12 FEBRUARY 1999. - An Act to insert an article 15ter in the Act of 4 July 1989 relating to the limitation and control of election expenses incurred for the elections of the Federal Chambers, as well as to the financing and open accounting of political parties and an article 16bis in the laws of the Council of State, coordinated on 12 January 1973 (1)

The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. An article 15ter, which reads as follows, is included in the Act of 4 July 1989 on the limitation and control of election expenses incurred for the elections of the Federal Chambers, as well as the financing and open accounting of political parties:
"Art. 15ter. § 1er. When a political party by its own fact or by that of its components, its lists, its candidates, or its elected agents, shows clearly and through several indices concordant its hostility towards the rights and freedoms guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950, approved by the law of 13 May 1955, and by the additional protocols to this Convention in force in Belgium, the endowment, which by virtue
Any complaint filed by at least five members of the Supervisory Board must be addressed directly to the State Council. The complaint thus transmitted indicates the subject matter of the application, the alleged perpetrator of the offence, the detailed description of the offence and, where applicable, its method of financing. The Council of State shall, within two months of its referral, give a duly reasoned decision and may decide to remove the endowment which, under this chapter, is allocated to the institution referred to in Article 22, or to a maximum of twice the amount of expenses financed or realized for the performance of that act, or for a period not less than three months or more than one year.
§ 2. A cassation appeal against the decision of the Council of State is opened before the Court of Cassation within thirty days. This appeal has no suspensive effect.
§ 3. The procedure as well as the procedure for hearing the persons concerned shall be determined by royal decree deliberated in the Council of Ministers. "
Art. 3. An article 16bis, which reads as follows, is inserted in the laws of the Council of State coordinated on 12 January 1973:
"Art. 16bis. The section makes decisions on complaints filed under section 15ter of the Act of 4 July 1989 on the limitation and control of election expenses incurred in the elections of the Federal Chambers, as well as on the financing and open accounting of political parties. »
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
