Article 1^er. This Act regulates a matter referred to in Article 77 of the Constitution.
CHAPTER I^er. - Protocol amending the Agreement of 9 February 1994 on the collection of a right of use for the use of certain roads by heavy-duty vehicles, given the implementation of Directive 1999/62/EC of the European Parliament and the Council of the European Union of 17 June 1999 on the taxation of heavy-duty vehicles for the use of certain infrastructures
Art. 2. The Protocol amending the Agreement of 9 February 1994 on the collection of a right of use for the use of certain roads by heavy-duty vehicles, given the implementation of Directive 1999/62/EC of the European Parliament and the Council of the European Union of 17 June 1999 on the taxation of heavy-duty vehicles for the use of certain infrastructures, signed in Brussels on 22 March 2000 by the Governments of the Kingdom of Belgium, the Kingdom of Denmark,
CHAPTER II. - Eurovignette
Art. 3. Article 7 of the Act of 27 December 1994 enacting the Agreement on the Collection of a Right of Use for the Use of Certain Roads by Heavy Duty Vehicles, signed in Brussels on 9 February 1994 by the Governments of the Kingdom of Belgium, the Kingdom of Denmark, the Federal Republic of Germany, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands and the Kingdom of Sweden, and instaurant9/
“Art. 7. The annual eurovignette, including administrative costs, is for vehicles:
The daily eurovign, including administrative costs, is, for all vehicle categories, set at EUR 8.00. »
Art. 4. Article 7bis, as follows, is inserted in the same law:
"Art. 7bis. For vehicles registered in Greece, the amounts of the eurovignette referred to in Article 7 are reduced by half, for a transitional period of two years, ending June 30, 2002.
This transitional period may, with the authorization of the European Commission, be extended from year to year. » .
Art. 5. In section 12 of the Act, the words "25 epics" are replaced by the words "25,00 EUR".
Art. 6. In section 13 of the Act, the words "250 ECUs" are replaced by the words "250,00 EUR".
Art. 7. Section 15 of the Act is repealed.
CHAPTER III. - Entry into force
Art. 8. Section 4 of this Act produces its effects on 1^er July 2000.
Articles 2, 3 and 5 to 7 produce their effects on 1^er January 2001.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.

Protocol Amending the Agreement of 9 February 1994 on the Collection of a Right of Use for the Use of Certain Roads by Heavy Duty Vehicles, as the Directive 1999/62/EC of the European Parliament and the Council of the European Union of 17 June 1999 on the Taxation of Heavy Duty for the Use of Certain Infrastructures
The Governments of the Federal Republic of Germany, the Kingdom of Belgium, the Kingdom of Denmark, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands and the Kingdom of Sweden,
Contracting Parties to the Agreement of 9 February 1994 on the Collection of a Right of Use for the Use of Certain Roads by Heavy Duty Vehicles, as amended by the Protocol of 18 September 1997 on the accession of the Kingdom of Sweden to the Agreement referred to below as "the Agreement"
Considering the adoption of Directive 1999/62/EC of the European Parliament and the Council of the European Union of 17 June 1999 on the taxation of heavyweights for the use of certain infrastructures, referred to as "the Directive"
Considering the joint declaration of the Governments of Belgium, Denmark, Germany, Luxembourg, the Netherlands and Sweden to implement all efforts to align their common right of use with the new maximum rates provided for in Article 7, paragraph 7 and Annex II to the Directive, made at 2142^e session of the Council of the European Union of 30 November and 1^er December 1998 agreed as follows:
Article 1^er
The first consideration of the Preamble to the Agreement is replaced by:
"In light of Directive 1999/62/EC of the European Parliament and the Council of the European Union of 17 June 1999 on the taxation of heavyweights for the use of certain infrastructures, replacing Directive 93/89/EEC of the Council of the European Communities of 25 October 1993,".
After the second considering a third consideration is added:
"In view of the joint declaration of the Governments of Belgium, Denmark, Germany, Luxembourg, the Netherlands and Sweden to implement all efforts to align their common right of use with the new maximum rates provided for in Article 7, paragraph 7 and Appendix II of the Directive, made at 2142^e session of the Council of the European Union of 30 November and 1^er December 1998".
Article 2
Article 2, paragraph 1^er, of the Agreement is replaced by:
"The definitions required in Article 2 of Directive 1999/62/EC of the European Parliament and the Council of the European Union of 17 June 1999 on the taxation of heavyweights for the use of certain infrastructures apply to this Agreement. »
Article 3
Article 3, paragraph 1^erfrom the Agreement the words "the procedure of Article 9 of the Directive" are replaced by:
"the procedure of Article 7, paragraph 2, point b, ii, of the Directive."
In paragraph 2 the words "Article 7, point d, of the Directive" are replaced by:
“Article 7, paragraph 2, point b, i, of the Directive”.
In paragraph 3, the words “article 7, point e of the Directive” are replaced by:
"Article 7, paragraph 6, of the Directive."
Article 4
Article 4, paragraph 2, of the Agreement is replaced by:
"In their respective territory, Contracting Parties to the Agreement may exempt vehicles listed in Article 6, paragraph 2 (b), from the Directive on the Right of Use referred to in Article 3. "
Article 5
Article 8, paragraph 1^er, of the Agreement is replaced by:
"The annual right of use, including administrative costs, is for vehicles:
1. to three axles:
a. NON-EURO : 960 euro,
b. EURO I: 850 euro,
c. EURO II and less polluting: 750 euro.
2. four axles or more:
a. NON-EURO : 1550 euro,
b. EURO I: 1400 euro,
c. EURO II and less polluting: 1250 euro. »
Paragraph 2 is replaced by:
"The monthly right of use, including administrative costs, is for vehicles:
1. to three axles:
a. NON-EURO : to 96 euro,
b. EURO I: 85 euro,
c. EURO II
and less polluting: 75 euro.
2. four axles or more:
a. NON-EURO : à 155 euro,
b. EURO I: 140 euro,
c. EURO II and less polluting: 125 euro. »
Paragraph 3 is replaced by:
"The weekly usage fee, including administrative costs, is for vehicles:
1. to three axles:
a. NON-EURO : 26 euro,
b. EURO I: 23 euro,
c. EURO II and less polluting: 20 euro.
2. four axles or more:
a. NON-EURO : 41 euro,
b. EURO I: 37 euro,
c. EURO II and less polluting: 33 euro. »
Paragraph 4 is replaced by:
"The right of daily use, including administrative costs, is, for all categories of vehicles, set at 8 euro. »
Paragraph 5 is replaced by:
"For vehicles registered in Greece, the right of use referred to in paragraphs 1 to 4 is, for a period of two years after the entry into force of the Directive, reduced by half. The Contracting Parties to this Agreement may decide to extend the transitional period from year to year provided that the European Commission authorizes such an extension. »
Paragraph 7 is replaced by:
"For the purposes of this Agreement, the exchange rate of the euro in the various national currencies is fixed in accordance with Article 10 of the Directive. »
Article 6
Article 10, paragraph 2, last sentence of the Agreement is replaced by:
"A 25 euro administrative fee is charged for the review of the refund request. »
Article 7
In Article 13, paragraph 2, of the Agreement the line
"A = annual usage fee of 1250 ECU" is replaced by:
"A = annual usage fee of 1250 euro".
Article 8
In the French version of Article 20 of the Agreement, the date "December 31, 2010" is replaced by: "December 31, 2019".
Article 9
1. This Protocol enters into force on the first day of the month following the last date on which the respective Governments notified the European Commission in writing by diplomatic means that the constitutional requirements necessary for its entry into force in their respective States are met.
2. The Depositary shall transmit to the Government of all Contracting Parties to the Agreement the notifications referred to in paragraph 1^er and the effective date of this Protocol.
Done in Brussels on 22 March 2000 in the German, Danish, French, Dutch and Swedish language, each text being equally authentic, in an original deposited in the archives of the European Commission; a certified true copy shall be transmitted to each Contracting Party.

Juni 1999 über die Erhebung von Gebühren für die Benutzung bestimmter Verkehrswege durch schwere Nutzfahrzeuge
Die Regierungen des Königreichs Belgien, des Königreichs Dänemark, der Bundesrepublik Deutschland, des Grossherzogtums Luxem-burg, des Königreichs der Niederlande und des Königreichs Schweden,
die Vertragsparteien des Übereinkommens vom 9. Februar 1994 über die Erhebung von Gebühren für die Benutzung bestimmter Strassen mit schweren Nutzfahrzeugen in der Fassung des Protokolls vom 18. September 1997 über den Beitritt des Königreichs Schweden zu dem genannten Übereinkommen, im Folgenden als « Übereinkommen » bezeichnet, sind-
aufgrund der Annahme der Richtlinie 1999/62/EG des Europäischen Parlaments und des Rates der Europäischen Union vom 17. Juni 1999 über die Erhebung von Gebühren für die Benutzung bestimmter Verkehrswege durch schwere Nutzfahrzeuge, im Folgenden als « Richtlinie » bezeichnet,
in Anbetracht der auf der 2142. Tagung des Rates der Europäischen Union vom 30. November und 1. Dezember 1998 abgegebenen gemeinsamen Erklärung der Regierungen Belgiens, Dänemarks, Deutschlands, Luxemburgs, der Niederlande und Schwedens, alles zu tun, um ihre gemeinsame Benutzungsgebühr den in Artikel 7 Absatz 7 und in Anhang II
Artikel 1
Der erste Beweggrund der Präambel des Übereinkommens wird ersetzt durch:
« aufgrund der Richtlinie 1999/62/EG des Europäischen Parlaments und des Rates der Europäischen Union vom 17. Juni 1999 über die Erhebung von Gebühren für die Benutzung bestimmter Verkehrswege durch schwere Nutzfahrzeuge, die die Richtlinie 93/89/EWG des Rates der Europäischen Gemeinschaften vom 25. Oktober 1993 ersetzt."
Nach dem zweiten Beweggrund wird ein dritter Beweggrund angefügt:
"aufgrund der auf der 2142. Tagung des Rates der Europäischen Union vom 30. November und 1. Dezember 1998 abgegebenen gemeinsamen Erklärung der Regierungen Belgiens, Dänemarks, Deutschlands, Luxemburgs, der Niederlande und Schwedens, alles zu tun, um ihre gemeinsame Benutzungsgebühr den in Artikel 7 Absatz 7 und in Anhang II
Artikel 2
Artikel 2 Absatz 1 of the Übereinkommens wird ersetzt durch:
« Es gelten die Begriffsbestimmungen des Artikels 2 der Richtlinie 1999/62/EG des Europäischen Parlaments und des Rates der Europäischen Union vom 17. Juni 1999 über die Erhebung von Gebühren für die Benutzung bestimmter Verkehrswege durch schwere Nutzfahrzeuge. »
Artikel 3
In Artikel 3 Absatz 1 Übereinkommens werden die Worte « Verfahren nach Artikel 9 der Richtlinie » ersetzt durch:
"Verfahren nach Artikel 7 Absatz 2 Buchstabe b Ziffer ii der Richtlinie".
In Absatz 2 werden die Worte « Artikel 7 Buchstabe d der Richtlinie » ersetzt durch:
"Artikel 7 Absatz 2 Buchstabe b Ziffer i der Richtlinie".
In Absatz 3 werden die Worte « Artikel 7 Buchstabe e der Richtlinie » ersetzt durch:
"Artikel 7 Absatz 6 der Richtlinie".
Artikel 4
Artikel 4 Absatz 2 of the Übereinkommens wird ersetzt durch:
"Jede Vertragspartei kann für ihr Hoheitsgebiet Kraftfahrzeuge, die in Artikel 6 Absatz 2 Buchstabe b der Richtlinie bezenet sind, von der Gebühr nach Artikel 3 befreien. "
Artikel 5
Artikel 8 Absatz 1 of the Übereinkommens wird ersetzt durch:
« Die Gebühr einschliesslich der Verwaltungskosten für ein Jahr beträgt für Kraftfahrzeuge
1. mit bis zu drei Achsen
a. ohne EURO-Einstufung 960 Euro
b. EURO I 850 Euro
c. EURO II und schadstoffärmer 750 Euro
2. mit vie oder mehr Achsen
a. ohne EURO-Einstufung 1550 Euro
b. EURO I 1400 Euro
c. EURO II und schadstoffärmer 1250 Euro. »
Absatz 2 wird ersetzt durch:
« Die Gebühr einschliesslich der Verwaltungskosten für eine Monat beträgt für Kraftfahrzeuge
1. mit bis zu drei Achsen
a. ohne EURO-Einstufung 96 Euro
b. EURO I 85 Euro
c. EURO II und schadstoffärmer 75 Euro
2. mit vie oder mehr Achsen
a. ohne EURO-Einstufung 155 Euro
b. EURO I 140 Euro
c. EURO II und schadstoffärmer 125 Euro. »
Absatz 3 wird ersetzt durch:
« Die Gebühr einschliesslich der Verwaltungskosten für eine Woche beträgt für Kraftfahrzeuge
1. mit bis zu drei Achsen
a. ohne EURO-Einstufung 26 Euro
b. EURO I 23 Euro
c. EURO II und schadstoffärmer 20 Euro
2. mit vie oder mehr Achsen
a. ohne EURO-Einstufung 41 Euro
b. EURO I 37 Euro
c. EURO II und schadstoffärmer 33 Euro. »
Absatz 4 wird ersetzt durch:
« Die Gebühr einschliesslich der Verwaltungskosten für einen Tag beträgt für alle Fahrzeugklassen einheitlich 8 Euro. »
Absatz 5 wird ersetzt durch:
"Für Kraftfahrzeuge, die in Griechenland zugelassen sind, wird die Gebühr nach den Absätzen 1 bis 4 für einen Zeitabschnitt von zwei Jahren nach Inkrafttreten der Richtlinie um die Hälfte verringert. Die Vertragsparteien dieses Übereinkommens können beschliessen, die Übergangszeit um jeweils ein Jahr zu verlängern, sofern die Europäische Kommission eine solche Verlängerung genehmigt. »
Absatz 7 wird ersetzt durch:
"Für die Zwecke dieses Übereinkommens wird der Kurs für die Umrechnung des Euro in die verschiedenen Landeswährungen nach Artikel 10 der Richtlinie festgelegt. »
Artikel 6
Artikel 10 Absatz 2 Satz 2 of the Übereinkommens wird ersetzt durch:
"Für die Bearbeitung des Erstattungsantrags wird eine Verwaltungsgebühr von 25 Euro erhoben. »
Artikel 7
In Artikel 13 Absatz 2 of the Übereinkommens wird die Zeile
"A = Jahresgebühr in Höhe von 1250 ECU" ersetzt durch:
"A = Jahresgebühr in Höhe von 1250 Euro; "
Artikel 8
Im französischen Wortlaut des Artikels 20 des Übereinkommens wird das datum « 31 décembre 2010 » durch « 31 décembre 2019 » ersetzt.
Artikel 9
1. Dieses Protokoll tritt am ersten Tag des Monats in Kraft, der auf den letzten Tag folgt, an dem die jeweiligen Regierungen der Kommission der Europäischen Union auf diplomatischem Weg schriftlich mitgeteilt haben, dass die in ihrem jeweiligen Staat erforderlichen verfa
2. Der Verwahrer übermittelt den Regierungen aller Vertragsparteien des Übereinkommens die in Absatz 1 bezeichneten Mitteilungen und teilt ihnen den Tag des Inkrafttretens dieses Protokolls mit.
Geschehen zu Brüssel am 22 März 2000 in dänischer, deutscher, französischer, niederländischer und schwedischer Sprache, wobei jeder Wortlaut gleichermassen verbindlich ist, in einer Urschrift, die im Archiv der Kommission der Europäischen Union hinterlegt diese übermittelt jeder Vertragspartei eine beglaubigte Abschrift.
