The House of Representatives adopted and sanctioned the following:
CHAPTER I. - General provisions
Art. 1.01.1.
This Act regulates a matter referred to in Article 74, 3° of the Constitution.
Art. 1.01.2.
The General Estimates for fiscal year 1997 are adjusted:
1° with respect to the appropriations provided for the holdings, in accordance with the table annexed to this Act;
2° in respect of appropriations by programme, in accordance with the totals of the programmes in adjusted departmental budgets annexed to this Act.
CHAPTER Ierbis. - Planned allocations for staffing
Article 1erbis 01.32.4
Contract with the Citizen: administrative renewal (parliamentary mediator) - The additional credit of 20 million francs can only be used by federal mediators after, on the one hand, their detailed budget proposals for the fiscal year 1997 have been forwarded to the House of Representatives and approved by the House of Representatives, and on the other hand, in accordance with the provisions of sections 17 and 19 of the Act of 22 March 1995, the House of Representatives has approved the rules of procedure of the mediators and decreed the status and framework of their personnel.
CHAPTER II. - Special provisions of departments
Section 11. - Services of the Prime Minister
Art. 2.11.1.
In section 2.11.3 of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997 the following subsidy is inserted:
- Programme 60/2 - R & D in the international context: "Subsidy to the European Organization for Research and Treatment of Cancer". »
Art. 2.11.2.
In the text of section 2.11.3 of the Act of 16 December 1996 containing the General Estimates for the 1997 fiscal year, the following program is added between programs 56/1 and 60/0:
« Programme 57/1 - Centre Europeen
Children who have disappeared
Grant to the European Centre for Missing Children. »
Section 12. - Ministry of Justice
Art. 2.12.1.
In section 2.12.7 of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997, the text referred to in the program "51/0 - Subsistance", 1) is replaced by the following text:
« 1) Subsidies to host and guidance organizations as part of national projects for the supervision of alternative measures. "
Section 13. - Ministry of the Interior
Art. 2.13.1.
Section 2.13.3 of the Act of 16 December 1996 containing the General Estimates for 1997 is supplemented as follows:
« Programme 51/9 - Population and elections
Intervention in the operational costs of the Electoral Coordination Office in Bosnia and Herzegovina. .
Programme 58/0 - Subsistence
1° Grant to the Flemish Brabant Province for the construction of the Provincial Council Chamber and facilities reserved for Government Commissioners and federal agents.
2° Grant to the Flemish Brabant Province as an intervention in the rental or development costs of the Provincial Council. »
Section 14. - Ministry of Foreign Affairs
and Foreign Trade
Art. 2.14.1.
Within the scope of the basic allocation concerned, program 53/1 - "Foreign Policy", a subsidy may be granted to the "Asia-Europe Foundation".
Art. 2.14.2.
Within the limits of the basic allocation concerned, in programme 53/4 - "Humanitarian Assistance", expenses of any kind can be made, with prior agreement of the Council of Ministers, as interventions by Belgium in the actions of preventive diplomacy, peacekeeping and promotion of democracy within the framework of international policy.
Section 16. - Ministry of National Defence
Art. 2.16.1
Section 2.16.10 of the Act of 16 December 1996 containing the General Estimates for the 1997 Budget Year is supplemented as follows:
" 8. A.S.B.L. "The Friends of the Music of the Guides";
9. A.S.B.L. "Belgian Air Force Symphonic Band Foundation". »
Art. 2.16.2.
In section 2.16.13, the first paragraph of the Act, the amount of CHF 250 million is replaced by the amount of CHF 350 million.
Section 2.16.13 of the Act is supplemented as follows:
"The Minister of National Defence is authorized, in the same markets, to use refunds collected for the sale of F-16 aircraft by the United States, to third countries ("coupments for tooling"), up to 265.0 million francs. »
Art. 2.16.3
Section 2.16.14, first paragraph of the Act is replaced by the following:
"In accordance with section 150 of the Act of 26 June 1992 on social and other provisions, the Minister of National Defence is authorized, within the limits of revenues derived from the alienation of immovable property that are part of the real estate entrusted to his management, collected and accounted for 87.07.04.28.B of the section "Treasury Order Operations" to contract in 1997, for a sum of 500 million francs, However, payments are limited to CHF 250 million for the fiscal year. » .
Art. 2.16.4.
In section 2.16.20, second paragraph of the Act, the amount of CHF 1,000 million is replaced by the amount of CHF 650 million.
Art. 2.16.5.
In article 2.16.22, first paragraph of the same law, the Dutch text: "... of het burgerlijk element..." is replaced by the following text: "... of de civiele dienst...".
Section 18. - Ministry of Finance
Art. 2.18.1.
Section 2.18.1 of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997 is supplemented by the following provision:
Ҥ 7. By derogation from Articles 5 and 34 of the State Accounting Laws, coordinated on 17 July 1991, the ordinary accountant of the Accounting and Budget Directorate of the General Secretariat is authorized to make expenditures on the account of various revenues, exclusively within the framework and within the financial limits of programmes pre-financed on this account by the European Union or other international bodies.
Prior to their payment, invoices and claims relating to these programs must be subject to the visa of the delegated official of the General Secretariat. »
Art. 2.18.2.
Section 2.18.4 of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997 is replaced by the following provision:
"By derogation from Articles 5 and 34 of the State Accounting Laws, coordinated on 17 July 1991, the appropriations authorized by this Act may be used for the performance of invoices and claims of receivable of prior years concerning:
- The Clothing Mass for Customs Administration personnel and accesses;
- supplies resulting from commitments made to the intervention of the Federal Purchasing Office and to be charged to basic allowances 12.01 or 74.01 of a subsistence program;
- fixed expenses to be charged to the basic allowance 11.04 in the regulation of the account 87.10.18.51 of the Cash Administration relating to the remuneration of subsidized contractors;
- works, supplies and services resulting from commitments made to the operation of the Buildings Board.
Art. 2.18.3
By derogation from Article 1.01.3, § 2, of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997 and Article 15 of the Acts on State Accounting, coordinated on 17 July 1991, the basic allowances for remuneration and allowances generally of any kind " 11.08 - Staff members of the Customs and Excise Administration who requested, on January 1, 1993, their early retirement or who introduced in 1993 an application for personal availability" and " 11.09 - Personnel of the Customs and Access Administration made available to other Administrations of the Ministry of Finance and other government departments and services" may be redistributed to or from the basic allowance " 11.03 Final Staff and Intern".
Art. 2.18.4.
By derogation from Article 12 of the State Accounting Laws, coordinated on 17 July 1991, claims of receivables of prior years may be cleared on the credits provided for years prior to the following basic allocations of the subsistence programme "40.0 - General Secretariat": .
11.03 - "Remunerations and allowances generally any of the final and interns statutory staff";
11.04 - "Remunerations and allowances generally of non-status personnel";
12.01 - "Permanent Expenditures for the Purchase of Unsustainable Goods and Services";
12.28 - "Amount to cover expenses resulting from the creation and operation of information processing centres of the Department of Finance";
74.01 - "Expense for the acquisition of durable movable property".
Art. 2.18.5.
In the text of Article 2.18.3 of the Act of 16 December 1996 containing the general budget of expenditures for the fiscal year 1997, the following phrase: ", and to the financing of the resumption of loans of the Forges Company of Clabecq, nantis of the guarantee of the State," is added after the words "European institutions".
Section 21. - Pensions
Art. 2.21.1.
Section 2.21.3, 2nd paragraph, of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997, the amount of CHF 4.800.0 million and the amount of CHF 5.900.0 million.
Section 23. - Ministry of Employment and Labour
Art. 2.23.1
Section 2.23.3 of the Act of 16 December 1996 containing the General Estimates for the 1997 Budget Year is supplemented as follows:
Programme 40/5 - Equal opportunities
between women and men
3) Subsides to the A.S.B.L. "Sophis".
Programme 56/3 - Predictions
Within the limits of the basic allocation of program 56/3 - "Prepensions", a grant may be allocated to the Merchant Marine Life Safety Fund to pay the additional allowances of the sector's prepensions.
Art. 2.23.2
Section 2.23.7 of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997 is amended as follows:
"The National Employment Board is authorized to use, during the current fiscal year, the available balance of previous years to cover the costs associated with the engagement of subsidized contractors (AB 56/40 42.11), as well as to make the waiting allowance payments to workers affected by certain business closures and severance pay to workers fired from coal (AB 56/60 42.13). »
Section 31. - Ministry of Average Class and Agriculture
Art. 2.31.1.
Section 2.31.7 of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997 is replaced as follows:
"Scheduled to the programme of activity 56/1 - R & D, within the national framework - Urgent problems, contractual research and extension - commitments up to 20,000 francs for the regularization of the commitments as of 1 January 1995. »
Section 32. - Ministry of Economic Affairs
Art. 2.32.1.
In section 2.32.1, § 1, first paragraph, of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997, the amount of CHF 30,000 is replaced by the amount of CHF 50,000. .
Art. 2.32.2
Section 2.32.4 of the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997 is replaced as follows:
"The programme of activity 70/1 - R & D in the national context is authorized to carry out commitments up to 16,000 francs in order to regularize the outstanding commitments as of 1 January 1997. »
Section 33. - Ministry of Communications and Infrastructure
Art. 2.33.1.
Section 2.33.4 of the Act of 16 December 1996 containing the General Estimates for the 1997 Budget Year is supplemented as follows:
« Programme 51/1 - Société Nationale des Chemins de fer
Subsides to the SNCB as an intervention in the organization of a day of promotion Train-Tram-Bus. »
Art. 2.33.2
The budget of the Belgian Institute of Postal Services and Telecommunications of 1997 is approved annexed to this Act.
This budget amounts to 884,300,000 francs and 884,300,000 francs.
It includes in expenditures a commitment credit of 40,700,000 francs.
Section 51. - Public debt
Art. 2.51.1.
The application of the provisions of Article 11 of the Convention of 6 February 1965 for the settlement of issues relating to the Public Debt and the wallet of the Belgian Congo Colony, concluded between the Kingdom of Belgium and the Democratic Republic of the Congo, approved by the law of 23 April 1965, and the application of the provisions of Article 7, of the law of 5 January 1977 issuing a second tranche of borrowing of the Belgo-Congolese Fund.
CHAPTER III. - Restitution and allocation funds
Art. 3.01.1.
Table 3 annexed to this Act replaces Table 3 - Restitution and allocation funds, annexed to the Act of 16 December 1996 containing the General Estimates for the fiscal year 1997.
CHAPTER IV. - Separate Management State Services
Art. 4.01.1.
The operations during the 1997 fiscal year of the Prison Labour Board (Justice) and the Permanent Recruitment Secretariat (Public Service) are estimated at the sums listed in the 1997 budget annexed to this Act.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
