Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. The Protocol amending Articles 1(a) , 14(1) and 14(3)(b) of the European Agreement of 30 September 1957 concerning the International Carriage of Dangerous Goods by Road (ADR), signed in Geneva on 28 October 1993, will be issued its full and complete effect.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.

PROTOCOL APPENDIX AMENDMENTS TO ARTICLES 1 (a) , 14 (1) and 14(3) (b) OF THE EUROPEAN ACORD OF 30 SEPTEMBER 1957 RELATING TO THE INTERNATIONAL TRANSPORT OF DANGEROUS GOODS BY ROAD (ADR)
The parties to this Protocol,
Having considered the provisions of the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR), dated 30 September 1957 (hereinafter referred to as the Agreement), with regard to the definition of the term "vehicle" in Article 1(a) and the procedure for amending the Annexes to the Agreement, and in particular the provisions of Article 14 (1) of the Agreement;
Noting with respect to the procedure for amending the annexes that Contracting Parties to the Agreement may encounter difficulties in implementing, within the time limit provided for in Article 14 (3) of the Agreement, the internal measures required by the taking of effect of the amendments;
Noting on the other hand the views expressed by the Working Group on the Transport of Dangerous Goods of the Inland Transport Committee of the United Nations Economic Commission for Europe, and the proposals of the Governments of Austria and France to amend the Agreement;
Convince of the following:
Article 1er
Amendment to Article 1(a) of the Agreement
Article 1er (a) of the Agreement is amended to read as follows:
"(a) by "vehicle", any motor vehicle, other than a vehicle belonging to the armed forces of a Contracting Party or under their responsibility, which is intended to circulate on the road, complete or incomplete, with at least four wheels and whose maximum speed by construction is greater than 25 kilometres per hour, as well as its trailers - except for vehicles that move on track, tractors and trailers »
Article 2
Amendment of Article 14 (1) of the Agreement
Section 14, subsection (1) of the Agreement is amended to read as follows:
“1. Notwithstanding the review procedure provided for in Article 13, any Contracting Party may propose one or more amendments to the annexes to this Agreement. To that end, it will transmit the text to the Secretary-General of the United Nations. The Secretary-General may also propose amendments to the Annexes to this Agreement in order to ensure consistency with other international agreements on the transport of dangerous goods.
It may also propose amendments to the annexes to this Agreement adopted by the Working Party on the Transport of Dangerous Goods of the Inland Transport Committee of the Economic Commission for Europe, at the request of this Group. "
Article 3
Amendment of Article 14 (3) (b) of the Agreement
Section 14, subsection (3)(b) of the agreement is amended to read as follows:
“(b) The Contracting Party or, as the case may be, the Secretary-General submitting the draft amendment in accordance with paragraph 1er of this Article, may specify in the proposal a period of more than three months for the entry into force of the amendment in the case it would be accepted. »
Article 4
Signature, ratification, acceptance, approval or accession
1. Contracting Parties to the Agreement may become Contracting Parties to this Protocol:
(a) signing it
(b) by depositing an instrument of ratification, acceptance or approval upon signature subject to ratification, acceptance or approval;
(c) by placing an instrument of accession.
2. This Protocol is open for signature at the Office of the Executive Secretary of the Economic Commission for Europe, Geneva, from 28 October 1993 to 31 January 1994.
Article 5
Depositary
Instruments of ratification, acceptance, approval or accession shall be deposited with the Secretary-General of the United Nations.
Article 6
Entry into force
This Protocol shall enter into force one month after the date on which all Contracting Parties to the Agreement have signed it subject to ratification, acceptance or approval or have deposited their instruments of ratification, acceptance, approval or accession, as the case may be.
Article 7
Any State that becomes a Party to the Agreement after it has been satisfied with the conditions of entry into force of this Protocol under Article 6 shall be considered as a Contracting Party to the Agreement as amended by the Protocol.
Article 8
The original of this Protocol, of which the English and French texts are equally authentic, will be deposited with the Secretary-General of the United Nations.
