CONSTITUTIONAL PRESIDENT OF THE PLURINATIONAL STATE OF BOLIVIA

For the Plurinational Legislative Assembly, it has sanctioned The following Law:

THE PLURINATIONAL LEGISLATIVE ASSEMBLY,

DECRETA:

ANIMAL DEFENSE LAW

AGAINST ACTS OF CRUELTY AND MISTREATMENT

Article 1. (OBJECT). This Law aims to establish the normative framework for the defense of the

animals, against acts of violence, cruelty and mistreatment, committed by natural or legal persons.

Article 2. (PURPOSE). This Law is intended to prevent and criminalize acts of violence,

mistreatment, cruelty and biosafety committed by persons against domestic animals, within the framework of paragraph 21 of Paragraph I of Article 298 of the Constitution. State Policy.

Article 3. (ANIMAL RIGHTS). Animals as protection subjects, have the following

rights:

To be recognized as living beings.

To a healthy and protected environment.

To be protected against all kinds of violence, mistreatment and cruelty.

To be assisted and taken care of.

Article 4. (OBLIGATIONS OF THE STATE). The Executive Body, through its Ministries, will have the

following obligations:

The Ministry of Health will propose:

Policies for the prevention of zoonoses, within the framework of their competencies concurrent with the different levels of government.

Regulation of the use of laboratory animals for scientific research purposes.

The Ministry of Education will propose:

Educational policies intended to promote animal welfare and defense.

Regulation of use of animals for scientific research purposes.

The Ministry of Communication will propose policies for communication, awareness raising, dissemination of government programs and actions, concerning the defense of animals, in coordination with the Ministry of Environment and Water, and the Ministry of Autonomy.

The Ministry of Rural Development and Lands will propose health and agricultural safety policies.

Article 5. (OBLIGATIONS OF PERSONS).

I. People have the following obligations:

Avoid causing them or allowing unnecessary suffering.

Refusing unnecessary surgical procedures.

Educating new generations, about the importance of respect for animals and promoting their defense.

To report to the competent authorities, the acts of mistreatment and cruelty that contravene the legal order related to the protection of animals.

Reporting suspected cases of zoonoses and other animal diseases, to the competent authorities.

Other established by Law or Regulation.

II. The owners or managers of the animals have the following obligations:

Assume the emerging responsibility for the custody and tenure of an animal and the damage to third parties that the animal could cause.

Control your reproductive cycle and give you professional, appropriate and timely veterinary medical care.

Velar for your needed food and shelter.

Avoid breeding a larger number of animals than you may be maintained, without causing any inconvenience to third parties, or endangering public health.

Do not abandon them.

Article 6. (BANS). It is prohibited:

The use of animals in military, police or other instruction practices, in which the animal's death or suffering is caused.

The mobilization, entry, exit and marketing of animals in the affected jurisdictions, in case of outbreaks of rabies, zoonoses and epizootic diseases.

Article 7. (RULES AGAINST ACTS OF ABUSE). The Autonomous Territorial Entities, in the

framework of their competencies, may issue the corresponding regulations, establishing sanctions against acts of abuse that cause pain and suffering, caused directly or indirectly by the people.

Article 8. (MEDIA). The means of oral, written and television communication, within the framework

of their social responsibility, should disseminate educational information aimed at the general population, on the respect and defense of animals.

Article 9. (SOCIAL CONTROL). The organized civil society, in particular the organizations or institutions

dedicated to the defense of the animals, in application of Law No. 341 of 5 February 2013, of Participation and Social Control, in the levels of government that corresponds, you can:

Participate in the formulation of rules and policies aimed at avoiding and sanctioning, acts that cause suffering in animals.

Promoting awareness, education and prevention actions, for the development of a culture of respect and defence of animals.

Suggesting and promoting inter-institutional control and control measures and mechanisms for the punishment and elimination of behaviors that cause abuse and cruelty to animals.

Article 10. (CRUEL AND BIODIUM TREATMENT).
