ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. Article 1er of the Law on the Suppression or Restructuring of Public Interest Organizations and Other State Services, coordinated on 13 March 1991, the following amendments are made:
A) at 1°, the words "and 16 July 1993" are replaced by the words "July 16, 1993 and July 13, 2001";
B) at 2°, the words "Special Law of 16 July 1993" are replaced by the words "Special Laws of 16 July 1993 and 13 July 2001".
Art. 3. In the same Act, Title III is supplemented by a chapter IX, entitled: "The heritages instituted with certain state scientific institutions that come from the Ministry of Average Classes and Agriculture", including an article 26ter, as follows:
"Art. 26ter . § 1er. The heritages established at the Centre de Recherches Agronomiques in Ghent, the Centre de Recherches agronomiques in Gembloux and the Centre d'Economie agricole, which have the legal personality, are removed on the date fixed by the King.
§ 2. Within the limits established by the special law and by the special law of financing, the King shall rule the dissolution of the assets constituted as legal persons referred to in § 1er and any questions to which the latter is involved, including the transfer to the Walloon Region and the Flemish Region of personnel, property, rights and obligations that fall under these assets.
§ 3. The royal decrees referred to in § 2 shall determine, after consultation with the representative organizations of the staff, the modalities for the transfer of the staff and the measures necessary to guarantee their rights, in accordance with the principles referred to in Article 88, § 2, paragraphs 2 to 4, of the special law.
§ 4. Royal decrees referred to in §§ 1er at 3 are deliberated in the Council of Ministers, after the advice of the Governments concerned. »
Art. 4. In the same Act, Title III is supplemented by a chapter X entitled "The Belgian Office of Foreign Trade", including an article 26quater, as follows:
"Art. 26quater . § 1er. The Belgian Foreign Trade Office, referred to as the Office, is deleted on the date fixed by the King.
As soon as it is abolished, Article 2, § 2, applies to it.
§ 2. Within the limits laid down by the special law and by the special law of financing, the missions to the Office are transferred to the Walloon Region, the Flemish Region and the Brussels-Capital Region, each with respect to it.
§ 3. Within the limits set out in § 2, the King rules the dissolution of the Office and the transfer of staff members as well as the goods, rights and obligations of the Office, the Walloon Region, the Flemish Region and the Brussels-Capital Region, each with respect to it and to the Agency for Foreign Trade created by the cooperation agreement between the federal authority and the regions of May 24, 2002 relating to the creation of the Agency.
§ 4. The King may, by order deliberately in the Council of Ministers, transfer staff from the Office to the Federal Public Service Foreign Affairs, Foreign Trade and Development Cooperation.
§ 5. The royal decrees referred to in §§ 3 and 4 shall determine, after consultation with the representative organizations of the staff, the modalities for the transfer of the staff and the measures necessary to guarantee their rights, in accordance with the principles referred to in article 88, § 2, paragraphs 2 to 4, of the special law.
§ 6. Royal decrees referred to in §§ 1er and 3 are deliberated in the Council of Ministers after the advice of the Governments of the region concerned. »
Art. 5. Section 28 of the Act is repealed.
Art. 6. This Act comes into force on the day of its publication in the Belgian Monitor.
Promulgate this provision, order that it be coated with the seal of the State and published by the Belgian Monitor.
