The House of Representatives adopted and sanctioned the following:
CHAPTER 1er. - General provisions
Art. 1-01-1
This Act regulates a matter referred to in Article 74, 3° of the Constitution.
Art. 1-01-2
The General Estimates for the 2004 Budget Year are adjusted:
1° with respect to the appropriations provided for the Dots, in accordance with the table annexed to this Act;
2° in respect of appropriations by programme, in accordance with the totals of the programmes in adjusted departmental budgets annexed to this Act.
CHAPTER 2. - Special provisions of the Departments
Section 03. - SPF Budget and Management Control
Art. 2.03.1
The provision of a provision of €50.000,000, under programme 41/1, is intended to cover expenditures relating to Belgian participation in space projects, as well as to the modernization of federal and other accounts may, after agreement of the Minister of Budget, be allocated as necessary, by Royal Decree, between the appropriate programmes of the budgets of the departments concerned.
Section 04. - Personal SPF and Organization
Art. 2.04.1
Section 2.04.2 of the Act of 22 December 2003 containing the General Estimates for the 2004 Budget Year is replaced by the following:
Within the limits of the basic allowances concerned, the following grants may be awarded:
PROGRAMME 21/0
DIRECTION AND MANAGEMENT
Grant to the ABL Social Service of the Ministry of Public Service.
PROGRAMME 31/1
PERSONNEL AND ORGANIZATION
Grants supporting initiatives for agents for the exchange of professional knowledge, the improvement of staff culture, cultural diversity and the organization, and the updating of knowledge related to important social developments and their impact on the operation of the administrative apparatus.
PROGRAMME 31/2
FORMATION OF AGENTS
1° Contribution to the International Institute of Administrative Sciences;
2° Contribution to the European Institute of Public Administration in Maastricht;
3° Intervention for training activities organized by representative trade union organizations.
Section 12. - SPF Justice
Art. 2.12.1
Section 2.12.5 of the Act of 22 December 2003 containing the General Estimates for the 2004 Budget Year is amended as follows:
in paragraph 2: PROGRAMME 40/3 - STUDIES AND DOCUMENTATION, the following points are added:
4) Grant to the public interest agency "Belgian Committee for UNICEF".
5) Grant to the "Councilation of NGs for the Rights of the Child" and the "K Kinderrechten Coalitie Vlaanderen".
Section 14. - SPF Foreign Affairs,
Foreign trade and development cooperation
Art. 2.14.1
The text of section 2.14.4 of the Act of 22 December 2003 containing the General Estimates for the 2004 Budget Year is replaced by the following text:
The credits in programme 42/0 (A.B. 42.04.03.50) are intended to provide permanent working capital for the payment of expenses related to the operating and investment costs of Belgian diplomatic and consular posts and permanent representations to international bodies. Expenditures on these advances are regulated by imputation on the budgetary appropriations provided for this purpose. For the same purpose and with the application of the same budgetary regulation procedure, the Treasury is also authorized to replenish these working capitals abroad.
Art. 2.14.2
Section 2.14.6 of the Act is amended to read:

(12) Various contributions to international organizations including UNESCO, the International Labour Organization, the International Organization of Migration and the International Centre for Migration Policy Development.
Under PROGRAMME 54/4 - SPECIAL PROVISIONS replace the text of item 8 with:

Art. 2.14.3
The text of section 2.14.6 of the Act is supplemented as follows:
For grants and allowances granted under program 53/4 - Humanitarian assistance, in the context of conflict prevention, peacebuilding and human rights, as well as in the context of prevention, emergency assistance, short-term rehabilitation assistance and humanitarian action, and on the other hand, under program 54/4 - Special interventions, in the context of transition, reconstruction and consolidation of society, the assignment of goods or services on a free basis. Legislation and regulation in public procurement are applicable in the procurement of goods and services to be disposed of.
Art. 2.14.4
The amount of the commitment authority for the Belgian Survival Fund, listed under section 2.14.9 of the Act of 22 December 2003 containing the General Estimates for the fiscal year 2004, is replaced by the amount of 39.500,000 euros.
Art. 2.14.5
The second sentence of section 2.14.11 of the Act is supplemented as follows:
"or, for basic allocations 53.41.35.24 - Conflict prevention, peacebuilding and human rights and 53.41.35.80 - Prevention, emergency assistance, short-term rehabilitation and humanitarian action, the Minister of Foreign Affairs. »
Art. 2.14.6
The amount of authorization for the loan program to foreign states, listed under section 2.14 of the Act of 22 December 2003 containing the General Estimates for the fiscal year 2004, is replaced by the amount of €32,800,000.
Section 16. - Ministry of National Defence
Art. 2.16.1
The text of section 2.16.13 of the Act of 22 December 2003 containing the General Estimates for the 2004 Budget Year is replaced by the following text.
The Minister of Defense is authorized to use, up to 800,000 euros, revenues from the interest generated by the advances deposited with the Federal Reserve Bank of New York as part of the contracts for the supply of aircraft, logistics support, ground installations and related costs for the entire F16 fleet.
These interests will be charged to Account 87.07.03.27 C of the Treasury Order Operations Section. They will be used to cover the costs resulting from the above-mentioned markets.
The Minister of Defence is authorized, in the same markets, to use refunds collected for the sale of F16 aircraft by the United States, to third countries ("coupments for tooling"), up to EUR 1.6 million.
Art. 2.16.2
The text of the first and second paragraphs of section 2.16.24 of the Act is replaced by the following:
By derogation from the provisions of Article 28, 2nd paragraph, of coordinated laws on State accounting, the Minister of Defense is authorized to acquire a mine control simulator by means of a joint financial participation of the Kingdom of Belgium and the Kingdom of the Netherlands.
By derogation from the provisions of section 19 of the Act of 24 December 1993 on public procurement and certain contracts of work, supplies and services, the Minister of Defence is authorized to enter into a single market, awarded in accordance with the provisions of the Act of 24 December 1993 referred to above and for the joint acquisition of a mine control simulator with the Netherlands that mandate it to do so.
Section 17. - Federal police and integrated operation
Art. 2.17.1
The Minister of the Interior is authorized to make revenue and to affect payments made by staff members or other third parties:
1° in repair of unfit use, loss or degradation of federal police equipment;
2° in payment of their share in invoices in obligations contracted by the federal police, but which cannot be charged directly to these third parties by the contractor.
The revenues covered are included in section 16.01 of the Ways and Means Budget and are allocated to the Organic Budget 17-1 " Third-party benefits against payment" that is linked to Program 17-45.
Art. 2.17.2
If pursuant to Article 115, § 10 of the Act of 7 December 1998 organizing an integrated, two-tiered police service, as amended by the Program Law of 22 December 2003, and the order made pursuant to the same section, in the event of non-payment by the multi-communal police zones and the municipalities of the deliveries made for their benefit, the amounts are retained on the endowments allocated to them:
1° transferred from the basic allowances "endowments" to programme 17-90-1 to the basic allowances of Section 17 on which pre-financing took place, if unliquidated invoices relate to the benefits referred to in Article 115, § 9, 2° (including energy and telephone costs) of the law of 7 December 1998 organizing an integrated police service, two-tier structure, replaced by the law of 26 April 2002;
2° transferred from the basic allowances "endowments" to programme 17-90-1 to the Voys and Means Budget with the budgetary funds 17-2 or 17-3 for the purpose of clearing the debt balance found therein, if the unliquidated invoices relate to the benefits referred to in section 115, § 5, paragraph 1erthe same Act, as amended by the Program Act of 22 December 2003, or by section 406 of the Program Act of 22 December 2003.
Art. 2 .17.3
During the year 2004, on the organic budget fund 17-2 "Fund for the delivery of clothing and equipment against payment to police personnel", is authorized, in commitment and in order, a debt balance that cannot exceed, respectively 9.250.000 euros and 3.000.000 euros.
Art. 2.17.4
By derogation from section 406, § 3, of the Program Law of December 22, 2003, variable appropriations related to the 17-3 Fund are, for the year 2004, included in the Basic Allowance 17-90-31-1122 of the General Estimates.
Art. 2.17.5
By derogation from article 34, paragraph 2, of the Acts on State Accounting, coordinated on 17 July 1991, the balances still available as of 31 December 2003 from the undivided credits of the fiscal year 2002, recorded in basic allocations 21.11.03, 22.12.01, 22.12.04, 22.33.04, 22.74.01 and 22.74.04 of programme 90/2 of Section 17 - Federal police and integrated operation, are deferred to 2004 and may be used from the beginning of this year to order any expenditure incurred during the 2002 fiscal year in charge of these same basic allocations.
Section 18. - SPF Finance
Art. 2.18.1
§ 1. By derogation from section 1-01-3, § 3, of the Act of 22 December 2003 containing the general budget of expenditures for the fiscal year 2004, the undivided credits from the basic allocations referred to in the above-mentioned paragraph relating to operating expenses may be redistributed, within the program 40/0 - Management bodies, from section 18 - SPF Finance, to the segregated credits of basic allowances - 40.02.12.08. Operating costs under Coperfin and 40.02.74.08 - Investment expenditures under Coperfin.
§ 2. By derogation from section 1-01-03, § 3, of the Act of 22 December 2003 containing the General Estimates for the fiscal year 2004, the basic allocations referred to in the above-mentioned paragraph concerning operating expenses may also be redistributed to programs 80/4, 80/5 and 80/6 of section 18 - SPF Finance, to the basic allowance 34.41- Losses resulting from deficits of State accountants and extraordinary events.
Section 19. - Buildings Regime
Art. 2.19.1
In section 2.19.2 of the Act of 22 December 2003 containing the General Estimates for the fiscal year 2004, the amount of 32.783.230 euros is replaced by 119.994.553 euros. In addition, the table is replaced by the following table:

The text of section 2.19.5 of the Act is replaced by the following text:
The Buildings Authority is authorized to make expenditures for first-time work in buildings leased by it for the use of services to which it must provide housing under the Act of 1er April 1971, establishing a Buildings Board.
If it is installation work that can be considered as standard completions or equipment, these costs are borne by the Régie des buildings budget.
If, on the other hand, it is installation work that comes from the needs of the current or future occupant and cannot be considered as standard completions or equipment, the costs are borne by the occupant. In this case, the Buildings Regime receives, prior to the payment of expenses, advances from the occupying services. It will not be possible for the Régie des buildings to make any pre-financing of these expenses.
Art. 2.19.3
The text of section 2.19.4 of the Act is supplemented by the following paragraph:
The Régie des buildings is also authorized to make expenses for the decoration of the fenestration of the official parts of the Royal Palace of Laeken.
Art. 2.19.4
The text of section 2.19.7 of the Act is replaced by the following text:
The Authority of Buildings is authorized to cover expenses relating to fixed rental costs of the personal secretariats and strategic bodies of ministers and state secretaries housed in state buildings or in leased buildings that do not cohabit with their administration. The amount of these expenses is limited to 49,579 euros per minister and 24,789 euros per secretary of state for the buildings of the state and 99,157 euros per minister and 49,579 euros per secretary of state for the leased buildings. The guidelines for the distribution and use of this credit are set in concert by the Minister of Budget and the Minister who has the Régie des buildings in his duties.
Must be considered to be rental charges, such as central heating and air conditioning maintenance costs, window washing fees, lawn maintenance fees and telephone exchanges, elevators and other lifting facilities, electrical and safety facilities, common parts charges, maintenance fees for parks, parks and gardens, management fees, management fees and security fees
Section 21. - Pensions
Art. 2.21.1
In section 2.21.3, 2nd paragraph, of the Act of 22 December 2003 containing the general budget of expenditure for the fiscal year 2004, the amount of 162.000.000 euros is replaced by the amount of 284.000.000 euros.
Section 23. - SPF Employment, Labour and Social Concertation
Art. 2.23.1
Section 2.23.5 of the Act of 22 December 2003 containing the General Estimates for the 2004 Budget Year is replaced by the following:
The maximum amount of commitment authorization for the year 2004 available to the European Social Fund is 12,284,000 euros.
Any undertaking under this Article shall be subject to the visa of the Registrar of Commitments and the Court of Accounts.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Accounts, together with supporting documents, a statement made in three copies and mentioning, on the one hand, the amount of commitments covered in the past month and, on the other hand, the amount of commitments covered since the beginning of the year.
The Organic Budget Fund "Belgian European Social Fund" is authorized to present a debiting position, which cannot exceed in order the amount of 8.900.000 euros.
Art. 2.23.2
By derogation from Article 45, § 2, the State Accounting Acts, coordinated on July 17, 1991 the means available as of December 31, 2004 of the "Employment Fund" (Program 56/4) are disaffected and added to the general resources of the Treasury.
Section 25. - SPF Public Health, Food Chain Safety and Environment
Art. 2.25.1
In section 2.25.4 of the Act of 22 December 2003 containing the General Estimates for the 2004 Budget Year, the following references are deleted:
- in PROGRAMME 51/1 - FINANCING OF SOINS
Grants to Colleges of Physicians in view of the Royal Decree of February 15, 1999.
Subsidies to two coupole organizations within the framework of patient associations.
- in PROGRAMME 51/3 - MEDICAL AIDE URGENTE
Subsidy to the Red Cross of Belgium on urgent medical assistance.
- in PROGRAMME 52/2 - SANITARY VIGILANCE CELLUL
Basic scientific research and international exchange of data on recent developments and problems in the field of prophylaxis and hygiene.

- in PROGRAMME 56/4 - SCIENTIFIC INSTITUT OF THE PUBLIC HEALTH PASTER (ANCIEN INSTITUT PASTER)
Subsidies granted by the Institut Pasteur for investigations or research carried out for or in collaboration with the Institut Pasteur, in the context of contracts or agreements with academic centres, other scientific institutions, public institutions or study services.
Art. 2.25.2
In section 2.25.4 of the Act the following are added:
- in PROGRAMME 51/2 - POLICY OF SOINS
Subsidies to various associations for the supervision and support of the citizen in his capacity as "patient".
Subsidies to ASBL Medical errors.
- in PROGRAMME 52/1 - PROFESSIONS OF HEALTH
Subsidies to integrated home care services.
- in PROGRAMME 52/4 - ORGANIZATION AND PLANNING
Subsidies to the FARMAKA ABL for the information of general practitioners on the proper use of antibiotics.
Subside to ABL Belgian Pharmacotherapeutic Information Centre for the project "Guide of Antibiotics".
- in PROGRAMME 55/2 - CLIMATIC CHANGEMENTS
Granting a capital of up to 1.5 million euros to an anonymous public law company to be established by the Federal Investment Corporation to improve and realize the eco-efficiency of the Belgian economy.

Subsidies to national and international associations and organizations active in the field of the marine environment:
Subsidies to initiatives related to symposiums and awareness-raising campaigns, study days and the dissemination of information on awareness of marine issues, scientific collaboration with some institutions and organizations.
Subsidies to public sector associations and organizations:
Subsidies to scientific cooperation with some institutions for the protection of the marine environment and/or for the creation of marine protected areas.
Subsidies for both the private and public sector and as an intervention in the costs related to the commitments and/or investments undertaken by these institutions in the fight against oil pollution and other pollutions (among other subsidies to the asbl Revalidation Centre for Birds and Wildlife in Ostend).
Subsidies for direct financing of meetings in Belgium of experts from international organizations with regard to marine policy.
Art. 2.25.3
In section 2.25.6 of the Act, the amount of 186.399.833 for revenues is replaced by the amount of 169.854.924 euros, and the amount of 180.197.157 euros for expenses is replaced by the amount of 181.504.599 euros.
Art. 2.25.4
By derogation from Article 45, § 2, of the State Accounting Laws, coordinated on 17 July 1991, the available means of the Primary Materials Fund (Program 54/4) are disaffected and added to the general resources of the Treasury.
Art. 2.25.5
By derogation from Article 45, § 2, of the State Accounting Acts, coordinated on 17 July 1991 the available means of the Health and Quality of Animals and Animals Fund (Program 54/6) are disaffected and added to the general resources of the Treasury.
Art. 2.25.6
By derogation from Article 15 of the State Accounting Laws, coordinated on July 17, 1991, the credits on basic allowances 40.01.33.05 and 40.01.33.06, provided for the subsidy to the asbl "Social Service of the SPF Public Health, Safety of the Food Chain and Environment, and the SPF Social Security" can be redistributed to the basic allowances for the specific costs of personnel or operations of the SPF
Art. 2.25.7
Expenditures relating to prior budgetary years may be charged against current year appropriations in the following cases:
- Miscellaneous costs (rental charges, personnel, consumer expenses) related to the operation of departmental offices.
- Expenditures on attendance tokens and travel and residence allowances awarded to the chairs and members of the boards and boards installed in the department.
Section 32. - SPF Economy, P.M.E., Average Classes and Energy
Art. 2.32.1
Section 2.32.4 of the Act of 22 December 2003 containing the General Estimates for the 2004 Budget Year is amended for the following programs:
PROGRAMME 48/4
SUBVENTIONS TO EXTERNAL BODIES AND ECONOMIC MANIFESTMENTS
1. Grant to the International Institute of Statistics at the Hague.
2. Grant to the Belgian Society of Demography.
3. Grant to the Belgian Statistical Society.
4. Economic events (Royal Decree of 9 April 1962) both in Belgium and abroad (participations, various interventions, purchase or rental of equipment).
5. Grant to the ETRIOS Institute, European Training and Research Institute for Official Statistics.
PROGRAMME 49/1
PROTECTION OF THE RIGHT TO CONSOMMATION
1. Grant to the Consumer Organizations Research and Information Centre (CRIOC).
2. Grant to the ABL "Travel Litigation Commissions".
3. Grant to associations in the context of consumer protection and information.
Art. 2.32.2
By derogation from Article 45, § 2, of the laws on State accounting, coordinated on 17 July 1991 the available means of the Fund for the Production and Protection of Plants and Plant Products (Division 54, Programme 2, SPF Economie, P.M.E., Classes Moyennes et Energie) are disaffected and added to the general resources of the Treasury.
Section 33. - SPF Mobility and Transport
Art. 2.33.1
Section 2.33.1 of the Act of 22 December 2003 containing the General Estimates for the 2004 Budget Year is replaced by the following provision:
§ 1er. By derogation from Article 15 of the Organic Law of the Court of Accounts of 29 October 1846, advances of funds may be made to the extraordinary accountants of the services that are part of the Federal Public Service Mobility and Transport for a maximum amount of 175,000 euros to the effect of paying claims that do not exceed 2.500 euros concerning:
- the purchase of unsustainable goods and services;
- the purchase of heritage furniture;
- the fees of lawyers and doctors and the remuneration of foreign experts to the Federal Public Service and third-party benefits as well as the tokens of presence that are due to them, the costs of road and residence;
- expenditure on water, gas and electricity consumption, telephone costs and fuel consumption expenses for vehicles;
- compensation to third parties arising from State responsibility;
- the various allowances of State staff and the Minister's strategic bodies for real expenses and property damages as well as the transportation costs for the travel of service and insurance premiums of the Federal Public Service delegates who travel abroad, including the intervention of the employer state in the price of the social subscription.
However, the accountants of the Budget and Management and Logistics Service Supervision Service will be able to have advances of funds in a maximum amount of 500,000 euros as a result of paying such claims.
Accountants of the Management Budget and Control Service may also have advances of funds in a maximum amount of 75,000 euros for the payment of receivables that do not exceed 2.500 euros and that relate to:
- various social relief and allowances for pensioned personnel, former agents and beneficiaries for the Federal Public Service as a whole;
- special relief to certain categories of victims of occupational accidents.
With advances in funds, these extraordinary accountants are allowed to pay expenses not exceeding 2,500 euros; accountants are nevertheless allowed to pay phone and postal expenses up to 5,000 euros.
§ 2. Authorization is given to the Accountants of the Budget and Management Control Service to make the necessary advances to officials and experts on mission abroad, even if these advances are greater than 2.500 euros.
Art. 2.33.2
Section 2.33.3 of the Act is replaced by the following provision:
The Minister of Mobility is authorized to grant compensation or relief under the conditions that he or she will determine, to former pensioners or not as a result of accidents in service or occupational accidents or for health reasons, as a result of not treating them less favourably than workers in similar conditions, and notwithstanding the provisions of the Civil Pension Act of 21 July 1844.
Art. 2.33.3
Section 2.33.4 of the Act is amended for the following programs:
Within the limits of the basic allowances concerned, the following subsidies may be granted:

Subsides to the ABL Social Service of the Federal Public Service Mobility and Transport.
PROGRAMME 51/1. - RAIL TRANSPORT
(1) Subsidies for the financing of measures to promote public transport.
(2) Subsides to the User Advisory Board.
3) Grants for investment and tariff integration costs.
(4) Subsides under the Rosetta Plan.
5) RER Subsides
(6) Subsidies for the promotion of combined transport.
PROGRAMME 56/2. - TRANSPORT INFRASTRUCTURE
(1) Interventions in information and propaganda;
(2) Atomium restoration subsidies;
(3) Subsides line 26;
4) Subsides Palais des Beaux Arts.
Art. 2.33.4
Section 2.33.6 of the Act is replaced by the following provision:
"The amount of 100.000.000 euros taken from the proceeds of the tax of the natural persons to be allocated to the Fund of Financing the International Role and the Brussels Capital Function pursuant to Article 3 of the law of 10 August 2001 creating the said fund is increased by 1.190.000 euros (programme 33.56.22). »
Section 44. - SPP Social integration, poverty reduction and social economy
Art. 2.44.1
In section 2.44.7 of the Act of 22 December 2003 containing the General Estimates for the fiscal year 2004, the amount of 246.143.476 euros is replaced by the amount of 234.508.356 euros, for both revenue and expenditure.
Art. 2.44.2
Section 2.44.9 of the Act is replaced by the following:
The maximum amount of commitment authority for the year 2004 available to the Social Economy Fund under social programming 2000 - 2006 is set at 6.600,000 euros.

The transactions carried out on the restitution and allocation funds during the 2004 fiscal year are reassessed in accordance with the table annexed to this Act.
CHAPTER 4. - Separate Management State Services
Art. 4-01-1
The budgets of the State Services for separate management of the 2004 fiscal year are adjusted in accordance with the tables annexed to this Act.
CHAPTER 5. - State enterprises
Art. 5-01-1
The budget for the 2004 fiscal year of the state enterprise "La Monnaie Royale de Belgique", is re-estimated to the sums mentioned in the table annexed to this Act.
CHAPTER 6. - Public bodies
Art. 6-01-1
The budgets of the public interest agencies of category A of the 2004 fiscal year are adjusted in accordance with the tables annexed to this Act.
CHAPTER 7. - Final provision
Art. 7-01-1
This Act comes into force on the day of its publication in the Belgian Monitor.
