The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. It is assented to the Agreement of Cooperation of 10 December 2003 between the Federal State, the Flemish Community, the French Community, the German-speaking Community, the Joint Community Commission, the French Community Commission, the Flemish Region, the Walloon Region and the Brussels-Capital Region for collaboration in the fields of environment and health.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.

Agreement of cooperation of 10 December 2003 between the Federal State, the Flemish Community, the French Community, the German-speaking Community, the Joint Community Commission, the French Community Commission, the Flemish Region, the Walloon Region and the Brussels-Capital Region for collaboration in the areas of the environment and health
Considering articles 38, 39, 136, 137 and 138 of the Constitution;
Considering the special law of institutional reforms of 8 August 1980 as amended by the special laws of 8 August 1988, 16 July 1993 and 13 July 2001, including articles 5, § 1er I, 1° and 2°, 6, § 1er II and 92 bis, §§ 1er5 and 6;
Considering the law of institutional reforms for the German-speaking Community of 31 December 1983, in particular articles 4 and 5;
Considering the special law of 12 January 1989 on Brussels institutions as amended by the special laws of 16 July 1993 and 13 July 2001 in particular articles 4, 42, 60, 61 and 63;
Considering the Decree (II) of 19 July 1993 of the French Community assigning the exercise of certain competences of the French Community to the Walloon Region and to the French Community Commission in particular Article 3, 6°;
Considering the Decree (II) of 22 July 1993 of the Walloon Region assigning the exercise of certain competences of the French Community to the Walloon Region and to the French Community Commission in particular Article 3, 6°;
Having regard to the decree (II) of the French Community Commission of 22 July 1993 attributing the exercise of certain competences of the French Community to the Walloon Region and to the French Community Commission in particular Article 3, 6°;
Having regard to the decision of the Government-Executive Consultation Committee of 9 May and 13 June 1989 creating an inter-ministerial Conference of the Environment;
In view of the protocol of 27 October 1999 regulating the various forms of collaboration between the Federal Government and the Governments of the Communities and the Regions;
Having regard to the Circular of 12 September 1995 on inter-ministerial conferences;
Considering the opinion of the Council of State of 24 June 2003;
Considering the commitments made at the Ministerial Conferences "Environmental Health" of the World Health Organization European Region in Helsinki (1994) and London (1999);
Considering the definition of the relationship between the environment and health of the WHO in 1993. "The relationships between the environment and health cover aspects of human health, including the quality of life, which are determined by the physical, biological, social and psychosocial factors of the environment. This includes the theoretical and practical aspects of the assessment, correction, control and prevention of environmental factors that may potentially adversely affect the health of present and future generations."
Considering the many possible sources and influences of environmental pollution on health and the large number of actors involved in the relationship between the environment and health;
Considering that environmental policy and health policy require policy dialogues for action areas where they are linked and influenced by each other, and that this coherence must be based on a transdisciplinary approach as operational as possible;
Considering that the consultation on the relationship between the environment and health must respect the respective autonomy of the Federal Authority, the Regions and the Communities with regard to its development and implementation with respect to their own legislation and other management tools;
Considering that the 6th Programme of Environmental Action of the European Union has a chapter devoted to environmental-health relations;
Considering that an execution schedule must accompany the NEHAP, including a strategy to update the NEHAP with a view to taking into account the changing environment-health relations situation;
Considering that NEHAP should be implemented step by step and its results regularly evaluated;
Based on these reasons, the establishment of a national plan on the relationship between the environment and health is a step forward in implementing a coherent cross-cutting approach that brings together all stakeholders involved in the areas of health and the environment.
The federal state, represented by the minister with public health in his or her powers and by the Minister with the Environment in his or her powers;
The Flemish Community, represented by the Flemish Government in the person of its Minister-President, the Minister with the Environment in his powers and the Minister with Health in his powers;
The Walloon Region, represented by the Walloon Government in the person of its Minister-President, the Minister with the Environment in his powers and the Minister with Health in his powers;
The Brussels-Capital Region, represented by the Government of the Brussels-Capital Region in the person of its Minister-President and the Minister with the Environment in its responsibilities;
The French Community, represented by the Government of the French Community in the person of its Minister-President and by the Minister with Health in its functions;
The German-speaking Community, represented by the Government of the German-speaking Community in the person of its Minister-President and by the Minister with Health in its functions;
The Joint Community Commission, represented by the Joint Community Commission College in the person of its Chair and members with health policy in their responsibilities;
The French Community Commission, represented by the College of the French Community Commission in the person of its President and by the member with health policy in its functions;
Jointly exercising their respective competencies agreed as follows:
CHAPTER Ier. - Definitions
Article 1er. In this Agreement:
1. NEHAP: the national environmental-health action plan that incorporates key federal, regional and community-based data on the relationship between the environment and health and the plans and actions of the authorities concerned;
2. Federal Authority: Ministers and/or State Secretaries with Public Health and/or the Environment in their responsibilities;
3. Regional Ministers: Ministers with the environment and water policy as defined in Article 6, § 1er II of the Special Law; and health policy as defined in Article 5, § 1er I 1° of the special law;
4. Community Ministers: Ministers with health policy, as defined in Article 5 § 1er I, 1° and 2° of the special law;
5. ISSUES: The Interdepartmental Conference of the Environment Expanded to Health;
6. Cell: The Environment-Health Cell as a consultative structure in the field of relations between the environment and health established by this agreement between the Federal Authority, the Regions and the Communities;
7. Special Law: The Special Law on Institutional Reforms of 8 August 1980 as amended by the Special Laws of 8 August 1988, 16 July 1993 and 13 July 2001.
CHAPTER II. - Objective(s)
Art. 2. The purpose of this Agreement is to:
1. To ensure coordination of the drafting, monitoring of the implementation and revision of NEHAP;
2. to ensure, where competences are divided between the parties to this Agreement, a coordinated implementation of the NHLAP to the extent that the actions and projects concerned meet the cross-sectoral, cross-territorial and transdisciplinary criteria and require joint funding.
CHAPTER III. - Missions, structure and operation of the Conference and the Environment-Health Cell
Missions
Art. 3. The consultation between the Federal Authority, the Regions and the Communities on a coordinated management of environmental and health policies takes place within the framework of this agreement.
Section 1re. - ICMS
Art. 4. ICMS is chaired by the Minister or Secretary of State with the environment in his or her responsibilities.
It meets at least once a calendar year and ensures the effective implementation of this Agreement.
Art. 5. ICMS identifies the priority overarching areas in the implementation and monitoring of this cooperation agreement.
It identifies priority overarching areas in the implementation and monitoring of NEHAP.
It examines the assessment of NEHAP, which is submitted to it at half of the overall duration of it by the Environment-Health Cell.
It adopts the revisions to NEHAP, based in particular on proposals made by the Environment-Health Cell.
Art. 6. CIMES examines the annual activity report submitted by the Environment Health Unit and its programme of activity, objectives and budget for the coming year of work and approves it eventually after changes.
Art. 7. ICMS adopts its own rules of procedure at its first meeting following the signing of this agreement.
Section 2. - Environment Health Cell
Art. 8. The Cell is the preparatory body for the ICMS. It performs the tasks assigned to it by it.
The Unit is responsible for coordinating the monitoring of the implementation of NEHAP. It assesses it on a mid-term basis and proposes to CIMES, no later than three months before the end of the latter, an updated NEHAP project and recommendations.
Art. 9. The Cell is composed as follows:
1 representative designated by each Federal and Regional Minister of the Environment and each Federal, Regional and Community Health Minister.
Art. 10. The Cell shall designate among its members, on an annual basis and by consensus, a president according to the following rotation: Federal Authority-Regions-Communautés.
He is assisted by a vice-president from another level of power and the other sector.
In the event of a lack of consensus, the chair in office remains in charge as long as a successor is not chosen. In the event of a lack of consensus regarding the first president of the Cell, the Cell will be designated by the President of CIMES.
Art. 11. The Cell shall meet every three months or within fifteen days of the request of a majority of its members to its President.
Art. 12. The Cell shall adopt its rules of procedure within three months of its entry into office and submit it for approval to the CIMES. It organizes its work independently and submits an annual activity report to CIMES for adoption, including the use of budgetary and personal resources, as well as an activity program, including objectives and a budget, for the coming year of work.
Art. 13. In carrying out its tasks, the Cell is assisted by a permanent secretariat as described in Article 18, which convenes and prepares its meetings, prepares a proposal for an agenda and prepares minutes of meetings.
Section 3. - Provisions concerning the implementation of international obligations in the field of the Environment and Health
Art. 14. With regard to this matter, the cell is only seized at the express request of the ICMS.
CHAPTER IV. - Budgetary provisions
Art. 15. The Federal Authority shall pay its full costs for the meeting of the ICMS under Chapter 3 Section 1 of this Agreement.
Art. 16. The Federal Authority, the Regions and the Communities shall, in accordance with Article 6, take charge of the operating costs of the Cell under Chapter 3, Section 2 and 3 of this Agreement.
These fees will meet the following distribution key:
- Federal Authority 30%;
- Flemish Community and Region 39%;
- French Community 6%;
- German-speaking Community 0.5%;
- Brussels Capital Region 3.25 per cent;
- Communal Commission 2 per cent;
- Commission Communautaire Française 1.25 %;
- Walloon Region 18%.
Art. 17. The distribution key, as defined in Article 16, will also apply to actions and projects, corresponding to the criteria of Article 2.2, proposed by the Cell and adopted by the ICMS, and conducted jointly by the parties to this Agreement.
Art. 18. The permanent secretariat of the Cell includes at least one person at level A and 2 persons at level B. The personnel and operating costs of the permanent secretariat are borne by the Federal Authority.
CHAPTER V. - Final provisions
Art. 19. Any dispute between the parties relating to the interpretation and implementation of this Agreement shall be submitted to the ICMS.
If no consensus is found within the latter, the dispute is subject to a jurisdiction referred to in Article 92 bis, §§ 5 and 6, of the special law.
Each party to the agreement shall designate a member to the cooperation jurisdiction and notify in writing its decision to the President of the ICMS.
The cooperation court shall notify in writing its decision to the President of CIMES.
The Federal Authority, the Regions and the Communities shall, in accordance with the distribution key provided for in Article 16, take charge of the operating costs of the cooperation jurisdiction.
Art. 20. This agreement is issued to the Belgian Monitor by the SPF Chancellery of the Prime Minister, at the request of the parties whose legislators have given their consent to the agreement in the last place.
Art. 21. The Federal Authority, the Regional and Community Ministers, shall designate the members of the Cell within three months of the coming into force of this Agreement.

Aufgrund der Entscheidung des Beratungsausschusses Regierungs-Exekutiven vom 9. May und 13. Juni 1989 über die Einrichtung einer interministeriellen Umweltkonferenz;
Aufgrund des Protokolls vom 27. Oktober 1999 zur Regelung der verschiedenen Formen der Kooperation zwischen der föderalen Regierung und den Regierungen der Gemeinschaften und der Regionen;
Aufgrund des Rundschreibens vom 12. September 1995 über die interministeriellen Konferenzen;
Aufgrund dem Gutachten des Staatsrates vom 24. Juni 2003;
In Erwägung der Verpflichtungen, die auf den Ministerkonferenzen "Uwelt und Gesundheit" der Weltgesundheitsorganisation (Regionalbüro für Europa) in Helsinki (1994) und London (1999) eingegangen wurden;
In Erwägung der WHO-Definition der Zusammenhänge von Umwelt und Gesundheit 1993:
« Sie umfassen die Aspekte der menschlichen Gesundheit, einschliesslich der Lebensqualität, die durch die physischen, biologischen, sozialen und psychosozialen Umweltfaktoren bestimmt werden. Dieser umfasst die theoretischen und praktischen Aspekte der Bewertung, der Verbesserung, der Kontrolle und der Vorbeugung der Umweltfaktoren, die potentiall die Gesundheit der gegenwärtigen und künftigen Generationen nachteilig beeinflussen könen
In Erwägung der zahlreichen Queln und möglichen Einwirkungen der Umweltverschmutzung auf die Gesundheit und der vielen Beteiligten, die von den Zusammenhängen von Umwelt und Gesundheit betroffen sind;
In Erwägung, dass die Umweltpolitik und die Gesundheitspolitik für die Handlungsbereiche, in denen sie mit einander verbunden sind und durch einander beeinflusst werden, gemeinsam in Angriff genommen werden müssen und dassöfiese Kohärenz
In Erwägung, dass die Konzertierung hinsichtlich der Zusammenhänge von Umwelt und Gesundheit der jeweiligen Autonomie der Föderalbehörde, der Regionen und der Gemeinschaften nachkommen muss, was ihre Ausarbeitung und Ausführung
In der Erwägung, dass das Sechste Umweltaktionsprogramm der Europäischen Union ein Kapitel über die Zusammenhänge von Umwelt und Gesundheit umfasst;
In Erwägung, dass ein Ausführungszeitplan den nationalen Aktionsplan Umwelt und Gesundheit (NEHAP) einschliesslich einer Strategie begleiten muss, die ermöglichen soll, den NEHAP zu aktualisieren, um die Entwicklung der Lage
In Erwägung, dass der NEHAP Schritt für Schritt ausgeführt und seine Ergebnisse regelmässig bewertet werden müssen;
Aufgrund dieser Gründe stellt die Erstellung eines nationalen Plans über die Zusammenhänge von Umwelt und Gesundheit einen Fortschritt dar, der die Umsetzung von kohärenten Querschnittsmassnahmen erlaubt, die alle Beteiligten auf dem

Die Wallonische Region vertreten durch die Wallonische Regierung in der Person ihres Minister-Präsidenten, des Ministers, zu dessen Zuständigkeitsbereich die Umwelt gehört, und des Ministers, zu dessen Zuständigkeitsbereich die Gesundheit gehört;
Die Region von Brüssel Hauptstadt vertreten durch die Regierung der Region von Brüssel Hauptstadt in der Person ihres Minister-Präsidenten und des Ministers, zu dessen Zuständigkeitsbereich die Umwelt gehört;
Die Französische Gemeinschaft vertreten durch die Regierung der Französischen Gemeinschaft in der Person ihres Minister-Präsidenten und des Ministers, zu dessen Zuständigkeitsbereich die Gesundheit gehört;
Die Deutschsprachige Gemeinschaft vertreten durch die Regierung der Deutschsprachigen Gemeinschaft durch ihren Minister-Präsidenten und durch den Minister, zu dessen Zuständigkeitsbereich die Gesundheit gehört;
Die Gemeinsame Gemeinschaftskommission vertreten durch das Vereinigte Kollegium der Gemeinsamen Gemeinschaftskommission in der Person ihres Präsidenten und der Mitglieder, zu deren Zuständigkeitsbereich die Gesundheitspolitik gehört;
Die Französische Gemeinschaftskommission vertreten durch das Kollegium derö Franzsischen Gemeinschaftskommission in der Person ihres Präsidenten und des Mitglieds, zu dessen Zuständigkeitsbereich die Gesundheitspolitik gehört;
gemeinsam ihre jeweiligen Kompetenzen ausübend sind wie folgt übereingekommen :
KAPITEL I. - Definitionen
Artikel 1 - In diesem Abkommen versteht man unter :
1. NEHAP: der national Aktionsplan Umwelt und Gesundheit, in dem die föderalen, regionalen und gemeinschaftlichen Hauptdaten zu den Zusammenhängen von Umwelt und Gesundheit und zu den Plänen und Massnahmen der betroffen Behörden erw
2. Föderalbehörde : Die Minister bzw. die Staatssekretäre, zu deren Zuständigkeitsbereich die Volksgesundheit bzw. die Umwelt gehören;
3. Regionale Minister : Die Minister, zu deren Zuständigkeitsbereich die in Artikel 6 § 1 des Sondergesetzes definierte Umwelt und Wasserpolitik, sowie die in Artikel 5 § 1° des Sondergesetzes genannte Gesundheitspolitik gehören;
4. Gemeinschaftsminister : Die Minister, zu deren die in Artikel 5 § 1 I 1° und 2° des Sondergesetzes genannte Gesundheitspolitik gehört;
5. GIKUG: Die gemischte interministerielle Umwelt Konferenz, die auf die Gesundheit erweitert wird;
6. Zelle: Die Zelle Umwelt- Gesundheit als Beratungsstruktur im Bereich der Zusammenhänge von Umwelt und Gesundheit, die durch diese Vereinbarung zwischen der Föderalbehörde, den Regionen und den Gemeinschaften eingerichtet wird;
7. Das Sondergesetz : Das Sondergesetz über institutionelle Reformen vom 08. August 1980, abgeändert durch die Sondergesetze vom 08. August 1988, 16. Juli 1993 und 13. Juli 2001.
KAPITEL II. - Zielsetzungen
Art. 2 - Ziele dieses Abkommen sind es :
für die Koordinierung der Erstellung, Weiterverfolgung der Umsetzung und Revision of NEHAP Sorge zu tragen;
dort, wo die Kompetenzen unter den Vereinbarungsparteien aufgeteilt werden, dafür Sorge zu tragen, dass der NEHAP koordiniert umgesetzt wird, insofern die Aktionen und Projekte den Anforderungen der Intersektorialitäprechent
KAPITEL III. - Aufgaben, Struktur und Funktionieren der Konferenz und der Zelle Umwelt- Gesundheit
Art. 3 - Aufgaben.
Die Konzertierung zwischen der Föderalbehörde, den Regionen und den Gemeinschaften über die koordinierte Durchführung der Umwelt- und Gesundheitspolitiken findet im Rahmen dieser Vereinbarung statt.
Abteilung 1. - Die GIKUG
Art. 4 - Der Minister oder der Staatssekretär, zu dessen Zuständigkeitsbereich die Umwelt gehört führt den Vorsitz der GIKUG.
Die GIKUG trifft sich mindestens einmal pro Kalenderjahr. Sie sorgt für die gute Ausführung dieser Vereinbarung.
Art. 5 - Die GIKUG bestimmt die vorrangigen allgemeinen Themenbereiche in der Umsetzung und Weiterverfolgung dieser Kooperationsvereinbarung.
Sie bestimmt die vorrangigen allgemeinen Themenbereiche in der Umsetzung und Beobachtung des NEHAP.
Sie untersucht die Bewertung des NEHAP, die ihr die Zelle Umwelt- Gesundheit in der Hälfte der Gesamtdauer dieses Plans unterbreitet.
Sie nimmt die Revisionen des NEHAP an, indem sie sie sich insbesondere auf die Vorschläge basiert, welche die Zelle Umwelt- Gesundheit gemacht hat.
Art. 6 - Die GIKUG untersucht den durch die Zelle Umwelt - Gesundheit vorgelegten Jahrestätigkeitsbericht, sowie ihren Tätigkeitsplan, ihre Zielsetzungen und ihren Haushalt für das kommende Arbeitsjahr und billigt ihn eventuell nach Abänderun
Art. 7 - Die GIKUG nimmt ihre eigene Geschäftsordnung in ihrer ersten Sitzung nach der Unterzeichnung dieser Vereinbarung an.
Abteilung 2. - Die Zelle Umwelt - Gesundheit
Art. 8 - Die Zelle ist das vorbereitende Organ der GIKUG. Sie führt die Aufgaben aus, die diese ihr zuteilt.
Die Zelle wird damit beauftragt, die Weiterverfolgung der Umsetzung des NEHAP zu koordinieren. Sie sorgt für eine zwischenzeitliche Bewertung und schlägt der GIKUG spätestens drei Monate vor dem Fälligkeitsdatum derselben ein aktualisiertes Projekt des NEHAP und Empfehlungen vor.
Art. 9 - Die Zelle wird wie folgt zusammengesetzt:
Jeweils 1 Vertreter wird, von jedem föderalen und regionalen Umweltminister und von jedem föderalen, regionalen und gemeinschaftlichen Gesundheitsminister bestimmt.
Art. 10 - Die Zelle ernennt unter ihren Mitgliedern jährlich und durch Konsens einen Präsidenten turnusgemäss wie folgt: Föderalbehörde - Regionen - Gemeinschaften.
Er wird von einem Vizepräsidenten unterstützt, der aus einer anderen Machtebene und aus dem anderen Bereich stammt.
Bei fehlendem Konsens bleibt der amtierende Präsident im Amt, solange ein Nachfolger nicht gewählt wird. Bei fehlender Übereinstimmung über den ersten Präsidenten der Zelle wird dieser vom Präsidenten der GIKUG bezeichnet.
Art. 11 - Die Zelle trifft sich alle drei Monate oder innerhalb von fünfzehn Tagen nach dem an ihren Präsidenten gerichteten Antrag einer Mehrheit ihrer Mitglieder.
Art. 12 - Die Zelle nimmt ihre Geschäftsordnung innerhalb von drei Monaten nach ihrem Amtsantritt an und unterbreitet sie der GIKUG zur Billigung.
Sie organisiert selbständig ihre Arbeit und legt jährlich der GIKUG einen Tätigkeitsbericht zur Billigung vor. Dieser umfasst die Verwendung der Haushaltsmittel und des Personals sowie einen Tätigkeitsplan der Zielsetzungen und einen Haushalt für das kommende Arbeitsjahr beinhaltet.
Art. 13 - Für die Verwirklichung ihrer Aufgaben wird die Zelle von einem in Artikel 18 genannten ständigen Sekretariat unterstützt, der die Sitzungen einberuft und vorbereitet, eine Tagesordnung vorschlägt und die Protokolle der Sitzungen
Abteilung 3 - Bestimmungen über die Ausführung der internationalen Verpflichtungen auf dem Gebiet der Umwelt und Gesundheit
Art. 14 - In dieser Sache wird die Zelle auf ausdrücklichem Ersuchen der GIKUG eingesetzt.
KAPITEL IV. - Haushaltsbestimmungen
Art. 15 - Die Föderalbehörde übernimmt völlig die Sitzungskosten der GIKUG, die in Kapitel 3, Abteilung 1 dieser Vereinbarung vorgesehen sind.
Art. 16 - Die Föderalbehörde, die Regionen und die Gemeinschaften übernehmen gemäss Artikel 6 die Verwaltungskosten der Zelle, die in Kapitel 3, Abteilungen 2 und 3 dieser Vereinbarung vorgesehen sind.
Diese Kosten werden dem folgenden Verteilungsschlüssel entsprechen:
- Föderalbehörde 30%;
- Gemeinschaft und Flämische Region 39%;
- Französische Gemeinschaft 6%;
- Deutschsprachige Gemeinschaft 0.5%;
- Region von Brüssel-Hauptstadt 3.25%;
- Gemeinsame Gemeinschaftskommission 2%;
- Französische Gemeinschaftskommission 1.25%;
- Wallonische Region 18%.
Art. 17 - Der in Artikel 16 bestimmte Verteilungsschlüssel findet ebenfalls auf die Aktionen und Projekte Anwendung, entsprechend den Anforderungen des Artikels 2.2., die von der Zelle vorgeschlagen und von der GIKUG angenommen und von den Vereingeams
Art. 18 - Das ständige Sekretariat der Zelle schliesst mindestens 1 Person von Level A und 2 Personen von Level B ein. Die Personal- und Betriebskosten des ständigen Sekretariats werden von der Föderalbehörde getragen.
KAPITEL V. - Schlussbestimmungen
Art. 19 - Jede Meinungsverschiedenheit zwischen den Beteiligten bezüglich der Auslegung und Umsetzung dieser Vereinbarung wird der GIKUG unterbreitet.
Falls keine Übereinstimmung innerhalb diesem erzielt werden kann, wird die Meinungsverschiedenheit einem in Artikel 92bis §§ 5 und 6 des Sondergesetzes vorgesehenen Gericht vorgelegt.
Jeder unterzeichnende Partner ernennt ein Mitglied für diese Gerichtsbarkeit und teilt dem Präsidenten der GIKUG schriftlich ihre Entscheidung mit. Die Gerichtsbarkeit setzt den Präsidenten der GIKUG schriftlich über seine Entscheidung in Kenntnis.
Dem in Artikel 16 vorgesehenen Verteilungsschlüssel entsprechend übernehmen die Föderalbehörde, die Regionen und die Gemeinschaften die Betriebskosten der Gerichtsbarkeit.
Art. 20 - Dieses Abkommen wird im belgischen Staatsblatt durch den FÖD Kanzlei des Premierministers auf Antrag der Partei, für die der Gesetzgeber als Letztes dem Abkommen zugestimmt hat, veröffentlicht.
Art. 21 - Die Föderalbehörde, die regionalen und gemeinschaftlichen Minister ernennen die Mitglieder der Zelle innerhalb von drei Monaten nach dem Inkrafttreten dieses Abkommens.
