The House of Representatives adopted and sanctioned the following:
CHAPTER 1er
General provisions
Article 1-01-1
This Act regulates a matter referred to in section 74.3 of the Constitution.
Art. 1-01-2
The General Estimates for the fiscal year 1998 are adjusted:
1° with respect to the appropriations provided for the holdings, in accordance with the table annexed to this Act;
2° in respect of appropriations by programme, in accordance with the totals of the programmes in adjusted departmental budgets annexed to this Act.
CHAPTER 2
Special provisions of departments
Section 11
Services of the Prime Minister
Art. 2.11.1
In the text of Article 2.11.3 of the Act of 19 December 1997 containing the General Estimates for the fiscal year 1998, the following provision is added in PROGRAMME 40/3 - SOCIAL PROVENTIONS:
« 5. Contribution to the permanent secretariat of the European Football Championships Coordination Committee in the year 2000. "
Art. 2.11.2
In section 2.11.3 of the Act of 19 December 1997 containing the General Estimates for the 1998 fiscal year, the following subsidies are inserted:
- to PROGRAMME 60/1 - R & D IN THE NATIONAL FRAMEWORK:
« 13. Grant to the asbl "Prince Laurent Foundation".
14. Financing satellite monitoring and security telecommunications programs. »
- in PROGRAMME 60/2 - R & D IN INTERNATIONAL FRAMEWORK:
“9. Grants to the following international organizations:
- European Society for Aquaculture;
- Society for Cognitive Sciences of Music;
- International Federation for Information Processing;
- European Council of the Academy of Fine Arts;
- International Council of Museums. »
Section 13
Ministry of the Interior
Art. 2.13.1
Section 2.13.3 of the Act of 19 December 1997 containing the General Estimates for the fiscal year 1998 is supplemented as follows:
« PROGRAMME 55/0 - SUBSISTANCE
Grants from the Office of Foreigners to international organizations engaged in activities related to foreign policy. "
Art. 2.13.2
The Ministry of the Interior is exempted from recovery, in charge of some officials who were transferred from the Ministry of Justice to 1er January 1994, unduly paid sums, following the non-application of section 24, paragraph 3, of the Royal Decree of 3 November 1993 on enforcement measures relating to the mobility of personnel of certain public services, as amended by the Royal Decree of 23 December 1996:
1) as an allowance granted in the services of the workshops of the Belgian Monitor;
(2) as an allowance granted for the conduct of a motor vehicle.
Art. 2.13.3
The Ministry of the Interior is exempted from the recovery of unduly paid amounts, as an allowance granted for the exercise of a higher function, as a result of the non-application of section 1er of the Royal Decree of 8 August 1983 concerning the exercise of a superior function in the State administrations, as amended by the Royal Decrees of 6 November 1991 and 17 March 1995, of Article 3, § 1eras amended by the Royal Decrees of 25 February 1985 and 20 February 1989, and § 2, as amended by the Royal Decree of 4 August 1996, and Article 4, as amended by the Royal Decrees of 20 February 1989 and 4 August 1996, and provided that these officials have borne actual charges which cannot be considered normal and inherent in their function.
Art. 2.13.4
The means available at 1er January 1998 on the Fund of conscientious objectors, as well as the means received after that date for the same Fund, in accordance with the provisions of the Act of 24 December 1993 creating budgetary funds and amending the Organic Law of 27 December 1990 creating budgetary funds, are disaffected and added to the general resources of the Consolidated Revenue Fund.
Section 14
Ministry of Foreign Affairs
and Foreign Trade
Art. 2.14.1
Section 2.14.6 of the Act of 19 December 1997 containing the General Estimates for the fiscal year 1998 is supplemented as follows:
« PROGRAMME 41/7 - COLLABORATION
INTERNATIONALE
3) Subside to the Europalia Foundation. »
Art. 2.14.2
The Minister of Foreign Affairs is authorized to enter into a transaction as part of the final closing of the Belextel contract. It will be liquidated on the credit in the basic allowance 41/02.12.01.
Section 15
Development cooperation
Art. 2.15.1
The text of section 2.15.2 of the Act of 19 December 1997 containing the General Estimates for the fiscal year 1998 is amended as follows:
"The liquidated expenses of the permanent working capital, provided in 1996 by the basic allowance 54.09.03.50, are regulated without delay by imputation on the following basic budgetary allocations: 54.02.12.01, 54.02.12.27, 54.02.35.50, 54.11.35.11, 54.14.54.40, 54.14.54.41, 54.50.35.50 and 54.62. »
Art. 2.15.2
Treatment for the period 1er April 1995 to 30 November 1996, liquidated to Madame Fabienne Coverur, whose promotion to the rank of councillor was cancelled by Decision No. 68.774 of 9 October 1997 of the Council of State, was maintained for that period.
The treatment of Madame Fabienne Coverur, for the period 1er December 1996 to 31 December 1997, whose promotion to the rank of first adviser was reported by the Royal Decree of 17 December 1997 is maintained for that period.
These provisions remain without effect on the advancement of grade, baremic advancement and treatment of interest.
Section 16
Ministry of National Defence
Art. 2.16.1
In section 2.16.13, first paragraph of the Act of 19 December 1997 containing the General Estimates for the fiscal year 1998, the amount of 640 million francs is replaced by the amount of 850 million francs.
This same article is supplemented by the following provision:
The Minister of National Defence is authorized, in the same markets, to use refunds collected for the sale of F-16 aircraft by the United States, to third countries ("coupments for tooling"), up to 79.0 million francs. "
Art. 2.16.2
Section 2.16.14, first paragraph of the Act is replaced by the following:
"In accordance with Article 150 of the Act of 26 June 1992 on social and other provisions, the Minister of National Defence is authorized to use within the limits of revenues from the alienation of immovable property that are part of the real estate entrusted to his management, collected and accounted for 87.07.04.28.B of the section "Treasury Order Operations" to contract in 1998, for a new profit of 10 million francs Payments are limited to 200.0 million francs for the fiscal year. "
Art. 2.16.3
In section 2.16.20, second paragraph of the Act, the amount of permits of 1,300 million francs for investments is replaced by the amount of 2,200 million francs and the amount of 1,400 million francs for payments is replaced by the amount of 600 million francs.
Section 19
Ministry of Public Service
Art. 2.19.1
Section 2.19.8 of the Act of 19 December 1997 containing the General Estimates for the 1998 fiscal year, the amount of CHF 1,420,000 is replaced by the amount of CHF 2,624,000.
Art. 2.19.2
The Régie des buildings is authorized to make expenditures for the installation of an electronic surveillance system in the royal palaces of Belvedere, Stuyvenberg and Châteauneuf.
Section 21
Pensions
Art. 2.21.1
In section 2.21.3, second paragraph, of the Act of 19 December 1997 containing the General Estimates for the fiscal year 1998, the amount of 5,300.0 million is replaced by the amount of 6,300.0 million francs.
Section 23
Ministry of Employment and Labour
Art. 2.23.1
Section 2.23.3 of the Act of 19 December 1997 containing the General Estimates for the fiscal year 1998 is supplemented as follows:
« PROGRAMME 56/5 - REGIED
TRANSPORT MARITIMES
- Grant to the Maritime Transport Regime to cover the expenses inherent in the treatment of the statutory personnel occupied by the ONem. »
Section 31
Ministry of Average Class and Agriculture
Art. 2.31.1
The Minister with agricultural responsibility is authorized to pay in 1998 the annual pension for occupational disease of 260,000 francs, referred to in the decision of the Board of Directors of the National Board of Agricultural and Horticultural Disposals of 22 September 1994.
Art. 2.31.2
Expenditures on claims of prior years under the State's annual subsidy for the various regimes and sectors of the Social Status of Independent Workers may be charged against the credits of the current year.
Section 32
Ministry of Economic Affairs
Art. 2.32.1
Section 2.32.4 of the Act of 19 December 1997 on the General Estimates for the 1998 fiscal year is amended as follows:
PROGRAMME 70/2 - R. " D. TO THE INTERNATIONAL
Under item 1), "Eurotechalert Grant" is replaced by "Research in the area of fusion and related research".
Section 33
Ministry of Communications and Infrastructure
Art. 2.33.1
Section 2.33.4 of the Act of 19 December 1997 containing the General Estimates for the fiscal year 1998, all provisions concerning Program 53/0 - Subsistence are repealed.
In this section 2.33.4 of the Act, Program 53/2 - Merchant Navy, is supplemented by the following text:
« 6) International Permanent Association of Congresses of Navigation. »
This section 2.33.4 of the Act is supplemented by the following:
« PROGRAMME 53/5 - TRANSPORT REGION MARITIMES
Intervention in the salaries of gtr contractors, occupied by the Ostende CPAS.
PROGRAMME 56/4 - PROMOTION
ROAD SECURITY
Grants to organizations or institutions in the context of actions or days of road safety studies. »
Art. 2.33.2
The budget of the Belgian Institute of Postal Services and Telecommunications of 1998 is approved to this Act.
This budget is for revenues of 1,119,200,000 francs and for expenditures of 1,119,200,000 francs.
It includes in expenditure the commitment credits for an amount of 41.000.000 francs.
Section 51
Public debt
Art. 2.51.1
By derogation from Article 7 § 2 of the State Accounting Laws, coordinated on 7 July 1991, the appropriations for the basic allowance 51.45.04.5103 for the State's coverage of the exchange guarantees granted to the SNCI in the execution of the so-called economic expansion laws are separated into credits of commitment and ordering.
CHAPTER 3
Restitution and allocation funds
Art. 3-01-1
Table 3 annexed to this Act replaces Table 3 - Restitution and allocation funds, annexed to the Act of 19 December 1997 containing the General Estimates for the 1998 fiscal year.
CHAPTER 4
Separate Management State Services
Art. 4-01-1
The operations during the 1998 fiscal year of the Autonomous Farms (Justice), the Prison Labour Authority (Justice), the Monetary Fund (Finance) and the Permanent Recruitment Secretariat (Public Service) are revalued to the sums mentioned in their respective budgets annexed to this Act.
Art. 4-01-2
During the 1996 fiscal year, the Monetary Fund is authorized to pre-finance, on behalf of the Royal Belgian Mint, the amounts required to carry out other work than national monetary manufacturing.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
