To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. Article 10bis of the Act of 31 December 1983 of institutional reforms for the German-speaking Community, inserted by the Act of 16 July 1993, is supplemented by paragraphs 2 and 3, as follows:
"The term of membership of the Council of the German-speaking Community cannot be accumulated with more than one paid executive mandate.
Are condensed as paid executive mandates within the meaning of the preceding paragraph:
1° the mandates of bourgmestre, chevin and president of a social assistance council, regardless of the income thereto;
2° any mandate exercised within a public or private body, as a representative of the State, community, region, province or municipality, provided that this mandate gives more power than the mere membership of the general assembly or board of directors of that body and whatever income it may have;
3° any mandate exercised within a public or private body, as a representative of the State, community, region, province or municipality, provided that the taxable gross monthly income in respect of the corporation reaches a minimum of 20,000 francs. This amount is adapted annually to the evolution of the Consumer Price Index. "
Art. 3. an article 14bis is inserted in the same law, which reads as follows:
"Art. 14bis. The amount of compensation, salary or token of presence received in return for the activities of the member of the Council of the Germanophical Community outside his or her mandate to advise shall not exceed half the amount of compensation awarded to members of the House of Representatives.
For the calculation of this amount, the allowances, salaries or attendance tokens arising from the exercise of a political mandate, function or public office are considered.
If the ceiling set out in paragraph 1er is exceeded, the allowance set out in section 14 is reduced, except where the term of membership of the Council of the German-speaking Community is accumulated with a term of bourgmestre, chevin or president of a social assistance council. In this case, it is the treatment of bourgmestre, chevin or president of a social assistance council that is diminished.
Where activities referred to in subparagraphs 1er and 2 begin or end in the course of the parliamentary mandate, the adviser informs the president of his assembly.
The Commission shall arrange in its regulations the terms and conditions for the execution of these provisions. »
Art. 4. This Act comes into force on January 31, 2001.
Promulgation of this law, let us order that it be clothed with the seal to the State and published by the Belgian Monitor.
