To all, present and to come, Hi.
The House of Representatives adopted and sanctioned the following:
General provisions
Article 1er. This Act regulates a matter referred to in Article 74, 3° of the Constitution.
Art. 2. The General Estimates for the 2004 Budget Year are adjusted:
1° with respect to the appropriations provided for the Dots, in accordance with the table annexed to this Act;
2° in respect of credits by program, in accordance with the totals of the adjusted programmes in the departmental tables annexed to this Act.
Special provisions of departments
Section 03 - SPF Budget and Management Control
Art. 3. The text of section 2.03.2 of the Act of 22 December 2003 containing the General Estimates for the 2004 Budget Year is replaced by the following text:
"The provision under program 41/1 to cover expenses of any kind arising from career reform, the financing of the Belgian contribution in the new headquarters of NATO, the relocation of several federal public services, the initiative to reduce the debt of low-income countries (PPTE and PPTE-trust fund) and other miscellaneous may, after agreement of the Minister of Budget, be apportioned according to the requirements, by appropriate means of discontinuation
By derogation from Article 5, paragraph 2, of the Act of 16 March 1954 on the control of certain public interest bodies, the distribution by royal decree of this provisional credit may also increase the State's financial intervention in favour of public interest bodies".
Section 04 - SPF Personnel and Organization
Art. 4. The text of sections 2.04.3 of the Act is replaced by the following text:
"The provision in program 31/2 - Training of public servants, and to cover expenses of any kind related to training activities, may be apportioned as necessary, between the appropriate programmes of the budgets of the various departments, through a Royal Decree proposed by the Minister of Public Service and Modernization of Administration.
By derogation from Article 5, paragraph 2, of the Act of 16 March 1954 on the control of certain public interest bodies, the distribution by royal decree of this provisional credit may also increase the State's financial intervention in favour of public interest bodies".
Art. 5. The text of section 2.04.6 of the Act is replaced by the following text:
"The provisional credit included in program 31/1 - Personnel and Organization, and intended to cover expenses related to the awarding of an allowance to project development staff in certain public services, may, after agreement of the Minister of Budget, be apportioned as necessary, by Royal Decree, between the appropriate programmes of the budgets of the various departments.
By derogation from Article 5, paragraph 2, of the Act of 16 March 1954 on the control of certain public interest bodies, the distribution by royal decree of this provisional credit may also increase the State's financial intervention in favour of public interest bodies".
Art. 6. The Minister of Public Service is authorized, in litigation, to make transactions and make payments to the Caisse des Dépôts et Consignation.
Section 12 - SPF Justice
Art. 7. The text of section 2.12.4 of the Act is supplemented as follows:
« 4) Grants to public bodies and associations responsible for the guardianship of foreign minors".
Art. 8. In section 2.12.5 of the Act, the following section is inserted:
« PROGRAMME 40/2 - TUTELLE MINEURS ETRANGER
Grants to public bodies and associations responsible for the guardianship of foreign minors".
Section 19 - Buildings Regime
Art. 9. Article 2.19.4, paragraph 1erthe Act of 13 July 2004 containing the first adjustment of the General Estimates for the 2004 Budget Year is replaced by the following provision:
The Buildings Authority is authorized to cover expenses relating to fixed rental costs of personal secretariats and strategic bodies of Ministers and Secretaries of State who, since 1er January 2004 or on the date of their appointment, are housed in state buildings or in leased buildings that do not cohabit with their administration. The amount of these expenses is limited to 49,579 euros per minister and 24,789 euros per secretary of state for the buildings of the state and 99,157 euros per minister and 49,579 euros per secretary of state for the leased buildings. The guidelines for the distribution and use of this credit are set together by the Minister of Budget and the Minister who has the Régie des buildings in his powers.
Section 33 - SPF Mobility and Transport
Art. 10. The costs associated with the assistance for the sale of the participation of the Belgian State in Biac and Belgacom are compensated for the proceeds of this sale.
Final provision
Art. 11. This Act comes into force on the day of its publication in the Belgian Monitor.
Promulgation of this law, let us order that it be clothed with the seal to the State and published by the Belgian Monitor.
