20 SEPTEMBER 2002. - An Act to replace, with a view to ensuring the assistance of the accused by a lawyer, section 293 of the Code of Criminal Investigation



ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. Section 293 of the Code of Criminal Investigation, replaced by the Act of 30 June 2000, is replaced by the following provision:
“Art. 293. At least fifteen days before the opening of the session and no later than the day of the first hearing, the President will verify whether the accused has chosen counsel to assist him in his defence. Otherwise, the president will appoint him an instant, barely nullity of all that follows.
This designation will be considered non-agreement, and nullity will not be pronounced if the accused chooses counsel.
The president may question the accused. In this case, the interrogation is found by a record that the president, the clerk, the accused, and, where appropriate, the interpreter sign. »
Given in Brussels on 20 September 2002.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
