CONSTITUTIONAL PRESIDENT OF THE PLURINATIONAL STATE OF BOLIVIA

For the Plurinational Legislative Assembly, it has The following Act:

THE PLURINATIONAL LEGISLATIVE ASSEMBLY,

D E C R E T A:

AGE REDUCTION LAW FOR UNHEALTHY JOBS

Article 1. (OBJECT). This Law aims to normalize access to the benefits of the

Pension with age reduction " for work under unsanitary conditions.

Article 2. (INSALUBRES CONDITIONS IN THE MINING SECTOR).

I. In the event that other mining sectors not covered by Law No 3725 of 3 August 2007, request it to be considered as analogous work by their sector, they shall comply with the following requirements:

To have a technical study of the sector for the declaration of analogous work, carried out by a technical commission made up of the National Institute of Occupational Health-INSO, National Institute of Health Insurance-INASES and the National Department The Ministry of Health and the National Health Department (CNS).

Contar with a legal technical report for the declaratory of analogous work, prepared by the National Institute of Occupational Health-INSO, National Institute of Health Insurance-INASES and the National Department of Medicine Work of the National Health Fund-CNS.

II. The report referred to in paragraph (b) of the previous paragraph, shall be referred to the Pension and Insurance Control and Control Authority-APS, for the verification of requirements and subsequent issuance of a Supreme Decree that recognizes that the mining sector carries out similar works to those determined in Law No 3725 of 3 August 2007, the same one that must be brought to the attention of the Ministry of Economy and Public Finance for their respective processing, in compliance with legal provisions.

Article 3. (UNHEALTHY CONDITIONS IN OTHER SECTORS).

I. For other sectors other than the mining sector, to be declared as unhealthy jobs and to benefit from the age reduction for access to retirement, the following requirements must be met:

Technical study of the sector for declaratory of work in unsanitary conditions, carried out by a technical commission made up of the National Institute of Occupational Health-INSO, National Institute of Health Insurance-INASES and the Department National of Work Medicine of the National Health Fund-CNS.

Legal technical report for the declaratory of work under unsanitary conditions, prepared by the National Institute of Occupational Health-INSO, National Institute of Health Insurance-INASES and the National Department of Medicine Work of the National Health Fund-CNS.

The technical study should look at the reduction of life expectancy from exposure time to unhealthy working conditions.

II. The report and studies outlined above must be submitted to The Authority of Taxation and Control of

Pensions and Insurance-APS, for its analysis and the issuance of a Project of Supreme Decree that recognizes that the sector performs works in unsanitary conditions determined in Law No. 3725 of 3 of August 2007, the same shall be brought to the attention of the Ministry Public Economy and Finance for their respective processing, in compliance with legal provisions.

Article 4. (FREQUENCY OF STUDIES). In case the mining or other sectors have

the study carried out by the technical commission, which establishes that there are no unsanitary working conditions in one or more sections of a given sector, the study will not be considered as the request for a new study, except where there is reasonable justification for the new study, such as the introduction of new processes, change of processes, etc., which could generate unhealthy jobs.

Article 5. (DEROGATIONS). The legal provisions contrary to this Law will be repealed.

Remitase to the Executive Body for constitutional purposes.

It is given in the Session Room of the Plurinational Legislative Assembly, at the nineteenth day of the month of August

of the year two thousand fourteen.

Therefore, it is enacted to have and comply with the Law of the Plurinational State of Bolivia.
