THE PLURINATIONAL LEGISLATIVE ASSEMBLY,

D E C R E T A:

TRADITIONAL BOLIVIAN TRADITIONAL MEDICINE LAW

TITLE I

GENERAL PROVISIONS

CHAPTER FIRST

OBJECT, SCOPE AND SCOPE

ARTICLE 1. (OBJECT). This Law is intended to:

CHAPTER SECOND

PRINCIPLES AND DEFINITIONS

ARTICLE 5. (DEFINITIONS). For the purposes of this Law, it is understood by:

TITLE II

ARTICLE 11. (REGISTER).

CHAPTER SECOND

ARTICLE 13. (HUMAN RESOURCES).

III. The Ministry of Health and Sports, through the Vice-Ministry of Traditional Medicine and Interculturality,

ARTICLE 14. (CROSS-SECTORAL ACTIONS).

I. The Ministry of Health and Sports, through the Viceministerium of Traditional Medicine and Interculturality, will promote

the implementation of cross-sectoral actions for the design, application and evaluation of standards and indicators of interculturality in health.

II. The cross-sector actions will be coordinated through the National Council of Traditional Ancestral Medicine

Boliviana-CONAMETRAB.

III. The traditional Bolivian ancestral medicine, will be part of the Telehealth project for Bolivia, in the framework of the

exercise and practice of it.

CHAPTER THIRD

EDUCATION IN TRADITIONAL TRADITIONAL MEDICINE BOLIVIANA

ARTICLE 15. (VALORIZATION OF THE DOCTORS AND THE TRADITIONAL DOCTORS).

CHAPTER FOURTH

AND ECONOMIC RESOURCES OF THE

TITLE III

NATIONAL COUNCIL OF

TRADITIONAL BOLIVIAN ANCESTRAL MEDICINE

CHAPTER FIRST

CREATION, CONFORMATION, AND ATTRIBUTIONS

ARTICLE 21. (NATIONAL COUNCIL OF TRADITIONAL BOLIVIAN ANCESTRAL MEDICINE-

CONAMETRAB).

I. The National Council of Traditional Bolivian Ancestral Medicine-CONAMETRAB, as an instance of support, is created

strengthening, developing and promoting traditional Bolivian ancestral medicine and interculturality in health.

II. The National Council of Traditional Ancestral Bolivian Medicine? CONAMETRAB, will be formed by the

nine representatives of the Departmental Councils of Traditional Ancestral Boliviana-CODEMETRAB, federations or similar instances representatives of the doctors and the traditional doctors, spiritual guides of indigenous nations and peoples originating peasants and Afro-olivians, midwives, parteros and naturists, according to the regulations of this Law.

III. The Technical Secretariat of the National Council of Medicine Traditional Ancestral Bolivian? CONAMETRAB, will be exercised by the Ministry of Health and Sports, through the Viceministerium of Traditional Medicine and Interculturality, in its competent technical quality.

ARTICLE 22. (ATTRIBUTIONS OF THE NATIONAL COUNCIL OF TRADITIONAL MEDICINE

ANCESTRAL BOLIVIANA-CONAMETRAB).

The National Council of Traditional Bolivian Ancestral Medicine? CONAMETRAB, has the following attributions:

ARTICLE 23. (DEPARTMENTAL COUNCILS OF TRADITIONAL ANCESTRAL MEDICINE

BOLIVIANA-CODEMETRAB).

CHAPTER SECOND

PERMANENT NATIONAL COMMISSION OF SPIRITUAL GUIDES OF INDIGENOUS PEOPLES AND PEOPLES ORIGINATING PEASANTS AND AFRO-OLIVIANOS

ARTICLE 24. (PERMANENT NATIONAL COMMISSION OF SPIRITUAL GUIDES OF THE

ARTICLE 25. (FUNGREV). The composition, attribution and functioning of the National Commission

TITLE IV

CONSERVATION AND SUSTAINABLE USE

OF BIODIVERSITY RESOURCES

CHAPTER FIRST

RESOURCES OF FAUNA, FLORA, WATER AND MINERALS, BOLIVIAN PHARMACOPOEIA MEDICINAL

ARTICLE 26. (FAUNA, FLORA, WATER AND MEDICINAL MINERALS). The State

ARTICLE 27. (PHARMACOPOEIA BOLIVIANA). The Ministry of Health and Sports, through the

Viceministerium of Traditional Medicine and Interculturality and the Unit for Medicines and Technology in Health-UNIMED, are responsible for the development of the Bolivian pharmacopoeia of medicinal plants, for the elaboration of programs, plans and research projects of the same.

ARTICLE 28. (BASIC LIST OF RAW MATERIALS AND RESEARCH).

I. The Ministry of Health and Sports, through the Viceministerium of Traditional Medicine and Interculturality and the Unit

of Medicines and Technology in Health-UNIMED, will draw up the list of the raw materials used for The elaboration and/or manufacture and/or transformation of traditional Bolivian natural products.

II. The Ministry of Health and Sports, through the Viceministerium of Traditional Medicine and Interculturality and the Unit

Medicines and Technology in Health-UNIMED, will promote research, diagnosis and registration

CHAPTER SECOND

ESTABLISHMENTS, PRODUCT VENDORS

ARTICLE 29. (HERBAL TRADITIONAL PRODUCTS

of its attributions, will authorize the opening and functioning of the Centers of Consultation of Traditional Ancestral Bolivian Medicine, assuring the compliance with the requirements required under the regulations of this Law.

ARTICLE 31. (PLURINATIONAL LIST OF NATURAL AND TRADITIONAL PRODUCTS IN

THE NATIONAL HEALTH SYSTEM).

I. The Unit for Medicines and Technology in Health-UNIMED, under the Ministry of Health and Sports,

will prepare the Plurinational List of Traditional Bolivian Natural Products, to guarantee the access of these products to the State entities of the National Health System.

II. The Plurinational List Of Traditional Bolivian Artisanal Natural Products-LIPAT, is an instrument that

guarantees the acquisition of national traditional natural products throughout the National Health System.

III. The Ministry of Health and Sports, through the National Health System, will incorporate the use of national traditional natural products

the health services network, with the support of the doctors and the traditional doctors, guides spiritual of indigenous nations and peoples originating peasants and Afro-olivians, midwives, parteros and naturists.

ARTICLE 32. (SANITARY REGISTER).

I. Every traditional Bolivian natural product, you must have a Sanitary Record for your

TITLE V

ILLEGAL EXERCISE AND MALPRACTICE

OF MEDICINE TRADITIONAL BOLIVIAN ANCESTRAL

CHAPTER FIRST

ILLEGAL EXERCISE AND MALPRACTICE

ARTICLE 33. (ILLEGAL EXERCISE). The illegal exercise of traditional Bolivian ancestral medicine, is

all activity carried out by people who are not registered in the Single Register of Traditional Bolivian Ancestral Medicine -RUMETRAB, as set forth in Article 11 of this Law.

ARTICLE 34. (MALPRACTICE). The malpractice of traditional Bolivian ancestral medicine is the

action or omission in interventions or procedures that impair the patient's health, causing injury and/or minor, severe or death; produced by doctors and traditional doctors, midwives, midwives and naturists, who will be sanctioned according to the applicable standard.

CHAPTER SECOND

RIGHTS OF USERS AND USERS OF TRADITIONAL MEDICINE BOLIVIAN ANCESTRAL

ARTICLE 35. (DERACTS). The rights of users and users of traditional ancestral medicine

ARTICLE 36. (DUTIES). The duties of users and users of traditional Bolivian medicine

are:

Respect recommendations, advice and guidance on treatments indicated by your state of Health or disease.

Providing dignified and respectful treatment to the traditional physician or physician, spiritual guide of indigenous peoples and peoples originating in the peasants and Afro-olivians, midwives, midwives and naturists.

Communicate de Truthful and complete your health, personal and family history.

Reporting the illegal exercise and malpractice of traditional Bolivian ancestral medicine.

ARTICLE 37. (INFRINGEMENTS).

The production, import and marketing of traditional ancestral products without Sanitary Registration granted by competent national authority.

Production, import, and marketing of traditional foreign ancestral products not backed by a Sanitary Register.

The marketing of traditional ancestral products, outside of herbalists or medical consultation points.

The distribution and marketing of products traditional ancestral, by any person, public or private institution, that do not have the Sanitary Registry.

The inadequate preservation of the raw material, which requires special maintenance conditions.

And others set in the regulation.

ARTICLE 38. (SANTIONS).

I. The offences referred to in the previous Article shall be sanctioned on the administrative path, with disablement, suspension, pecuniary fines or community work.

II. The penalties set out in the preceding paragraph shall be

TRANSIENT DISPOSITION

ONLY. This Law shall be regulated by the Executive Body, a Proposal of the Ministry of Health and

Sports, by Supreme Decree, within a maximum period of ninety (90) working days, computers from the publication in the Official Gazette of Bolivia.

FINAL DISPOSITION

ONLY. The collective intellectual property of the intangible biological component used for the purposes of traditional medicine

, will be recorded according to the special rule.

REPEAL AND ABROGATORY PROVISION

ONLY. All provisions contrary to this Law are repealed and abrogated.
