE BOLIVIAN TRADITIONAL MEDICINE ARTICLE 19. (FINANCING FOR THE PRACTICE AND EXERCISE OF THE BOLIVIAN TRADITIONAL MEDICINE). In the framework of the national health system, the economic resources destined to the practice and exercise of the Bolivian traditional medicine, should be financed to the interior of the institutional budget of the Ministry of health and sports.
ARTICLE 20. (FINANCING OF INVESTMENT PROJECTS). Autonomous territorial entities, within the framework of their competence, are empowered to set economic resources destined to the practice of the ancient Bolivian traditional medicine, for projects of investment, health infrastructure, equipment, maintenance and management of programmes.
TITLE III NATIONAL COUNCIL OF BOLIVIAN TRADITIONAL MEDICINE FIRST CHAPTER CREATION, FORMATION AND DUTIES ARTICLE 21. (NATIONAL COUNCIL OF TRADITIONAL MEDICINE BOLIVIANA - CONAMETRAB).
I creates the National Council of medicine traditional ancient Bolivian - CONAMETRAB, as support, strengthening, development and promotion of the Bolivian traditional medicine and the intercultural health.
II. the National Council of Bolivian traditional medicine? CONAMETRAB, will be composed of nine representatives of the departmental councils of medicine traditional ancient Bolivian - CODEMETRAB, federations or similar bodies representatives of the medical and traditional healers, spiritual guides of the Nations and rural native indigenous peoples and afrobolivianos, midwives, midwives and naturists, according to the regulations of this law.
The National Council technical secretariat of Ancestral Bolibiana traditional medicine III.? CONAMETRAB, shall be exercised by the Ministry of health and sports, through the Vice-Ministry of traditional medicine and interculturalism, in its competent technical quality.
ARTICLE 22. (POWERS OF THE NATIONAL COUNCIL OF TRADITIONAL MEDICINE BOLIVIANA - CONAMETRAB).
The National Council of Bolivian traditional medicine? CONAMETRAB, has the following responsibilities: develop and implement in a coordinated manner, across all levels of Government, plans, programmes and projects for the benefit of the medical and traditional healers, spiritual guides of the Nations and farmers originally indigenous peoples and afrobolivianos, midwives, midwives and naturists.

Promote the development and strengthening of the necessary institutions for the defence of the rights of the medical and traditional healers, spiritual guides of the Nations and farmers originally indigenous peoples and afrobolivianos, midwives, midwives and naturists.

Establish mechanisms for the protection of the rights of the traditional medical medical ylos, spiritual leaders of the Nations and peoples indigenous native peasants and afrobolivianos, midwife, midwives and naturists.

ARTICLE 23. (DEPARTMENTAL COUNCILS OF ANCIENT TRADITIONAL MEDICINE BOLIVIANA - CODEMETRAB).

CHAPTER TWO PERMANENT NATIONAL COMMISSION GUIDES SPIRITUAL OF THE NATIONS AND PEOPLES ORIGINALLY INDIGENOUS PEASANTS AND AFROBOLIVIANOS ARTICLE 24. (STANDING COMMITTEE ON NATIONAL SPIRITUAL OF THE NATIONS AND PEOPLES ORIGINALLY INDIGENOUS PEASANTS AND AFROBOLIVIANOS GUIDES). The permanent National Commission of spiritual guides of the Nations and peoples indigenous native peasants and Afrobolivianos, as a support, strengthening, development and promotion of spirituality, under the National Council of ancient Bolivian traditional medicine - CONAMETRAB is created.
ARTICLE 25. (OPERATION). The composition, allocation and operation, of the permanent National Commission of spiritual guides of the Nations and peoples indigenous native peasants and Afrobolivianos, shall be subject to the regulations of this law.
TITLE IV CONSERVATION AND SUSTAINABLE USE OF THE BIODIVERSITY RESOURCES FIRST CHAPTER RESOURCES OF FAUNA, FLORA, WATER AND MINERALS, BOLIVIAN PHARMACOPEIA OF MEDICINAL PLANTS ARTICLE 26. (FAUNA, FLORA, WATER AND MEDICINAL MINERALS). The plurinational State of Bolivia, civil society, social organizations and Nations and farmers originally indigenous peoples and afrobolivianos, promote and collaborate with the development of policies, plans, programs of protection, conservation, sustainable use and rational use of biodiversity related to exercise and the Bolivian traditional medicine practice.
ARTICLE 27. (BOLIVIAN PHARMACOPOEIA). The Ministry of health and sports, through the Vice-Ministry of intercultural and traditional medicine and drugs and technology in health - UNIMED unit are responsible for the development of the Bolivian Pharmacopeia of medicinal plants, for the development of programs, plans and research projects of the same.
ARTICLE 28. (BASIC LISTING PREMIUM E RESEARCH MATERIAL).
I. the Ministry of health and sports, through the Vice-Ministry of intercultural and traditional medicine and drugs and technology in health - UNIMED, unit to draw up list of the raw materials used for processing and/or manufacturing and/or processing of Bolivian traditional natural products.
II. the Ministry of health and sports, through the Vice-Ministry of traditional medicine and interculturality and drugs and technology in health - UNIMED, unit will promote research, diagnosis and registration systematized the use, knowledge and sustainable development in the Bolivian traditional medicine practice.
CHAPTER SECOND ESTABLISHMENTS, SELLERS OF PRODUCTS NATURAL TRADITIONAL BOLIVIAN ARTICLE 29. (BOLIVIAN TRADITIONAL NATURAL PRODUCTS HERBAL REMEDIES).
I is authorized the operation of the herbal remedies or House of Bolivian traditional natural products, in the public and private field expenderán exclusively national traditional natural products and will be answered, managed by the medical and ancestral registered traditional doctors, whose opening, installation and operation shall be subject to regulation of this Act and the regulations.
II. the health food shops or houses of Bolivian traditional natural products, may adopt the name according to the language of each region.
III. the registration, monitoring and control of the health-food shops or houses of Bolivian traditional natural products, will be in charge of the national drugs unit? UNIMED, through the departmental health services - headquarters, in accordance with the regulations of this law.
IV. import and export of raw materials, such as medicinal plants, plants, animals and minerals, which are used for realization of Bolivian traditional natural products, must be regulated by drugs and technologies in health unit? UNIMED, for the protection of the Bolivian traditional medicine practice.
ARTICLE 30. (CONSULTATION CENTRES). Departmental health services - headquarters, within the framework of its powers, shall authorise the opening and functioning of consultation of ancient Bolivian traditional medicine centers, ensuring the fulfilment of the requirements according to regulation of the present law.
ARTICLE 31. (PLURINATIONAL LIST OF NATURAL AND TRADITIONAL PRODUCTS IN THE NATIONAL SYSTEM OF HEALTH).
I unit for drugs and technology in health - UNIMED, dependent on the Ministry of health and sports, will prepare the pluri-national list of traditional Bolivian natural products, to ensure the access of these products to State institutions of the national health system.
II. natural traditional Bolivian handicraft products - LIPAT, plurinational list is an instrument which ensures the acquisition of national traditional natural products throughout the national health system.
III. the Ministry of health and sports, through the national health system, will incorporate the use of national traditional natural products in the network of health services, with the support of the medical and traditional healers, spiritual guides of the Nations and peoples originally indigenous peasants and afrobolivianos, midwife, midwives and naturists.
ARTICLE 32. (REGISTRATION).
I all Bolivian traditional natural product, must have mandatory registration for marketing.
II. the prepared individual national traditional natural, employed or used directly in the patient by the medical and traditional healers, spiritual guides of the Nations and farmers originally indigenous peoples and afrobolivianos, midwives, midwives and naturists, are not subject to registration.
III. monitoring and control of the marketing of Bolivian traditional natural products, will be in charge of the unit for drugs and technology in health - UNIMED of the Ministry of health and sports, in coordination with the departmental services health - headquarters.
IV. it is forbidden the marketing of natural traditional handicraft products foreign to the Bolivian traditional medicine, introduced into national territory without the respective registration.
V. Laboratories and pharmaceutical industries may not register their labs and branches or agencies such as artisan laboratories of Bolivian ancestral traditional natural products.
TITLE V ILLEGAL EXERCISE AND MALPRACTICE OF THE BOLIVIAN TRADITIONAL MEDICINE CHAPTER FIRST ILLEGAL EXERCISE AND BAD PRACTICE ARTICLE 33. (ILLEGAL EXERCISE). The illegal exercise of the Bolivian traditional medicine, is any activity performed by persons who are not registered in the registry only of the medicine traditional ancient Bolivian - RUMETRAB, as set out in article 11 of this law.
ARTICLE 34. (BAD PRACTICE). The malpractice of the Bolivian traditional medicine, is the Act or omission in interventions or procedures that may impair the health of the patient, causing injury or mild, serious injury or death; produced by the medical and traditional doctors, midwives, midwives and naturists, which shall be punished in accordance with the applicable standard.
SECOND CHAPTER RIGHTS OF USERS AND THE USERS OF THE BOLIVIAN TRADITIONAL MEDICINE ARTICLE 35. (RIGHTS). The rights of users and the users of the Bolivian traditional medicine are: be treated decent and friendly, respecting their traditions and customs.

Receive timely, complete and accurate, information often requiring it.

Consult promptly and take preventive measures that are recommended to avoid diseases.

Claim or report about poor care or service of the medical and traditional healers, spiritual guides of the Nations and farmers originally indigenous peoples and afrobolivianos, midwives, midwives and naturists.

To the free choice of their medical or traditional doctor, midwife, obstetrician and naturist.

Exercise full autonomy to make decisions about your health, without any pressure.

ARTICLE 36. (DUTIES). The duties of persons users and users of the Bolivian traditional medicine are: respect the recommendations, tips and guidance on treatments indicated by their State of health or disease.

Provide dignified and respectful treatment to medical or traditional doctor, spiritual guide of the Nations and peoples originally indigenous peasants and afrobolivianos, midwife, midwives and naturists.

TITLE VI VIOLATIONS AND PENALTIES CHAPTER ONLY INFRACTIONS AND SANCTIONS ARTICLE 37. (INFRACTION). Shall be regarded as infringement: production, import and marketing of traditional ancestral products without health registration issued by the competent national authority.

The production, import and marketing of traditional ancestral foreign products not supported by a health registry.

The marketing of the ancestral traditional products, out of the herbal remedies or medical consultation points.

The distribution and marketing of ancestral traditional products, by any person, public or private institution, without the registration.

Inadequate preservation of raw material, which requires special conditions of maintenance.

And others laid down in the regulation.
ARTICLE 38. (SANCTIONS).

I. the offences referred to in the previous article, will be sanctioned in the administrative, with disqualification, suspension, pecuniary fines or community work.
II. the sanctions set forth in the preceding paragraph shall be regulated.
SOLE TRANSITIONAL PROVISION. This law will be regulated by the Executive Branch, to the proposal of the Ministry of health and sports, by Supreme Decree, within a maximum period of ninety (90) days working, computable from the publication in the Official Gazette of Bolivia.


SOLE FINAL PROVISION. The collective intellectual property of the intangible biological component used for traditional medicine, will be registered according to the special rule.
SOLE REPEAL AND ABROGATION PROVISION. All provisions contrary to this law are hereby repealed and repealed.
