The Chambers adopted and We sanction the following:
Article 1
er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. Section 140 of the Compulsory Health Care and Compensation Insurance Act, coordinated on 14 July 1994, as amended by the Program Act of 24 December 2002, is amended as follows:
1° in paragraph 3, the last sentence is deleted;
2° paragraphs 7 and 8 are replaced by the following:
"For the purposes of Article 141, §§ 2, 3 and 5, the President or, in the absence of a Vice-President, and the members shall have a deliberative vote as follows:
- Each member referred to in paragraph 1
er, 1°, 3° and 4°, has a voice.
- Each member referred to in paragraph 1
er, 2°, disposes of a vote, except where matters relating to dispensators belonging to one of the categories set out in paragraph 1 are examined
er5° to 21°. In these cases, the group of representatives of the insurers has one voice.
- Each group consisting of representatives of organizations and associations referred to in paragraph 1
er, 5° to 21°, of this article has one voice.
- With respect to the other tasks set out in section 141, only the President and members referred to in paragraph 1
er, 2°, 3° and 4°, have a deliberate voice. They each have a voice.
Decisions shall be taken by a simple majority of the participants in the voting, taking into account the abstentions. »
Art. 3. This Act is effective February 15, 2003.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
