The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. The Convention on the Accession of the Kingdom of Spain and the Portuguese Republic to the Convention on the Law Applicable to Contractual Obligations, opened for signature at Rome on 19 June 1980, and Annexes I and II, made at Funchal on 18 May 1992, will come out their full and full effect.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
Given in Brussels on 9 February 1998.

The High Contracting Parties to the Taity establishing the European Economic Community,
Considering that the Kingdom of Spain and the Portuguese Republic, by becoming members of the Community, have pledged to accede to the convention on the law applicable to contractual obligations, open for signature in Rome on 19 June 1980,
Decided to conclude this Convention and designated for this purpose as Plenipotentiaries:

These, gathered within the Council, having exchanged their full powers recognized in due form,
The following provisions have been agreed:
Article 1
The Kingdom of Spain and the Portuguese Republic adhere to the Convention on the Law Applicable to Contractual Obligations, opened for signature in Rome on 19 June 1980.
Article 2
The law agreement applicable to contractual obligations is amended to read:
1. Article 22, paragraph 2, Article 27 and the second sentence of Article 30, paragraph 3, shall be deleted;
2. in section 31, point (d), is retracted by the following text:
“(d) communications under articles 23, 24, 25, 26 and 30; "
Article 3
The Secretary General of the Council of European Communities shall give the Government of the Kingdom of Spain and the Government of the Portuguese Republic a certified copy of the Convention on the Law Applicable to Contractual Obligations in German, English, Danish, French, Greek, Irish, Italian and Dutch.
The text of the Convention on the Law Applicable to Contractual Obligations in Spanish and Portuguese is contained in annexes I and II to this Convention. The text in Spanish and Portuguese shall be in the same way as the other texts of the law applicable to contractual obligations.
Article 4
This Convention is ratified by the signatory States. The instruments of ratification shall be deposited with the Secretary-General of the Council of the European Communities.
Article 5
This Convention comes into force, in the relations between the States that have ratified it, on the first day of the third month following the deposit of the last instrument of ratification by the Kingdom of Spain or the Portuguese Republic and a State that has ratified the Convention on the Law applicable to contractual obligations.
This Convention shall enter into force for each Contracting State which subsequently ratifys it on the first day of the third month following the deposit of its instrument of ratification.
Article 6
The Secretary-General of the Council of European Communities shall notify the States signatories:
(a) the deposit of any instrument of ratification;
(b) the dates of entry into force of this Convention for the Contracting States.
Article 7
This Convention, written in a single copy in the German, English, Danish, Spanish, French, Greek, Irish, Italian, Dutch and Portuguese languages, is deposited in the archives of the Secretary-General of the European Communities. The Secretary-General shall issue a certified copy in accordance with each of the Governments of the signatory States.
