ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. With a view to the transfer of legal pension obligations of B.I.A.C. with respect to its statutory staff and former statutory staff, including survival pensions in favour of their eligible persons and the charge of the funeral allowance, which is the result of section 190 of the Act of 21 March 1991 on the reform of certain economic public enterprises, the King may, by a deliberate order of the Councils, take all measures
1. modify and transfer to the State the above-mentioned obligations;
2. Dissolve in full law and liquidate the Statutory Staff Pension Fund of B.I.A.C., referred to in section 191 of the above-mentioned Act of 21 March 1991;
3. to settle between B.I.A.C., the Pension Fund and the State all financial and other obligations related to this transfer, in order to determine pensions in accordance with the pension legislation as it is in force on the day before the transformation of B.I.A.C. into an anonymous private corporation.
Art. 3. With a view to streamlining Belgocontrol's funding obligations with respect to the pensions of its statutory staff and its former statutory staff, including survival pensions in favour of the persons entitled to their statutory staff and former statutory staff and the charge of the funeral allowance, the King may, by a deliberate order in the Council of Ministers, take all necessary measures to:
1. to terminate financial obligations imposed on Belgocontrol under the Act of 28 April 1958 on the pension of staff of certain public bodies and their beneficiaries;
2. to develop a new funding mechanism for the phase-out and stabilization of the Belgocontrol financing requirement;
3. to settle, between Belgocontrol and the State, financial compensations and other obligations relating to this new regulation.
Art. 4. Orders adopted in accordance with articles 2 and 3 may amend, supplement, replace or repeal the existing legal provisions.
Art. 5. § 1er. The powers assigned to the King, by articles 2 and 3, expire on 30 June 2005.
§ 2. Orders adopted pursuant to sections 2 and 3 above cease to produce their effects if they are not ratified by law within nine months of their effective date.
§ 3. After 30 June 2005, the decrees adopted in accordance with Articles 2 and 3 and ratified in accordance with § 2, may only be amended, supplemented, replaced or repealed by a law.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
