10 JULY 2002. - An Act to amend, with respect to the overall financial budget for clinical biology and medical imaging, the Act respecting compulsory health care and allowances, coordinated on July 14, 1994 (1)

To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. Section 59 of the Compulsory Health Care and Compensation Insurance Act, coordinated on 14 July 1994, amended by the Acts of 12 August 2000, 2 January 2001, 19 July 2001, 30 December 2001 and 14 January 2002, are amended as follows:
1° the last sentence of paragraph 2 is replaced by the following provision: "From 1er July 2002, is also added half of the amount that corresponds to the algebraic difference between the overall financial resources budget and the expenditures recorded by the insurers for the benefit in question, recorded in the year 2001; the other half was added in the first six months of 2003. By derogation from the provisions of paragraph 5, the difference recorded in 2001 is incorporated into the lump sum amounts by prescription provided to non-hospitable beneficiaries as determined by the Health Care Insurance Committee; the rate of adaptations is determined by the General Council, after the advice of the Budget Control Board, and is carried out ex officio. From 2003 is added annually in the last six months half of the algebraic difference recorded the previous year; the other half is added in the first six months of the following year »;
2° Paragraph 3 is replaced by the following provision: "In the portion of the hospitalized recipients is added, in the year 2002, the amount that corresponds to the algebraic difference between the overall financial resources budget and the expenditures recorded by the insurers for the benefits in question, recorded in the years 1999 and 2000. In addition, from 1er July 2002, is added half of the amount that corresponds to the algebraic difference recorded in the year 2001; the other half was added in the first six months of 2003. By derogation from the provisions of paragraph 5, the difference in 2001 is incorporated into the lump sum amounts per day and per admission for hospitalized beneficiaries, as set by the Health Care Insurance Committee; the rate of adaptations is determined by the General Council, after the advice of the Budget Control Board, and is carried out ex officio. From 2003 is added annually in the last six months half of the algebraic difference recorded the previous year; the other half is added in the first six months of the following year. » .
Art. 3. Article 69, § 1erParagraph 2, last sentence, of the Act, as amended by the Acts of 20 December 1995 and 19 July 2001, is replaced by the following provision:
"From 2002 is added to the budget distributed annually in the last six months half of the algebraic difference recorded in the previous year; the other half is added in the first six months of the following year. For the incorporation of the differences recorded in 2001, the same procedure as for the incorporation of the 2001 differences in clinical biology is applied. »
Art. 4. The provisions of this Act shall apply for the first time on the algebraic differences of 2001.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
