12 JUIN 2016. - An Act to amend the Act of 31 January 2003 on the phase-out of nuclear energy for industrial electricity production, with a view to fixing the annual fee for the extension of nuclear power plants Doel 1 and Doel 2 (1)



PHILIPPE, King of the Belgians,
To all, present and to come, Hi.
The House of Representatives adopted and sanctioned the following:
Article 1er. This Act regulates a matter referred to in Article 74 of the Constitution.
Art. 2. In section 4/2 of the Act of 31 January 2003 on the phase-out of nuclear energy for industrial electricity production, inserted by the Act of 28 June 2015, the following amendments are made:
1° in paragraph 1er, the words "from the year 2016, until 2025 included" are inserted between the words "The owner of the nuclear power plants Doel 1 and Doel 2 verse" and the words "to the federal state" and the words ", until 15 February 2025 for Doel 1 and until 1er December 2025 for Doel 2," are repealed.
2° paragraph 1er is supplemented by two paragraphs, as follows:
"The total annual fee is set at 20 million euros for the two nuclear power plants. This amount is paid no later than June 30 of each year referred to in paragraph 1er to the Energy Transition Fund referred to in section 4ter of the Electricity Market Organization Act of 29 April 1999.
In the event of a final shutdown of one of the plants referred to in paragraph 1er imposed by the public authorities under the Act of 15 April 1994 for imperative reasons of nuclear safety, or pursuant to a binding decision of any competent European or international institution imposing the advance final order of Doel 1 or Doel 2, the annual fee is reduced in proportion to the unavailability of the power plant concerned for the current year. The reduction is fixed by the King, by order deliberately in the Council of Ministers. In this case, the fee is no longer payable for subsequent years. ";
3° in paragraph 2, the words "federal (with the exception of general application taxes) that" are replaced by the words "federal (with the exception of general application taxes and annual fees under the Act of 15 April 1994) that";
4° in paragraph 3, 1°, the word "calculation" is replaced by the word "payment";
5° paragraph 3, 2°, is replaced as follows: "2° settle the compensation of the parties in the event of non-compliance with the provisions of the agreement, in the event of a temporary or final judgment of Doel 1 or Doel 2, or in the case of unilateral acts of a contracting party and, with respect exclusively to the federal State, of unilateral acts in accordance with its competences ".
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
