12 JANVIER 2006. - An Act to amend the Act of 15 December 1980 on access to territory, residence, establishment and removal of aliens (1)



ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. In Part IV of the Act of 15 December 1980 on access to territory, residence, establishment and removal of aliens, an article 79bis is inserted, as follows:
"Art. 79bis. § 1er. Any person who enters into a marriage in the circumstances referred to in section 146bis of the Civil Code shall be liable to imprisonment for eight days to three months or to a fine of EUR 20 to 100.
Any person who receives a sum of money to pay for the conclusion of such a marriage shall be punished by imprisonment from fifteen days to one year or a fine from fifty to two hundred and fifty EUR.
Anyone who resorts to violence or threats against a person to compel him to enter into such a marriage shall be punished by imprisonment for a month to two years or a fine of one hundred to five hundred EUR.
§ 2. The attempted offence under § 1erParagraph 1er, is punished by a fine of twenty-six to fifty EUR.
The attempted offence under § 1er, paragraph 2, shall be punished by imprisonment from eight days to six months or a fine of twenty-six to one hundred and twenty-five EUR.
The attempted offence under § 1er, paragraph 3, shall be punished by imprisonment of fifteen days to one year or a fine of fifty to two hundred and fifty EUR.
Art. 3. This Act comes into force on the day of its publication in the Belgian Monitor.
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
